Abstract

Land as a commodity that can be owned by the public, transferable ownership rights, one way transfer of land rights is through buying and selling. In the process of buying and selling land, the land status of the trade is very important. Because the common phenomenon of buying and selling land that was in dispute. The sale and purchase of land under customary law adopts cash, real and bright, meaning that every relationship should look real and concrete. Means of direct cash payments when buying and selling process, the real meaning of buying and selling land as a real object, and the light means buying and selling is done in front of the authorities. Today the frequent buying and selling land that is in dispute, of course it would be detrimental to the buyer. Land dispute itself has not decided who is entitled by law to have it, but routed through buying and selling. When there is a third party that will disturb the tranquility of the buyer to control the land he bought.Issues that will be examined in this study are: First, whether the land in dispute can be the object of buying and selling? Second, if the seller is responsible for the land in dispute?This research is a normative legal research. This discussion is more to discuss about an analysis of the law written in the book. Source of data used is the source of the data obtained from the study of literature, among others, include official documents, books, research results in the form of reports and so on. Data was analyzed qualitatively in drawing conclusions using deductive thinking.The results of this study are first, that the land was in dispute can not be transferred, because the land rights dispute itself is still up for grabs. Certainly not qualify agreement is valid lawful reason. Second, the seller is responsible in conflict over land dispute traded. Because the law states that the seller shall ensure and bear the traded goods. Advice from the author of First, the land in dispute should not be traded, because the rights of the land is not yet clear, Secondly, the land in dispute Seller shall be liable for damages arising from the sale and purchase of land in dispute.

Abstract

Abstract Article 158 Paragraph (1) of the Employment Act has been repealed by the Constitutional Court in Decision N0.012/PUU-I/2003. Then legal vacuum concerning Termination of Employment for major offenses. Government issued Circular Letter No.SE-13/MEN/SJ-HK/I/2005, which states the Firm Termination due to severe error, can be done after decision of the criminal judge finalized. This type of research is normative. Data were analyzed qualitatively, concluding with the deductive method of thinking. Results First, the concept of Termination On serious mistakes After Section 158 of the Employment Act is repealed by the Constitutional Court Termination Of workers who make mistakes should heavy Decision Criminal Justice Stay. While the workers who perform heavy Mistake that are not criminal acts lack a legal basis. Second, the concept of Termination On serious mistakes After Section 158 of the Employment Act repealed by the Constitutional Court illustrate the lack of protection for workers who perform heavy errors beyond the provisions of Criminal.Abstrak Pasal 158 Ayat (1) UU Ketenagakerjaan telah dicabut oleh MK melalui putusan No.012/PUU-I/2003. Dengan demikian terjadi kekosongan hukum mengenai PHK karena kesalahan berat. Pemerintah menerbitkan SE No.SE-13/MEN/SJ-HK/I/2005, yang menyatakan Pengusaha yang melakukan PHK karena kesalahan berat, dapat dilakukan setelah ada putusan hakim pidana berkekuatan tetap.  Jenis penelitian adalah normatif. menganalisis hukum yang tertulis. Data dianalisi secara kualitatif, penarikan kesimpulan dengan metode berfikir deduktif. Hasil Pertama, Konsep PHK Atas Kesalahan Berat Setelah Pasal 158  UU Ketenagakerjaan dicabut oleh MK yaitu PHK Terhadap pekerja yang melakukan kesalahan berat harus ada Putusan Hakim Pidana Tetap. Sementara terhadap pekerja yang melakukan kesalahan berat yang bukan tindak pidana tetapi diatur sebagai kesalahan berat belum memiliki dasar hukum. Kedua, Konsep PHK Atas Kesalahan Berat Setelah Pasal 158 UU Ketenagakerjaan dicabut Oleh MK menggambarkan tidak adanya perlindungan terhadap pekerja yang melakukan kesalahan berat diluar ketentuan Pidana.

Abstract

Media sosial adalah platform daring yang memungkinkan individu dan kelompok untuk berinteraksi, berbagi konten, dan berkomunikasi secara elektronik. Dengan adanya media sosial dapat memberikan banyak kemudahan dalam menyebarkan informasi, berkomunikasi dan mencari suatu informasi. Dididalam media sosial ini memungkinkan pengguna untuk membuat profil, mengirim pesan, berbagi foto dan video, serta terlibat dalam berbagai aktivitas online lainnya. Namun penting dalam penggunaan media sosial secara bijak dan bertanggungg jawab, karena menyadari risiko yang ada akibat dampak dari penggunaan media sosial. Penyuluhan dalam rangka bijak bermedia sosial didesa padang luas yang diselenggarakan oleh mahasiswa KUKERTA Universitas Riau. Melihat kondisi banyak orang yang tidak menelaah atau mencari dahulu kebenarannya suatu informasi yang didapat dari jejaring Media sosial tersebut. Mahasiswa KUKERTA Universitas Riau tertarik dalam membuat salah satu program penyuluhan bijak bermedia sosial agar seluruh masyarakat didesa padang luas dapat lebih bijak menggunakan Media sosial. Kegiatan ini juga dilakukan atas izin pihak kepala desa dan diketahui oleh dosen pembimbing lapangan (DPL).

