Abstract

Batik sebagai salahsatu warisan budaya yang dimiliki Indonesia. Pada tahun 2009 UNESCO memasukkan batik Indonesia ke dalam Daftar Representatif sebagai Budaya Tak-benda Warisan Manusia (Representative List of the Intangible Cultural Heritage of Humanity) dalam Sidang ke-4 Komite Antar-Pemerintah (Fourth Session of the Intergovernmental Committee) tentang Warisan Budaya Tak-benda di Abu Dhabi. Hal ini mendorong Pemerintah Indonesia untuk menggiatkan batik di lingkungan masyarakat. Salah satunya adalah Kabupaten Grobogan. Banyaknya pelaku usaha di bidang batik (pengrajin batik) tentunya membutuhkan pengembangan usaha untuk keberlangsungan hidup usahanya. Pengembangan usaha ini terkait dengan perbuatan hukum dengan pihak lain dimana terkadang terdapat perjanjian diantara keduanya. Pengrajin batik sendiri lebih memfokuskan pada produksi bukan pada perjanjian. Masih minimnya pengetahuan tentang perjanjian menyebabkan kurangnya pemahaman akan akibat dari perjanjian tersebut. Alasan inilah yang mendorong pengabdi untuk mengenalkan perjanjian secara sederhana kepada pengrajin agar mereka tidak gagap atas perjanjian yang melibatkan mereka. Pengabdian dilakukan dengan dua tahapan. Pertama, adalah mendapatkan informasi selengkap-lengkapnya terkait dengan perjanjian yang pernah mereka buat dan kedua adalah dengan memberikan dasar-dasar sederhana dalam penyusunan perjanjian.

Abstract

Angka pengangguran di Indonesia pada tahun 2018 mencapai 6,87 juta orang. Tingginya angka pengangguran ini menunjukkan bahwa masih rendahnya kesadaran untuk melakukan investasi, hal ini di tunjukkan dari masih banyaknya orang yang mencari pekerjaan, yang mengakibatkan tidak pernah terfikirnya untuk melakukan investasi terutama untuk masa depan. Perlu adanya optimalisasi program investasi dengan cara melakuakan pelatihan dalam beberapa aspek yang berkaitan dengan sebelum melakukan investasi, saat proses investasi hingga sudah memasuki masa purnakerja. Untuk sebelum melakukan invetasi tentunya perlu adanya pemilihan investasi yang tepat, wawancara yang sesuai dengan jatidiri dan lain-lain. Sedangkan saat melakukan investasi dan setelah investasi adalah pelatihan di bidang hak-hak yang seharusnya diterima oleh investor agar dapat tetap sejahtera meskipun sudah tidak bekerja lagi. Pengabdian dilakukan dengan pendekatan yuridis sosiologis dengan melakukan beberapa rangkaian kegiatan secara berkelanjutan. Pengabdian dilakukan di lapangan lokasi yang pengabdi anggap relevan dengan masalah yang diangkat, yaitu Desa Jatijajar Kecamatan Bergas. Pendekatan yang seperti demikian diharapkan menunjang validitas dari hasil Pengabdian sebagai keluaran yang bermanfaat. Dengan menerapkan kompetensi tersebut di lokasi sasaran demi mengetahui kemanfaatannya. Sehingga akan terjadi sinegritas antara perusahaan dan calon investor.

Abstract

Cooperative Loans and Savings (KSP) is a business entity that having an essential role as an alternative capital fund which is faster and based on the Membership Principle. According to Law No 25 the Year 1992 concerning Cooperatives states that Cooperatives in Indonesia should operate under the Membership Principle. Cooperatives have social characteristics in the form of prioritizing mutual benefits and interests rather than personal interests and benefits. Thus, cooperatives must become the spearhead of the national economy by collecting and distributing funds. However, the reality, there are still numerous frauds in the process of collecting and distributing funds to raise the deposit and also the high interest and the high late charge. The problem appeared is how the actual management of cooperatives loans and savings to carry out their duties and functions. This research is also dealt with the extent of supervision, which is mandated by the law. KSP needs a proper procedural of supervision for their organization. The Financial Services Authority (OJK) is expected to work together with the Ministry of Cooperative and SMEs Office to supervise Cooperative Loans and Savings because it is found that many injustices have been fallen debtors and it is urgent to revise the law and make KSP is under OJK's supervision. The objective of this research is to examine the management of Cooperative Loans and Savings in Indonesia. The other aim of this research is to provide recommendation and consideration for the Indonesian government to strengthen the supervision of Cooperative Loans and Savings under OJK because there is malpractice regarding the term of interest in KSP. The research method used in this article is the statute method, which is supported by an empirical juridical approach in KSP Mitra Usaha Perkasa

Abstract

Consumer rights violations persist at music festivals due to errors and negligence by business actors, resulting in a disregard for legal protections and certainty. This failure in fulfilling legal responsibilities often leads to event cancellations. This study investigates two key issues: (1) Consumer protection following the cancellation of the 2022 Berdendang Bergoyang Festival, and (2) Dispute resolution efforts stemming from business actors' mistakes in the cancellation. Employing empirical juridical methods, including interviews, questionnaires, and document analysis, the research reveals loopholes allowing event organizers to bypass regulations, such as inadequate permits, facilitating exploitation by negligent parties. Resolution strategies involve non-litigation methods, such as mediation, aiming to refund tickets and compensate audiences. Litigation remains an option if agreements cannot be reached. The research concludes that consumer protection mechanisms often fail due to consumer vulnerability and business actors' lack of good faith. Recommendations include regulatory adjustments to eliminate loopholes, ensuring legal compliance and consumer welfare. Effective consumer dispute resolution requires both litigation and non-litigation approaches, emphasizing the importance of governmental and law enforcement intervention to safeguard consumer rights and promote legal certainty in festival arrangements.

