Abstract

The Implementation of a debt settlement agreement between PT. Duri Indah Raya and PT. Adhi Karya (Persero) Tbk begins with the debt of a cooperation agreement between both parties on the construction of Mall Duri . The payment that must be paid by PT. Duri Indah Raya is always less and late to PT. Adhi Karya and it makes the debt. Due to the debt, both parties agreed to finish it by converting a portion of the placement or placement into the PT. Adhi Karya Tbk by PT. Toward the effort to finish the debt between both parties, the problem is not resolved. The purpose of this study was to investigate the implementation of a debt settlement agreement between PT. Duri Indah Raya and PT. Adhi Karya, to determine what legal action can be taken to solve the problems of accounts payable of development cooperation agreements of PT Mall Duri between PT. Duri Indah Raya and PT. Adhi Karya. This type of research can is juridical empirical research, because in this study the authors directly conduct research on the location or place under study. From the research, there are two fundamental issues that will be concluded. Debts arising between PT. Duri Indah Raya and PT. Adhi Karya is preceded by the presence of a cooperation agreement between PT. Duri Indah Raya and PT. Adhi Karya Tbk about Duri Mall development. PT. Duri Indah Raya always late and less make payments on any payment. Then the parties agreed to settle the debt by converting a portion of the PT. Duri Indah Raya into placement or investment in shares of PT. Adhi Karya. However, the various efforts made by the parties, the debt still remains unresolved. Suggestions that there firmness of PT. Adhi Karya and if necessary legal measures both non-litigation and litigation to resolve their debt problems.Keywords: Implementation - Agreement - Debt Settlement

Abstract

Social responsibility and the environment that have been enjoined in Law Number 40 Year 2007 regarding Limited Liability Company, which aims at realizing sustainable economic development to improve the quality of life and the environment that are beneficial to the local community and society in general and the Company itself in the context of relations Company harmonious, balanced, and in accordance with the environment, values, norms, and local culture. As for the purpose of writing this essay, namely: First, to determine the mechanism of implementation of Corporate Social Responsibility at PT. Raja Beach Gardens in the village of Tanjung Pauh Hilir Subdistrict Singngingi. Second, to determine the measures to be implemented by PT. Palm Beach King in the implementation of Corporate Social Responsibility can improve the economy of the local community.This research is a sociological research that want to see the unity between law and society with the gap between das sollen and das sein. This research was conducted in the village of Tanjung Pauh Subdistrict Singngingi Hilir Regency Kuantan Singngingi, while the sample population is the whole party related to the issues examined in this study, the data source used, primary data and secondary data, data collection techniques in this study conducted through interviews, literature studies and questionnaires.The conclusion of this study is, for the First Implementation of corporate social responsibility on a PT. Raja Beach Gardens in the village of Tanjung Pauh Hilir Subdistrict Singingi not refer to the Riau Provincial Regulation No. 6 of 2012 on Corporate Social Responsibility in the province of Riau. The implementation of the CSR that has been done by PT Raja Beach Gardens is by giving some money to the village authorities and improvement of roads to roads that have been damaged. However, in the implementation of CSR is still found deficiencies in various fields, namely the field of development, community economic development, education, the environment and social welfare. Both efforts should be undertaken by PT. Abstract

As a service provider company and providing non-profit public benefits,PDAMs should be oriented towards quality service quality, capable of providinghigh quality water that meets health requirements (colorless and odorless),continuity, innovative, so that PDAM Tirta Indra Kab Indragiri Hulu can defenditself, and in the future is expected to become a service company that can betrusted and proud by consumers, especially Indragiri Hulu Regency. However, inreality there are still many unattainable drinking water consumer rights, such asthe right to convenience, where consumers are less comfortable with the servicesof PDAMs, and the right to information, where PDAMs are not open toconsumers regarding quality information from the drinking water they consumeeach year.As for the purpose of writing this thesis is To know the implementation,constraints, and efforts in legal protection for consumers of drinking waterservices Tirta Indra Regional Water Company Indragiri Hulu regency.The conclusions can be obtained from this research is, First, theimplementation of legal protection for consumers of drinking water services TirtaIndra PDAM Indragiri Hulu regency is still not running properly. Second,constraints in the implementation of legal protection for consumers of drinkingwater services Tirta Indra PDAM Indragiri Hulu regency is the number ofcomplaints from consumers and the quality of drinking water. Third, the effortsmade by PDAM Tirta Indra Indragiri Hulu regency in overcoming the problemsof drinking water services to consumers, related to consumer complaints directlyhandled by Public Relations Section and Customers PDAM Tirta Indra, ondrinking water quality, PDAM Tirta Indra Indragiri Hulu do some fixes such asPlow Meter and Pam Browsing. The author's suggestion from this research is,First, PDAM Tirta Indra Kab. Inhu is expected to improve services in providingclean water and quality. Secondly, PDAM Tirta Indra Kab. Abstract