Abstract

Kegiatan Kuliah Kerja Nyata (KUKERTA) merupakan program efektif untuk memperkuat kesadaran politik dikalangan Masyarakat. Kegiatan pengabdian ini bertujuan untuk membangun pemilih yang lebih kritis tentang isu politik dan calon yang mereka dukung serta meningkatkan kesadaran pemilih tentang mekanisme pemilu yang akan diadakan pada tahun 2024 di Desa Terantang. Tim Kukerta bekerja sama dengan pihak Komisi Pemilihan Umum (KPU) Kabupaten Kampar, Anggota PPK (Panitia Pemilihan Kecamatan) Kecamatan Tambang, Anggota PPS (Panitia Pemungutan Suara) Desa Terantang, Aparat Pemerintah Desa dan Madrasah Aliyah Swasta untuk menyelenggarakan kegiatan diskusi politik dengan metode yang digunakan yakni melalui sosialisasi kepada Masyarakat. Hasil yang diperoleh dari kegiatan ini adalah peningkatan pemahaman masyarakat tentang hak pilih, proses pemilihan, dan pentingnya partisipasi aktif dalam pemilu serta menciptakan ruang dialog yang membantu mengatasi keraguan pemilih . Hal ini menunjukkan keberhasilan dalam meningkatkan kesadaran pemilih di Desa Terantang dan Masyarakat lebih siap untuk berperan aktif dalam pemilihan umum 2024.

Abstract

Agricultural land has a social function whose benefits are very helpful to improve the welfare of the community in order to realize social justice. Land exploitation agreements with production sharing are regulated in customary law based on an agreement between the landowner and the tenant farmer in return for the results agreed by both parties. In its development, the production sharing agreement is regulated through Law Number 2 of 1960 Concerning Production Sharing Agreements. In the Kampar Regency area, which has indigenous peoples and still upholds life based on customs or still maintains local wisdom. Access to agricultural management is an important aspect for indigenous peoples, especially for indigenous groups that are still dependent on natural resources. In managing agricultural land, indigenous peoples in Kampar Regency, one of which is carried out by cooperating in agricultural land management between fellow indigenous peoples. The urgency of this writing is to see the implementation of agricultural management agreements in indigenous peoples in Kampar Regency. The results of this study are that not all indigenous peoples carry out agricultural land management agreements, agricultural management agreements are carried out because the majority of the population works as farmers, but not all people have land for farming. Agreements are made in writing for agricultural management. Obstacles to the Implementation of profit- sharing agreements in the indigenous people of Kampar Regency include when implementing the Harvest, the cultivator does not share the results in accordance with the agreement. Discrepancies in understanding between indigenous peoples are cultivators and indigenous peoples as landowners. The lack of understanding of indigenous peoples regarding agricultural profit-sharing arrangements and tenurial conflicts that still occur in Kampar have also become obstacles in the implementation of agricultural land management agreements in Kampar indigenous peoples.

Abstract

Penelitian ini mengkaji tentang pelaksanaan perlindungan konsumen dalam jual beli mobil bekas di Showroom Syahran Motor Kabupaten Padang Lawas Sumatera Utara yang berfokus tentang pemenuhan hak-hak konsumen berdasarkan Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen (UUPK). Penelitian ini menggunakan Hukum Sosiologis, data diperoleh melalui hasil wawancara dan hasil observasi. Pelaku usaha belum sepenuhnya memenuhi ketentuan UUPK, terbukti dari hak-hak konsumen yang diabaikan, seperti informasi yang tidak jelas terkait kondisi mobil, serta adanya kerugian yang dialami konsumen akibat kondisi mobil yang cacat. Kemudian, adanya klausula eksonerasi dalam perjanjian jual beli yang menimbulkan ketidakseimbangan posisi hukum antara konsumen dan pelaku usaha. Beberapa konsumen juga tidak mendapatkan ganti rugi atas kerusakan mobil, karena terikat perjanjian sepihak yang melanggar prinsip perlindungan konsumen. Dalam penelitian ini pentingnya pengetahuan  hukum baik konsumen maupun pelaku usaha agar lebih memahami  hak dan  kewajibannya, dan  seharusnya    konsumen   perlu melakukan upaya lanjutan untuk memperjuangkan haknya melalui Badan Penyelesaian Sengketa Konsumen.

