Abstract

This study discusses Indonesia's compliance with international trade law under globalization, economic integration, and domestic regulatory challenges. Compliance with international trade law is crucial for Indonesia to increase global market access, attract foreign investment, and strengthen the competitiveness of national products. Supporting factors for compliance include awareness of economic benefits, trade stability, and involvement in international trade organizations and agreements such as the WTO, ASEAN, and RCEP. On the other hand, there are inhibiting factors that include weak international law enforcement mechanisms and challenges in harmonizing national regulations with global trade standards. Globalization has accelerated Indonesia's integration into the world economy, demanding adjustments to trade policies to comply with international provisions despite challenges such as industrial competition and dynamics of domestic interests. International organizations, especially the WTO, play an essential function in ensuring Indonesia's compliance with trade law through monitoring and dispute resolution mechanisms. The compliance is driven by the basic principles of international trade law, such as non-discrimination, transparency, and fair trade, which require Indonesia to adjust its trade regulations to avoid sanctions and strengthen national economic stability. Thus, this study highlights that compliance with international trade law is not merely a legal obligation but a strategic step in maintaining Indonesia's position in the global economy and ensuring sustainable economic growth amidst the dynamics of international trade.

Abstract

Rapid developments in information technology have driven digital transformation in various aspects of life, from the government and economic sectors to social life. Amidst this progress, significant new challenges have also emerged, one of which is the threat to personal data protection and cybersecurity. The misuse of personal data, leaks of sensitive information, and the prevalence of cyber attacks have become urgent legal issues that must be addressed comprehensively. The protection of personal data is no longer merely a technical issue, but has become part of the fulfillment of human rights, particularly the right to privacy and security in digital life. The state, as the legal duty bearer, has the responsibility to formulate and implement adequate regulations to guarantee these rights. In this context, this study aims to examine in depth the urgency of personal data protection and cyber security in the digital era, analyze the effectiveness of existing regulations, and highlight the need to formulate a Cyber Security and Resilience Law as a strategic step to deal with the complexity of digital threats. This study uses a normative juridical method with a legislative and conceptual approach, which is based on a study of written legal norms and a conceptual understanding of the right to privacy, legal protection, and cybersecurity principles. The research data sources consist of primary legal materials such as legislation, as well as secondary legal materials in the form of legal literature, academic journals, and opinions from legal experts. With this framework, this research is expected to contribute theoretically to strengthening the legal basis for data protection and cybersecurity in Indonesia.

Abstract

Cryptocurrency regulation in Indonesia faces complexity due to differences in approach between Bank Indonesia (BI), the Commodity Futures Trading Supervisory Agency (Bappebti), and the Financial Services Authority (OJK), which creates legal uncertainty for the public and business actors. BI prohibits cryptocurrency as a means of payment, Bappebti classifies it as a tradable commodity, while OJK limits the involvement of financial institutions in crypto-asset transactions. This disharmony impacts legal certainty, consumer protection, and supervision of the potential misuse of cryptocurrency in criminal acts such as money laundering and terrorism financing. Although the government has regulated taxes on cryptocurrency transactions through the Minister of Finance Regulation, regulations related to investor protection and supervision mechanisms still need to be clarified. Therefore, policy harmonization is needed between BI, Bappebti, OJK, and other relevant authorities to create clear regulations, balance between supervision and innovation, and provide legal certainty for the cryptocurrency ecosystem in Indonesia to encourage sustainable digital economic growth.

Abstract

The goals of Law Number 23 of 2004 about the Elimination of Domestic Violence (PKDRT) and Law Number 35 of 2014 concerning Child Protection are to protect children from various forms of violence and to ensure their rights, including sexual violence, both in educational environments, society, and in the household. This study examines the provisions in both laws that specifically regulate the protection of children from sexual violence, including children's rights to a safe environment, state obligations in preventing and handling cases, and legal sanctions against perpetrators. The Child Protection Law affirms children's rights to receive protection from sexual crimes through articles that regulate education, rehabilitation, psychosocial assistance, and a fair legal process for victims, While the PKDRT Law offers a strong legal foundation for safeguarding children from domestic abuse, it also imposes severe penalties on those who engage in sexual violence against minors. Although these regulations have provided strong legal protection, their implementation still faces challenges, such as low reporting rates due to social and economic factors, lack of public awareness, and limitations in law enforcement. Therefore, this study emphasizes the importance of concrete steps in increasing the effectiveness of child protection from sexual violence, such as strengthening prevention policies, providing assistance services for victims, and more optimal law enforcement to create a safe and violence-free environment for children.

Abstract

This study analyzes the legal challenges in spatial planning and land management in urban areas based on Law Number 26 of 2007 concerning Spatial Planning, using descriptive research methods to describe spatial conditions and provide rational and balanced interpretations. The results of the study indicate that the main problems in spatial management include the preparation of spatial plans that are still hampered by complex and bureaucratic procedures, policy implementation that is often not in accordance with the plan due to regulatory disharmony between the central and regional governments, and weak supervision that causes rampant violations of spatial planning without effective sanctions. In addition, suboptimal coordination between related sectors and the lack of capacity of local governments to utilize information technology, such as geographic information systems (GIS), also hamper efficient and adaptive spatial management of urban dynamics. Strategic efforts are needed in the form of simplifying spatial revision procedures, harmonizing central and regional policies, strengthening supervisory institutions by increasing their authority and capacity, stricter law enforcement against spatial violations, and improving community involvement in spatial supervision to create a more sustainable, responsive, and in-line spatial planning system with socio-economic developments in urban areas.

Abstract

Reform in Indonesia brings great expectacy for respect for human rights, including protection for minority groups. However, in reality, discrimination still occurs that is contrary to the ideals of the reform. This study aims to analyze legal protection for minority groups in Indonesia using normative legal methods through literature studies and analysis of laws and regulations. The results indicate that although there are various national legal instruments, such as the 1945 Constitution, and the Human Rights Law, and ratification of international instruments such as the ICCPR and ICERD, the implementation of legal protection for minority groups still faces various challenges. The main factors that hinder the effectiveness of this protection include structural discrimination, weak law enforcement, and the lack of concrete affirmative policies. Therefore, strategic steps are needed in the policy of protecting minority groups, including a more progressive human rights-based approach, strengthening regulations, and increasing the government's commitment to enforcing fair and equal legal protection for all citizens, including minority groups.