Abstract

This research delves into the Actio Pauliana in bankruptcy cases, which involves legal action taken prior to declaring bankruptcy against the Debtor. The method employed in this research is a qualitative approach, utilizing statutory regulations and case studies. This type of research is normative juridical, examining and analyzing Supreme Court Decision No. 388 K/Pdt.Sus-Pailit/2014, the Civil Code, Law No.37/2004, Law no. 40/2007, and interviews with bankruptcy experts. Primary data sources include interviews with bankruptcy experts, while secondary data sources consist of primary legal materials such as legislation and court decisions, along with secondary legal materials like books, journals, and articles related to the research, as well as tertiary legal materials. Researchers gathered legal analysis materials and conducted literature studies, which were discussed qualitatively and descriptively. The discussion in this research revolves around the legal act of transferring company assets through a sale, executed under the name of the President Director before the court's decision to declare bankruptcy, as well as the legal consequences of the sale and purchase agreement, and the examination of evidence regarding the actions of the main director.

Abstract

The many offers of high income make many people interested in investing. People's carelessness backfires on those who are victims of fraudulent investments. Illegal investment or more commonly known as a fraudulent investment is indeed carrying out investment activities that are not following existing regulations. The ease of access to information and the affordability of technology today has become the ground for illegal investment actors to look for victims. Investments that initially aim to obtain maximum income from existing capital in the future harm investors. In illegal assets, it is not only the activities that are not appropriate, but the completeness of the licensing documents for investment companies is also incomplete. Many types of activities resemble investments but are fake or illegal. The victims of this activity are not only a few. Even from all walks of life are victims of this irresponsible activity. This service is carried out by educating the public regarding complaints and assisting with illegal investments. This service will be carried out by providing investment training for the community in Kalipancur Village, especially for mothers and teenagers who are often the target of investment fraud. Such an approach is expected to provide validity of the results as a good outcome. This training is considered efficient and effective because the public understands and understands commercial transactions through the internet to increase their knowledge to increase their income and standard of living.

Abstract

This paper explores the critical intersection of branding and legal protection for Micro, Small, and Medium Enterprises (MSMEs), acknowledging the pervasive misunderstanding among business actors regarding brands as intellectual property. Despite brands serving as integral identities for products, many MSME owners overlook their legal protection by the state. This gap in understanding exposes brands, including owned trademarks, to unauthorized use, posing significant risks to brand owners. Consequently, MSME actors often perceive brands merely as complementary additions to their products, neglecting their pivotal role in securing business viability. Recognizing the imperative for assistance in trademark registration to safeguard businesses, this paper advocates for proactive measures to educate and support MSMEs in navigating legal frameworks. By empowering MSMEs with the knowledge and tools for effective brand management and legal safeguards, this initiative aims to unlock opportunities for growth and competitiveness in the market landscape. Moreover, leveraging the potential of branding within tourism-rich regions like Karanganyar Regency, particularly the Matesih sub-district, offers a promising avenue for MSMEs to broaden product visibility. The influx of tourists presents an opportunity for MSMEs to position their products as souvenirs, thereby indirectly promoting their brands through consumer engagement. By capitalizing on protected brands, MSMEs can effectively tap into consumer-driven promotion and expand their market reach. This paper underscores the crucial role of community services in strengthening the legal protection of MSMEs' brands, thereby facilitating their sustained growth and resilience in the marketplace. Abstract

It is crucial to ascertain whether halal tourism regulation can stimulate economic growth and promote sustainable national development to achieve community well-being. This research aims to advance halal tourism regulation to encourage the community's well-being. This research employs a qualitative methodology to conduct sociological and legal research. The research’s findings show that the decentralization of halal tourism regulation is intended to enhance the community's well-being. Nevertheless, the central level has not engaged in any discussions regarding the legal framework governing halal tourism implementation. The number of tourist visits, destinations, and hotels can be increased by the implications of halal tourism regulation in the form of Regional Regulations, particularly in West Nusa Tenggara. However, this has not resulted in community well-being. In contrast, Malaysia maintains robust institutions and regulations. The regulation of halal tourism in Malaysia is crucial for enhancing community well-being, as it promotes economic growth, employment opportunities, and adherence to Islamic principles. Consequently, it is crucial to enhance the institutional framework in Indonesia to supervise the implementation of halal tourism, foster collaboration among stakeholders, and strengthen regulations surrounding halal tourism to encourage community well-being.