Abstract

This study examines the potential reclassification of forest areas from National Park status to customary land (ulayat) for the Talang Mamak indigenous community in Riau. The issue stems from a longstanding conflict between the government and the Talang Mamak people, who feel that their traditional rights to the forest have been seized by the state through conservation policies. The research is positioned as a critique of the misalignment between state environmental policies and the recognition of indigenous rights, particularly in the management of natural resources. The research method used is a juridical-sociological approach, combining policy analysis through literature review and field interviews to gather perspectives from the indigenous community, as well as legal frameworks related to customary land rights and forest management. The findings show that the state’s centralized, conservation-oriented policies often conflict with sustainable forest management practices that the Talang Mamak people have followed for centuries. This conflict is exacerbated by the weak recognition and legal protection of the community's customary land rights. However, there is significant potential to reclassify the forest into indigenous-managed areas, provided there is strong policy support and active participation from all relevant stakeholders

Abstract

Kredit macet adalah kondisi di mana seorang debitur (nasabah/peminjam) tidak mampu atau tidak mau membayar cicilan atau pelunasan utang sesuai dengan perjanjian yang telah disepakati bersama pihak kreditur (pemberi pinjaman), baik itu bank maupun lembaga pembiayaan. Hal ini diatur secara eskplisit dalam Peraturan Otoritas Jasa Keuangan Nomor 35/POJK.05/2018 tentang Penyelenggaraan Usaha Perusahaan Pembiayaan, yang telah diubah terakhir kali dengan Peraturan Otoritas Jasa Keuangan Nomor 7/POJK.05/2022 tentang Penyelenggaraan Usaha Perusahaan Pembiayaan Penelitian ini bertujuan untuk menganalisis penyebab terjadinya kredit macet serta bentuk penyelesaian yang dilakukan oleh PT. JACCS Mitra Pinasthika Mustika Finance (MPM Finance) Cabang Rokan Hulu dalam perjanjian kredit, dengan menitikberatkan pada penerapan asas itikad baik. Kredit macet merupakan salah satu permasalahan serius dalam lembaga pembiayaan yang dapat merugikan perusahaan dan mengganggu stabilitas operasional. Penelitian ini menggunakan pendekatan yuridis empiris dengan teknik pengumpulan data melalui wawancara dan studi pustaka. Dengn Lokasi Penelitian di PT. JACCS Mitra Pinasthika Mustika Finance Rokan Hulu, sedangkan populasi dan sampel merupakan keseluruhan pihak yang berkaitan dengan masalah yang diteliti. Penelitian ini menggunakan summber data primer dan data sekunder dan teknik pengumpulan data dilakukan dengan wawancara Hasil penelitian menunjukkan bahwa kredit macet di PT. JACCS MPM Finance Rokan Hulu umumnya disebabkan oleh kelalaian nasabah dalam memenuhi kewajiban pembayaran, lemahnya pengawasan penggunaan objek kredit, serta kurangnya kesadaran hukum dari pihak debitur. Upaya penyelesaian yang dilakukan perusahaan meliputi pendekatan persuasif seperti pemberian surat peringatan secara bertahap, kunjungan ke rumah nasabah, restrukturisasi, diskon pelunasan, eksekusi jaminan, pelelangan hingga pelaporan ke kepolisian apabila terjadi tindakan melawan hukum seperti penggelapan objek kredit. Dalam konteks ini, asas itikad baik memiliki peran penting dalam membangun komunikasi dan kerja sama antara kreditur dan debitur demi mencapai solusi yang adil dan menghindari konflik berkepanjangan.

Abstract

Industrial relations regulation is a fundamental aspect of the national employment system, aiming to bridge the interests of employers and workers fairly and reflect the principle of balance. This study aims to determine the principle of equitable balance between worker protection and business flexibility in the reform of national labor law. This research uses a normative juridical approach focused on a literature review and analysis of relevant legal principles, concepts, and theories. Previous regulations emphasized worker protection as an effort to prevent injustice to vulnerable workers. The reform of labor law through the Job Creation Law seeks to reposition the balance by providing greater flexibility for employers and reducing the burden of labor costs, for example through adjustments to severance pay and expansion of PKWT (Working Permit) contracts. The main finding is that the reform brings a shift in the value of normative balance, focusing more on economic efficiency and business certainty for employers, while still striving to maintain worker fairness through schemes such as the Job Loss Guarantee. This reform, while providing operational convenience for employers, raises crucial questions about whether an optimal and equitable balance has been achieved, or whether it has instead created a new imbalance in which basic worker rights are sacrificed for economic flexibility. A just balance demands recognition of the strengths and vulnerabilities of both parties, as well as the formulation of regulations that enable inclusive economic growth and adequate social protection.
