Abstract

Tujuan dilakukan penelitian untuk menganalisis karakteristik sosial ekonomi masyarakat sub DAS Alo terhadap perilaku pemanfaatan fisik lahan. Penelitian dilakukan di kawasan sub DAS Alo yang secara administrasi sebagian besar berada di Kecamatan Tibawa. Data yang digunakan merupakan data sekunder dan primer yang diperoleh berdasarkan analisa survei dan studi literatur. Metode penelitian menggunakan metode analisis kuantitatif dan deskriptif kualitatif yang diguakan untuk memperjelas dan menginterpretasikan perolehan data sebgai hasil lapangan. Hasil penelitian menunjukkan bahwa karakteristik sosial dan ekonomi sangat mempengaruhi prilaku masyarakat dalam pemanfaatan lahan di kawasan Sub DAS Alo. Kondisi sosial mengakibatkan pembukaan lahan yang mampu mengubah bentuk fisik daerah DAS seperti pengalih fungsian lahan perbukitan, hutan dan tepi sungai menjadi kawasan pertanian produktif yang kerap dilakukan oleh masyarakat. Disisi lain hasil penelitian menunjukkan terdapat kesenjangan antara pemanfaatan lahan dengan kondisi ekonomi masyarakat. Terdapat petani penggarap sebesar 39,50% dan petani pemilik sebesar 20,50% berdasarkan total sampel yang diperoleh dalam penelitian dan pendapatan petani terbesar berada di bawah Rp.<1.500.000, berdasarkan penggolongan BPS pendapata  n tersebut dikategorikan pada kategori pendapatan rendah. Demikian dapat disimpulkan masyarakat yang mayoritas berprofesi sebagai petani memiliki kemampuan ekonomi yang rendah. Dengan kemampuan ekonomi rendah dapat memicu terjadinya pembukaan lahan yang lebih luas untuk bertujuan meningkatkan pendapatan yang layak.

Abstract

Protection and guarantee of human rights must be obtained by every citizen, one of which is the provision of legal aid not only for the poor, but also for people with disabilities as a group of people who are vulnerable to legal problems as mandated in Article 29 of Law Number 8 of 2016 concerning Disability Persons that the government and regional governments must provide for legal assistance. the implementation of legal aid for persons with disabilities must be formalized into regional regulations in order to guarantee and realize the principle of equality before the law to its citizens. The purpose of this study was to determine the Gorontalo District government policy in implementing the law on legal aid needed by persons with disabilities. This research uses descriptive research with a qualitative-quantitative approach (mix method). Stages of the implementation of the activities include survey activities at the research location, data collection, preparation of progress reports and finalization of the report as well as the preparation of research articles and publications in one of the national journals. The time of the study is from September to December 2019. The existence of this research is expected to provide information and enter the Gorontalo District government. The results showed that the legal advocacy program for persons with disabilities in Gorontalo District can be categorized as very urgent. The role of Gorontalo District Government in implementing Law No. 8 of 2016 is not yet optimal because there are no special laws that support it.Perlindungan dan jaminan hak asasi haruslah diperoleh setiap warga negara salah satunya adalah penyelenggaraan bantuan hukum tidak hanya untuk masyarakat miskin, tapi juga bagi penyandang disabiltas sebagai kelompok masyarakat yang rentan bermasalah dengan hukum sebagaimmana yang telah diamanatkan di dalam Pasal 29 Undang-Undang Nomor 8 Tahun 2016 tentang Penyandang Disibilitas bahwa pemerintah dan pemerintah daerah wajib menyediakan bantuan hukum tersebut. penyelenggaraan bantuan hukum bagi penyandang disabilitas harus diformilkan ke dalam peraturan daerah dalam rangka menjamin dan mewujudkan asas equality before the law kepada warganya. Tujuan penelitian ini adalah untuk mengetahui kebijakan pemerintah daerah Kabupaten Gorontalo dalam mengimplementasikan undang-undang terhadap bantuan hukum yang dibutuhkan oleh penyandang disabilitas. Penelitian ini menggunakan jenis penelitian deskriptif dengan pendekatan kualitatif-kuantitatif (mix method). Tahapan pelaksanaan kegiatan meliputi kegiatan survey di lokasi penelitian, pengambilan data, penyusunan laporan kemajuan dan finalisasi laporan serta penyusunan artikel hasil penelitian dan publikasi pada salah satu jurnal nasional. Waktu penelitian dari Bulan September hingga Desember 2019. Adanya penelitian ini diharapkan dapat memberikan informasi dan masukkan pada pemerintah daerah Kabupaten Gorontalo. Hasil Penelitian menunjukkan bahwa program advokasi hukum terhadap penyandang disabilitas di Kabupaten Gorontalo dapat dikategorikan sangat urgen. Peran Pemerintah kabupaten Gorontalo dalam mengimplementasikan UU No. 8 Tahun 2016 belumlah maksimal karena belum adanya Perda khusus yang menunjangnya.

