Maslahah Mursalah As The Istinbath of The Law of Ibn Taimiyah in Conditional Waqf Darlius, Darlius

Abstract

Many cases of waqf occur in the community, where waqif provides conditions that are not in accordance with the object of the waqf object. If someone wants to donate enough with the intention of endowments only. The research method that I use is library research, which is the object of research regarding Ibn Taimiyah's opinion in conditional waqf. In the research method, the author uses analytical content. in this case Ibn Taimiyah's opinion about the conditional and istinbath of Ibn Taimiyah's law will be explained about reservations and its participation in waqf contracts. The author conducts research on conditional waqf in Ibn Taimiyah's perspective, finally, the author concludes that Ibn Taimiyah's opinion on conditional waqf is the inclusion of conditions on waqf must realize the meaning of taqarrub (self approach to God). if waqif requires for certain fields that have no merit, then the effort is a futile both in the world and the hereafter. In short, such conditions are deemed null and void, but the endowments remain valid. in applying the istinbath of law, Ibn Taimiyah applied maslahah mursalah as his legal approach. Maslahah mursalah is a benefit that is considered to bring benefits to humans and is not found basically in syara '. Abstract

Penelitian ini bertujuan untuk: (1) Menghasilkan Modul Elektronik Berbasis Animasi Pada Mata Kuliah Media Pembelajaran di Program Studi Pendidikan Teknik Mesin, (2) Mengetahui kualitas Modul Elektronik Berbasis Animasi Pada Mata Kuliah Media Pembelajaran di Program Studi Pendidikan Teknik Mesin FKIP Unsri. Penelitian ini merupakan penelitian dan pengembangan (R&D). Validasi modul elektronik ini dilakukan oleh ahli media dan ahli materi. Subjek uji coba penelitian ini adalah 32 mahasiswa program studi pendidikan teknik mesin FKIP UNSRI. Kesimpulan dari penelitian ini adalah: (1) produk modul elektronik berbasis animasi pada mata kuliah media pembelajaran yang layak untuk digunakan; (2) Kualitas produk modul elektronik ini sangat baik, hasil penilaian ahli media dan ahli materi ditinjau dari aspek tampilan 85 (sangat baik), aspek pembelajaran 51 (baik), dan aspek materi 54 (baik). Sedangkan hasil penialaian peserta didik uji coba lapangan pada aspek tampilan sebesar 956 (sangat baik), pada aspek pembelajaran sebesar 684 (sangat baik),  dan pada aspek isi sebesar 847 (sangat baik).

Abstract

enelitian ini mengkaji tentang persoalan mengawali dan akhir batas waktu shalat menurut imam mazhab karena masih banyak di temukan perdebatan ditengah masyarakat terhadap permulaan masuk waktu shalat sehingga tidak jarang terjadi polemik. Tujuan penelitian ini mengungkap pendapat imam mazhab dalam menentukan waktu shalat yang lima. Metode yang digunakan metode kualitatif dengan mengungkap data yang bersumber dari kitab dan karya para imam mazhab dengan mendeskripsikan hasil temuan. Mereka sepakat bahwa penggunaan matahari sebagai pedoman untuk menentukan awal dan akhir waktu shalat. Dimana permulaan waktu subuh dimulai sejak terbitnya fajar sadiq hingga terbitnya matahari, waktu dzuhur mulai ketika telah terjadi peristiwa tergelincirnya matahari atau disebut zawal dan berakhir ketika bayangan suatu benda dua kali panjang benda itu selain bayangan zawal atau awal masuknya waktu ashar. Waktu shalat magrib dimulai ketika matahari terbenam dan berakhir selama syafaq belum terbenam. Sedangkan isya masuk ketika syafaq terbenam dan berakhir waktu fajar kedua belum terbit. Namun, menurut imam Hambali untuk akhir shalat isya terjadi pada pertengahan malam.

Abstract

The research related to the concept of wilyatul hukmi in determining the beginning of the qamariyah month which is used for the eclipse phenomenon, namely the implementation of eclipse prayer commands from the perspective of fiqh and astronomy. The purpose of this research is to disclose the implementation of wilayatul hukmi into eclipse prayers under the fiqh and astronomy perspectives. Both of them tried to find out the use of this concept in eclipse prayers. The research method used was qualitative with descriptive analysis data processing techniques. Where according to fiqh scholars, eclipse prayers are performed based on the meaning of the hadith text which states that if you see an eclipse, immediately pray and do not use calculations or news and are not tied to an area to perform the prayer. Meanwhile, according to astronomy, eclipse prayers are performed if the area is passed by an eclipse event and an area that is not passed by an eclipse event has no obligation to follow the legal policies of another area.

