Abstract

The fulfillment of iddah maintenance is a legal obligation under Islamic family law intended to protect women economically after divorce. However, its implementation often differs from legal norms and court decisions, particularly when former husbands remarry. This study focuses on the practice of iddah maintenance and the influence of former husbands’ remarriage on the fulfillment of ex-wives’ rights in Pidie District, Pidie Regency. Using a qualitative method with a socio-legal approach, data were collected through in-depth interviews with ex-wives, community leaders, and relevant informants, as well as an analysis of divorce decisions at the Sigli Sharia Court. The findings show that iddah maintenance is inconsistently fulfilled, some former husbands provide limited support, while others provide none. Remarriage often shifts economic priorities toward the new family, while economic constraints, limited legal awareness, and ex-wives’ reluctance to claim their rights further weaken implementation. These findings demonstrate a gap between Islamic legal norms and social practice, highlighting the need to strengthen legal awareness and enforcement mechanisms to ensure the protection of women’s post-divorce economic rights. These findings imply that the development of Islamic family law should move beyond the normative recognition of iddah maintenance toward stronger mechanisms for protecting and enforcing women’s post-divorce economic rights. This includes strengthening court enforcement, increasing legal awareness, and developing a more responsive legal framework that addresses the socioeconomic consequences of former husbands’ remarriage through the principles of justice (‘adl), protection of women's rights (hifz al-huquq), and maslahah.