Corporate social responsibility is in a moral and moral dilemma, where companies are unethical when enjoying substantial profits, while environment is damaged and society is disregarded or harmed by its rights. In accordance with the core of moral strength is the awareness that is present in the company, it was not able to create awareness of the company to care about the community and the environment, therefore the law entered and made CSR as a mandatory for companies, especially PT. Anugerah Niaga Sawindo which is located in Rokan Timur Village Rokan IV Koto District Rokan Hulu District that existed since 2005. As for the purpose of writing this thesis, namely: First, to find out how the implementation of Corporate Social Responsibility at PT. Anugerah Niasa Sawindo Rokan Timur Village Rokan IV Koto Subdistrict. Second, to find out whether the implementation of corporate social responsibility PT. The award of Niasa Sawindo to the people of Rokan Timur Village Rokan IV Koto Sub-district is in accordance with the laws and regulations.This research is a sociological law research that is research that want to see unity between law and society with existence of gap between das sollen and das sein. This research was conducted in Rokan Timur Village Rokan IV Koto Sub-district Rokan Hulu District, while the population and sample are all parties related to the problem studied in this research, data source used, primary data, and secondary data, data collection technique in research This is done through interviews, literature review and questionnaires.The conclusion of this research is, First Implementation Corporate Social Responsibility PT. Anugrah Niaga Sawindo in Rokan Village, Rokan IV Koto Sub-district has been implemented, the name of its realization The Company only executes not as an obligation as regulated by the Law. Where in running the corporate social responsibility program, the company does not carry out social responsibility in a sustainable manner that can improve the economy of the community. Second In accordance with the provisions of unification Legislation PT. Anugrah Niaga Sawindo in the implementation of corporate social responsibility does not refer to Regional Regulation Riau Province No. 6 of 2012 on Social Responsibility and Environment of the Company. Suggestion writer to the problems studied is the first future in the future PT. Anugrah Niaga Sawindo must carry out corporate social responsibility in accordance with the needs of local communities that provide training, guidance to small and medium micro enterprises and provide guidance to farmer groups to improve the standard of living of the community. Abstract

Developments and advances in the field of economics, mainly trade in goods and services had a positive impact and negative for the world in the field of industrial intellectual property rights, especially in the field of trademark. The influx of economic globalization lead to diversity in the field of trademark infringement. Passing off action is a well-known mark piggybacking on actions carried out unlawfully, and result in unfair competition.The existence of Law Number 15 Year 2001 on trademark to this day can not provide legal certainty regarding passing off action as a violation of well-known mark. The purpose of this study is the first to determine the position of passing off action in violation of the act trademark in Indonesia, both know the legal protection of well-known mark of passing off action in Indonesia.Based on the research results of the problem formulation, it can be concluded that, first the act of passing off position in the legal system in Indonesia trademark infringement is included into the trademark, but the Act has not expressly mention. Second, concept of the protection of well-known mark of passing off action in the Indonesian legal system trademark consists of preventive measures and efforts repressive, preventive efforts made by the mechanism known brand registration, and legal socialization trademark. Repressive efforts to form a civil action and / or criminal prosecution in accordance with the provisions of the Trademark Law.Advice from the author, first namely law enforcement officers should have a strategic role in the field of legislation to renew the Trademark Act in order to provide legal certainty to the well-known mark infringement action including passing off. Second, should be legal protection trademark made in line with the oversight of all elements of law enforcement. Third, of Indonesia as a member of the WTO should be able to cope with unfair competition actions such as passing off by adjusting the rules of international conventions appropriate to the needs of the Republic of Indonesia.Key Words : Well-known Marks - Passing Off – Unfair Competition