Abstract

As a result of the violation of Human Rights ( HAM ) in the health care field can cause harm to people who are in desperate need of adequate provision of health services, so that the necessary law enforcement efforts against violators in health services for the community. It is intended to assure the protection of the public with regard to the violation of the right to obtain health care. In the health sector the perpetration of these violations of human rights can involve leaders of health care facilities or health workers who practice or work in health care facilities as opposed to health care legislation. This research aims to determine the result of the violation of human right in health care, so that the right to health is not achieved and law enforcement against infringement in terms of aspects of health care human rights. The specific objective is to determine the laws governing the right to obtain medical care and enforcement of violations in health care.Akibat terjadinya pelanggaran Hak Asasi Manusia (HAM) di bidang pelayanan kesehatan dapat menimbulkan kerugian bagi masyarakat yang sangat membutuhkan pemenuhan pelayanan kesehatan yang memadai, sehingga diperlukan upaya penegakan hukum terhadap pelaku pelanggaran dalam pelayanan kesehatan bagi masyarakat. Hal ini dimaksudkan untuk memberikan jaminan perlindungan bagi masyarakat berkaitan dengan pelanggaran atas hak untuk memperoleh kesehatan. Di bidang kesehatan terjadinya perbuatan pelanggaran hak-hak asasi manusia dapat melibatkan pimpinan fasilitas pelayanan kesehatan atau tenaga kesehatan yang melakukan praktik atau pekerjaan pada fasilitas pelayanan kesehatan yang bertentangan dengan undang-undang kesehatan. Penelitian bertujuan untuk menentukan akibat terjadinya pelanggaran hak asasi manusia dalam pelayanan kesehatan, sehingga pemenuhan hak atas kesehatan tidak tercapai dan penegakan hukum terhadap pelanggaran dalam pelayanan kesehatan ditinjau dari aspek hak asasi manusia dan tujuan khususnya yaitu untuk mengetahui peraturan perundang-undangan mengatur mengenai hak dalam memperoleh pelayanan kesehatan dan penegakan terhadap pelanggaran dalam pelayanan kesehatan.

Abstract

The rapid development of information technology has built social dependence on its devices. One of the most widely used information technology devices for the needs of activities or jobs is a computer. Computer operating systems that cannot be run without the support of software, automatically causes the need for computer software to become absolute. But the price of original software that is considered too expensive by the users ultimately becomes the main reason for the choice dropped on pirated software. This condition applies broadly, even in government agencies, including in the territory of Gorontalo Province. The level of knowledge and awareness of computer users about copyright protection laws is thought to be one of the main factors of the continued rampant use of pirated computer software in Indonesia in general and in Gorontalo in particular. This study aims to analyze formal law in Indonesia which regulates the use of pirated computer software. The scope of the discussion is to deepen the understanding of computer software and piracy and its formal legal analysis based on Law No. 28 of 2014 concerning Copyright. The results of the study are expected to be a reference for the public, especially computer users and businesses in products and services in the field of computers so as to increase understanding and legal awareness. The approach method used in this study is a normative juridical approach and analytical descriptive nature. This study uses secondary data obtained from primary and secondary legal materials. The results of the study describe the legal construction of copyright protection which includes the consequences of criminal law for violators, in this case it can ensnare makers, dealers, business actors and also users of pirated computer software.Pesatnya perkembangan teknologi informatika telah membangun ketergantungan sosial terhadap perangkat-perangkatnya. Salah satu perangkat teknologi informatika yang paling banyak digunakan untuk kebutuhan aktifitas atau pekerjaan adalah komputer. Sistem operasional komputer yang tidak bisa dijalankan tanpa dukungan software atau perangkat lunak, secara otomatis menyebabkan kebutuhan akan software komputer juga menjadi mutlak. Namun harga software asli yang dianggap terlalu mahal oleh para pengguna pada akhirnya menjadi alasan utama pilihan dijatuhkan pada software bajakan. Kondisi ini berlaku secara luas, bahkan di lingkungan instansi pemerintah, termasuk di wilayah Provinsi Gorontalo. Tingkat pengetahuan dan kesadaran para pengguna komputer tentang hukum perlindungan hak cipta diduga menjadi salah satu faktor utama tetap maraknya pengggunaan software komputer bajakan di Indonesia pada umumnya dan di Gorontalo khususnya. Penelitian ini bertujuan untuk menganalisis hukum formil di Indonesia yang mengatur tentang penggunaan software komputer bajakan. Ruang lingkup pembahasan adalah pada kajian mengenai software komputer dan pembajakan serta analisis hukum formilnya berdasarkan Undang-undang Nomor 28 Tahun 2014 Tentang Hak Cipta. Hasil penelitian diharapkan dapat menjadi referensi bagi publik, khususnya para pengguna komputer serta pelaku usaha produk dan jasa di bidang komputer sehingga dapat meningkatkan pemahaman dan kesadaran hukum. Metode pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dan bersifat deskriptif analitis. Penelitian ini menggunakan data sekunder yang diperoleh dari bahan hukum primer dan sekunder. Hasil penelitian mendeskripsikan konstruksi hukum tentang perlindungan hak cipta yang termasuk di dalamnya konsekuensi pidana hukum bagi pelanggarnya, dalam hal ini bisa menjerat pembuat, pengedar, pelaku usaha dan juga pengguna software komputer bajakan.

