Abstract

Dalam pemikiran Imam Syafi’i ada yang berpendapat bahwa apabila suami atau istri yang mafqud harus menunggu selama empat tahun dan menurut Undang-Undang serta Kompilasi Hukum Islam adalah harus menunggu dengan jangka waktu selama 2 tahun. Jangka waktu anta ra kedua pendapat ini sangat lama jika dikomparasikan. Ini karena canggihnya sistem transportasi dan informasi yang hadir pada era modern ini memberikan kesempatan yang cepat untuk mengetahui keberadaan si mafqud. Berbeda dengan waktu dulu yang yang masih belum mengenal sistem transportasi dan informasi. Maka di sini di lihat manakah yang lebih relevan untuk diikuti antara pemikiran Imam Syafi’i atau Undang-Undang dan Kompilasi Hukum  Islam. Dalam tulisan ini meneliti tentang Relevansi Pemikiran Imam Syafi’i tentang Mafqud Terhadap Perceraian Ghaib Studi Kasus di Pengadilan Agama Jombang. Penelitian ini bertujuan untuk mengetahui pendapat Imam Syafi’i tentang mafqud dan putusan Pengadilan Agama Jombang mengenai perceraian mafqud. Dalam penelitian ini, penulis menggunakan metode penelitian deskriptif yaitu penelitian yang berusaha menggambarkan dan menganalisis permasalahan sedetail mungkin. Jenis penelitian yang digunakan adalah bersifat penelitian kepustakaan (library research) dengan menelusuri teori-teori yang terdapat di perpustakaan dan lapangan. Hasil penelitian menunjukkan tidak ada satu dalil Al-Quran dan hadits yang menyebut batas waktu penetapan masa orang hilang, yang terdapat hanyalah pendapat sahabat yakni Umar bin Al-Khatab. Tetapi pendapat Umar hanyalah untuk istri yang kehilangan suami. Selain itu, dapat diketahui juga konsekuensi dari mafqud yang bisa terjadi terhadap orang sekeliling atau ahli warisnya dan ia menjadi satu tuntutan untuk menyelesaikannya. Karena hukum bersifat dinamis akan berubah dari waktu ke waktu mengikuti era perubahan zaman.

Abstract

Background. The dowry changes according to social, cultural, and economic conditions. The use of Alfiyah memorization as part of the dowry can have a deeper meaning within the maqashid sharia framework. Aim. This study examines the concept of memorizing Alfiyah as a marriage dowry in maqashid sharia and its implementation. Methods. This literature review qualitatively attempts to understand social problems (dowry) holistically which are formed through detailed grammar. Library source data are analyzed qualitatively with the process of data reduction, data presentation, and drawing conclusions or verification. Results. Dowry in Islamic law is a gift from a man to a woman as part of the marriage process. Dowry has a deeper meaning than just material value. The type of dowry depends on the form, value, or characteristics of the gift. The memorization of Alfiyah as a dowry in the concept of Maqashid Syariah can be seen from its objectives, namely Hifz al-Din, Hifz al-Nafs, Hifz al-Aql, Hifz al-Nasl, and Hifz al-Mal. The implications of memorizing Alfiyah as a dowry can have different impacts depending on the cultural context, religion, and social views of the community.

Abstract

This study examines the ownership and management of mines during the era of the Prophet Muhammad SAW. The method used in this study is qualitative by analyzing literature from Islamic historical sources, such as book documents, articles published in journals, texts of verses and hadiths of Islamic teachings, and others. The findings of this study indicate that the Prophet Muhammad SAW established basic steps in natural resource management, including mining, which are based on the principles of justice, benefits for society, and environmental protection. The summary of this study is that the mining management policy during the time of the Prophet Muhammad SAW can be a reference in sustainable and fair natural resource management today.

Abstract

Penelitian ini menggambarkan mengenai permasalahan pembagian waris bagi orang yang bekelamin ganda (khunta) berdasarkan pendapat Imam Ali As-Shobuni dan Imam Abu Hanifah, Salah satu daripermasalahan bagi orang yang bekelamin ganda (khuntsa) adalah dalam hal menentukan hak waris ataukewarisannya. Dalam al-Qur’an telah jelas dikemukakan secara detail mengenai hukum kewarisan untuk laki-laki dan perempuan. Tapi belum ditemukan dalam al-Qur’an mengenai hukum waris bagi orang yang bekelamin ganda (khunta) ini. Maka dalam penelitian ini akan dijelaskan bagaimana pendapat Imam Abu Hanifahdan Imam Ali As-Shobuni dalam menetapkan pembagian warisnya. Sifat penelitian adalah deskriptif dan jenis penelitian yang digunakanadalah normatif. Bahan hukum dan data diperoleh dari norma-norma hukum Islam tentang kewarisan dan khuntsa yang diperoleh dari nash al-Qur’an dan Hadits, serta pendapat para fuqaha’ dan para ahli yang diperoleh dari berbagai literatur tentang kewarisan.. Datadicari melalui studi kepustakaan (library research), sumber data primer dan sumber data sekunder. Hasil dari penelitian ini adalah, pada dasarnya dalam menentukan status hukum bagi bagi orang yang bekelamin ganda (khuntsa), dapat dilihat dari tanda-tanda kedewasaannya dan darimana ia mengeluarkan air kencing seperti yang disebutkan dalam sebuah hadis yang diriwayatkan oleh Ibnu Abbas.

Abstract

In the framework of Indonesian positive law, it is only the KHI that assigns child custody to the mother. Other legal provisions merely indicate that both parents are responsible for their children's care without clarifying which parent is awarded custody following a divorce. Various rulings exist that have granted custody to mothers, yet there are also instances where custody has been awarded to fathers. This creates ambiguity regarding the determination of child custody post-divorce. The objective of this study is to assess the most effective indicators for judges to consider in making child custody decisions, grounded in the principle of prioritizing the child's best interests. The methodology employed for this research is prescriptive normative legal analysis with a conceptual focus. Findings indicate that several factors can be utilized when deliberating on custody matters, including the child's wellbeing, the behavior of the parents, cooperation between them, and the allocation of parenting time. Should there be a need for additional factors, judges are permitted to incorporate these, provided they align with the principle of the child's best interests.

Abstract

Background. Requests for a guardian judge due to the guardian's nasab mafqud often occur with children whose parents are divorced, often found when a divorce occurs, one of the parents does not get custody of their child, does not care about their obligations to their child, as if they have disappeared without giving any news, especially visiting. to provide a living, and his whereabouts are unknown after the separation of the child's parents' relationship. Which ultimately makes it difficult for the child to carry out the marriage because the guardian is hampered by mafqud. Aim. This research aims to understand the implementation process of determining guardian judges as a result of mafqud in the Gudo Religious Affairs Office and how the proof of guardian mafqud carried out by the Gudo District KUA is viewed from an Islamic legal perspective and a positive legal perspective. Methods. This type of research is field research which is descriptive in nature using a phenomenological approach. Primary data sources were obtained through interviews and documentation from Gudo District KUA officials and supported by secondary data in the form of written literature or scientific works. Results. The results of this research explain that in determining the guardian of the judge because the guardian of the nasab is mafqud, the KUA officials refer to the procedures contained in Minister of Religion Regulation Number 20 of 2019. However, in proving the guardian of mafqud only with the testimony of the village head and there is no need for a judge's decision, in this case there is a lack of synchronization with the laws and regulations. -Existing invitations in Indonesia need to be improved.