Abstract

Property (vermogen) is all rights and obligations that have people, who have value for money. Thus it can be said that inheritance law is part of the law of wealth. Inheritance law is the provisions that govern the fate of one's wealth after the owner dies. During his life man has wealth. The wealth will not be brought after the owner dies. The wealth will be distributed to those who are entitled to receive it that is the closest offspring of the deceased and or the person appointed to receive it. The deceased is called the heir, while the one who is entitled to receive the treasure is called the heir. In the Tapanuli community ("Batak"), because the heirs are sons (all boys), then surely the inheritance is divided among the heirs (if boys are more than one) while Daughters have no inheritance or are not considered heirs. While this is very contrary to the provisions of Article 852 of the Civil Code.The purpose of writing this thesis namely; First, to know the implementation of inheritance system done by indigenous people batak toba in martoba village, simanindo district, samosir district. Second, to find out the inheritance system of indigenous people batak toba that do not give to the daughter as heir in accordance with justice.This type of research is a sociological law research or as an attempt to see the effect of positive law on the life of the community. From the results of research that has been done then, can be drawn two conclusions; Firstly, the implementation of inheritance in the Batak Toba community in Martoba Village has given inheritance to girls, but still more portion to boys. Second, the inheritance given to girls is now fair even though the share of the division is not the same as the boys and some even are not given to girls. Abstract

Law Number 8 Year 1999 About Consumer Protection Is Legal Basis in Legal Protection AgainstConsumers In The Use Of Styrofoam On Food Packaging In Sail Sub-District Pekanbaru Is Associated WithLaw Number 8 Year 1999 About Consumer Protection. The Need for Legal Protection of Consumers in the Useof Styrofoam in Food Packaging is due to the many business actors who use Styrofoam as food packaging inSail Sub-district Pekanbaru City, which became one of the problems that have a major impact on consumerhealth. Therefore, the purpose of this thesis writing, namely: First, knowing consumer knowledge and businessactors on consumer health on the use of styrofoam by business actors as packaging on food; Secondly, to knowthe legal protection of the consumers regarding the use of Styrofoam products as food packaging in Sail Sub-District in Pekanbaru City related to Law Number 8 Year 1999 About Consumer Protection.This type of research can be classified in the type of legal juridical sociological research, referred tosociological juridical research is the approach by looking in terms of legislation and the reality that occurredin the field, In accordance with the formulation of the problems expressed by the author. This research wasconducted in Pekanbaru City, at Central Office of Food and Drug Monitoring Riau Province, and in DistrictSail. Population and Sample are. Food traders and food buyers. Sources of data used, namely: primary dataand secondary data. Data collection techniques in this study with questionnaires, interviews, and literaturereview.The conclusions can be obtained from the results of research is First, Consumer Knowledge andBusiness Actors Consumer Health on the Use of Styrofoam as Packaging in Food Business and Consumer Donot Know Overall; Second, inhibiting factors, ineffective implementation of the purpose of consumer protectionand causing harm to consumers in the use Styrofoam the disease suffered in the future. The author's suggestionis to the central government to make regulations regarding the prohibition on the use of Styrofoam in foodpackaging. And the Local Government and the Agency BPOM to give special attention in the use of Styrofoamused in food packaging. and To business actors to raise awareness about the importance of consumerprotection and improve the quality of goods and / or services that ensure the continuity of goods and / orservices production, health, convenience, security and consumer safety, and for consumers to increaseawareness, ability and independence to protect themselves.Keywords: Use of Styrofoam-a health hazard-in Sail District.