Abstract

Accessibility is the facilities provided for persons with disabilities to realize equality and opportunity and all aspects of life and livelihood as ease of moving through and using buildings and the environment with due regard to fluency and feasibility. The purpose of this study was to determine the Gorontalo District regional government policy in implementing the Act relating to the accessibility of the needs of persons with disabilities. Particularly on the accessibility of persons with disabilities to government agencies in Gorontalo District based on Law No. 8 of 2016 concerning Persons with Disabilities and universal design principles implemented in Ministerial Regulation No. 14 of 2017 concerning Building Easiness Requirements. This research uses a normative a juridical type of research with a juridical empirical approach. The results showed that (1). Implementation of Law No. 8 of 2016 concerning Persons with Disabilities in Gorontalo Regency has not been implemented optimally (2). Obstacles found in government agencies in the Gorontalo District environment include government buildings not yet accessible for persons with disabilities. This means that the facilities provided do not meet the universal design principles of ease, usefulness, safety, and independence. The absence of regulations in the form of Regional Regulations and Regents as a legal umbrella related to the standard facilities and services that must be provided for persons with disabilities, and the lack of local budgets for the development and construction of facilities related to the accessibility of persons with disabilities.

Abstract

(Legal Protection Analysis Against Housekeepers). Under the Constitution, article 27 para 2 UUD 1945 confirms that each citizen is entitled to a decent work and livelihood. But in fact there are many cases of violence against groups of domestic workers. Although in international law has been governed by its protection system through the ILO convention, it remains a very weak position if it is not strengthened by the legal protections system of each country. This research aims to analyse the current employment legal system in Indonesia in providing legal protection against domestic helper.  The method of approach used is the normative and descriptive juridical approach. This research uses secondary data obtained from primary and secondary legal materials. The results showed that the laws and regulations of the employment sector governed by Law No. 13 of 2003 concerning employment did not reach the domestic helper group. While the Minister of Manpower Regulation No. 2 of 2015 on protection for domestic workers is still too weak because it has not been able to provide assurance of legal position and protection for domestic workers, whether in the system of wages, occupational safety, occupational health or social security programs. To ensure the position and protection of household workers must reconstruct or revise all rules pertaining to employment in order to be equality between the household worker and other workers so as to authorize the Industrial relations Court to adjudicate disputes with his employer.

Abstract

The open proportional system used in the 2024 Legislative Election with the determination of elected legislative candidates within political parties based on the majority of votes has resulted in disputes over elected candidates within political parties. This research aims to determine the provisions governing procedures for resolving disputes between internal political party candidates and institutions authorized to resolve disputes. The research method used is normative with descriptive analysis looking at Bawaslu's authority in resolving cases based on reports from fellow legislative candidate members within the party. The authority to determine elected candidates as legislative members is in the hands of the KPU/KPUD in stages. Thus, political parties cannot intervene in this authority in any form. The research results found that Bawaslu as the institution responsible for supervising the stages or process of elections as attributed to the Election Law, should be able to handle or resolve disputes between internal legislative candidates of political parties because it is explicitly stated in the academic text of Law no. 7 of 2017 that Bawaslu received and reviewed reports regarding alleged violations of Election Administration Provisions because disputes over elected candidates within political parties were included in the election dispute regime and not the political party dispute regime. The conclusion of this research is that this type of dispute can occur in the election process, especially in the process of determining elected legislative candidates by the KPU, provincial KPU, district/city KPU.