Abstract

Penggunaan merek khususnya merek terkenal tanpa izin dari pemilik merek sangat merugikan bagi pemilik merek terdaftar yang sebenarnya, yakni sipemilik atau produsen barang-barang yang bermutu tinggi, konsumen juga dirugikan karena banyak sekali pembeli yang tertipu atau tidak dapat membedakan mana merek tas branded yang asli dengan kualitas baik dengan barang palsu yang berkualitas rendah, selain itu negara juga ikut dirugikan. Tujuan penulisan skripsi ini, yakni: pertama, untuk mengetahui dan mengkaji konsumen merasa dirugikan atas penjualan tas palsu dengan merek palsu oleh pelaku usaha(penjual). Kedua, untuk mengetahui pelaksanaan tanggungjawab penjual yang menjual tas palsu di Kota Pekanbaru.Jenis Penelitian ini dapat digolongkan dalam jenis penelitian hukum sosiologis, karena dalam penelitian ini penulis langsung mengadakan penelitian pada lokasi atau tempat yang diteliti. Sedangkan populasi dan sample adalah merupakan keseluruhan pihak yang berkaitan dengan masalah yang diteliti dalam penelitian ini, sumber data yang digunakan data primer, data sekunder, dan data tersier, teknik pengumpulan data dalam penelitian ini dengan observasi, wawancara dan kepustakaan.Dari hasil penelitian masalah ada dua hal pokok yang dapat disimpulkan. Pertama, tindakan pelaku usaha dalam penjualan merek tas palsu dengan menyerupai yang asli dipasaran merupakan perilaku menyimpang dan merugikan konsumen karena konsumen harus membayar mahal untuk tas yang telah dibelinya itu dan kurangnya perlindungan hukum terhadap konsumen yang dirugikan haknya oleh pelaku usaha dan lemahnya hukum dalam hal ini. Kedua, Pelaksanaan tanggung jawab pelaku usaha (penjual) kepada konsumen tidak seutuhnya menjamin kerugian yang dialami konsumen tersebut. Pelaku usaha tidak sepenuhnya bertanggungjawab kepada konsumen karena masih banyaknya pelanggaran yang dilakukan pelaku usaha terhadap konsumen dalam barang yang dijualnya kepada konsumen. Saran Penulis. Pertama, Undang-Undang Nomor 8 Tahun 1999 Tentang Perlindungan Konsumen belum secara tegas memberikan perlindungan terhadap konsumen, maka penulis memberi saran kepada aparat penegak hukum yang memiliki peran strategis dalam hal pembuatan peraturan untuk mengadakan perubahan kepada Undang-Undang perlindungan konsumen guna untuk penyempurnaan perlindungan konsumen secara Kompleks agar dalam prakteknya tidak ada lagi pelaku usaha yang berbuat curang kepada konsumen. Kedua, konsumen harus lebih berani menyuarakan hak-haknya kepada pelaku usaha sebelum atau setelah menggunakan barang atau jasa, dan pelaku usaha harus mendengar apa yang seharusnya menjadi tanggung jawabnya, dan tidak ada lagi konsumen yang harus merasa terus menerus dirugikan haknya.Kata Kunci: Perlindungan Konsumen – Merek Terkenal – Merek Palsu

traffic accident is an incident on the road that can not be known when and where it will happen. Traffic accidents are a matter that could give rise to rights and obligations for each party for damages. Traffic accident that causes damage to a third party in the civil responsibility of employers or owners dikerenakan bus driver or bus wardens to supervise. Abstract

Today electricity is a very urgent need for the society because most people needs rely on electrical energy. The increasing demand for electricity is not balanced with the availability of electricity by the electricity company PT PLN. It causes electricity services to be not optimal and consequently harm the public or electricity consumers. Likewise, the services of electricity by PT. PLN (Persero) Sub Rayon Pulau Kijang to consumers of electricity in the District Reteh, electricity outages still occur to unilaterally causing harm to consumers.This research entitled Consumer Legal Protection against Electricity Outages by PT. PLN (Persero) Sub Rayon Pulau Kijang (Case Study: Electricity Outages Unilaterally in District Reteh, Indragiri Hilir. The formulation of the problem is how the rights of consumers in the service of electricity by PT. PLN (Persero) Sub Rayon Pulau Kijang, legal protection of electricity consumers in District Reteh against electricity outages unilaterally by PT. PLN (Persero) Sub Rayon Pulau Kijang, and the responsibility of PT. PLN (Persero) Sub Rayon Pulau Kijang to the rights of electricity consumers in District Reteh.The research aimed to determine the rights of consumers in the service of electricity by PT. PLN (Persero) Sub Rayon Pulau Kijang, the legal protection of electricity consumers in District Reteh against electricity outages unilaterally by PT. PLN (Persero) Sub Rayon Pulau Kijang and the responsibility of PT. PLN (Persero) Sub Rayon Pulau Kijang to the rights of electricity consumers in District Reteh.Type of research was a sociological law that was conducting research directly to the location or studied point. The nature of study was descriptive, by using primary and secondary data sources. Data collecting techniques used were questionnaire, interview and library research. Data analysis used was qualitative, and a method of conclusion used was deductive.The results showed consumer rights in the service of electricity by PT. PLN (Persero) Sub Rayon Pulau Kijang performed poorly due to Chief of Branch and Employee of Operator / Services Disruption, Staff of Public Service in District Reteh, and electricity consumers were not aware of consumer rights. there was no legal protection of Electricity consumers against electricity outages unilaterally. There was no responsibility of PT. PLN (Persero) Sub Rayon Pulau Kijang to the rights of electricity consumers in District Reteh.Leaders and employees of PT. PLN (Persero) Sub Rayon Pulau Kijang should increase the knowledge of the business operators of electric power and the rights of electricity consumers; conduct counseling and provide legal protection of electricity consumers in District Reteh related to electricity outages unilaterally, have a responsibility to the rights of electricity consumers in District Reteh; and electricity consumers in District Reteh increase knowledge about the rights of electricity consumers.Keywords: Consumer Protection, Electricity Outages