Abstract

This research is related to the thoughts of Imam Abu Hanifah who allows shigar marriages on the condition that both men must pay the mitsil dowry. This research seeks to reveal the reasons and legal guidelines used by Abu Hanifah regarding the permissibility of shigar marriage. This research method is library research which examines literature related to the research discussion, namely the books of al-Mabsuth and Badi'us Sana'i. Data were analyzed using descriptive analysis methods. Abu Hanifah is of the opinion that syighar marriage is prohibited because it makes the honor (budu') of the two women being married as a dowry, even though a woman's honor should not be used as a dowry, so that the dowry from the marriage becomes damaged (fasid), whereas "a marriage is not invalid just because the dowry is damaged (fasid)”, then in exchange for the damaged dowry (fasid) the two men are obliged to pay the mitsil dowry, this is required for marriages where the dowry is wine or pork. The prohibition in the two hadiths only shows that it is makruh, not haram, whereas "marriage is not invalidated by something that is makruh". The prohibition is also aimed at the essence of syighar, not at 'ain nikah. The argument that Abu Hanifah uses is a hadith narrated by 'Abdullah bin Umar "that the Prophet forbade marrying women without a dowry". The dowry is a right for the wife, not a guardian's right and an obligation for the husband, so a marriage cannot be empty or desolate from the dowry, as Allah SWT says in Surah an-Nisa: 4 and al-Baqarah: 236. In a broken syigar marriage (fasid ) is the dowry, not the contract, so that the marriage is not empty of dowry, in place of the damaged dowry (fasid) there is a mitsil dowry.

Abstract

This research aims to find out how the opinions of Hanafiyah and Syafi'iyah on the law of marrying the wife's sister who has been divorced ba'in at the time of divorce. on the law of marrying the sister of a wife who has been divorced ba'in during her iddah her iddah lasts. This research uses a qualitative method with literature data as the primary source. primary source is the book of Fath al-Qodir and Al-Muhazzab Fi Fiqh Imam Shafi'i, then the data is analysed using contents analysis. using contents analysis. The results of the study explain that the reason Hanafiyah scholars prohibit men from marrying because there is still a legal marriage bond and the husband is still obliged to provide nafafaf (maintenance) and the husband is still obliged to provide maintenance during the iddah period, so the husband cannot marry his wife's sister as in the iddah period husband may not marry his wife's sister as Allah says in Surah An-Nisa verse 23. Whereas the opinion of the Shafi'iyah scholars is that the marriage has been divorce ba'in kubra, besides that the husband does not have the obligation to provide nafaqah during the iddah period to provide maintenance during the iddah period of divorce ba'in. So it is permissible for a husband who has divorced his wife with a ba'in divorce may marry the sister of his ex-wife sister of the former wife.

Abstract

This research aims to reveal the reasons why nasab guardians do not become guardians in marriages as well as the reasons why mosque administrators become substitute guardians and the legal consequences of wrongly using guardians in marriages. This research method is qualitative with a case study approach. Primary data was obtained from traditional leaders, administrators, KUA officials, and nasab guardians. Data was collected through interviews and direct observation, then the collected data was analyzed using descriptive techniques. Based on the research results, the factors that cause religious guardians to be unwilling to become guardians are old age and health, worship, distance, lack of self-confidence, and the duties of mosque administrators. The reasons for the mosque administrator to become a substitute guardian; First, customary provisions and agreements. Second, there is a lack of socialization and cooperation between the village government, traditional leaders and the KUA regarding marriage law. The legal consequences of marriage include fasakh, namely a marriage that does not meet the requirements resulting in fasakh marriage, this is based on law no. 16 of 2019 amendments to law no. 1 of 1974 articles 22, 26 paragraphs 1, 27 paragraphs 1 and 2, and based on KHI article 71 letter e and the provisions of fiqh. The status of the nasab guardian who was replaced by the mosque administrator due to ungodly factors is that his marriage position is valid. However, if the guardian of the nasab had not expired and was replaced by the mosque administrator, the marriage was annulled so the marriage contract had to be repeated.

Abstract

Penelitian ini terkait dengan isbath talak isteri pertama yang di ajukan oleh isteri sah kedua dari suami yang telah meninggal kepada Pengadilan Agama Bangkinang kerena PT. Taspen tidak berkenan untuk mencairkan pensiun suami. Peneliti berupaya mengungkap dasar pertimbangan hakim dalam menetapkan isbath talak dalam perkara No. 06/Pdt-P/2001/PA-Bkn dan akibat hukum yang ditimbulkan. Metode dalam penelitian ini menggunakan kualitatif dengan teknik mengumpulkan data dengan mewancarai hakim kemudian data akan dianalisis secara normative hukum. Adapun dasar pertimbangan majelis hakim terkait talak yang dijatuhkan oleh suami pemohon terhadap isteri pertamanya dianggap sah diisbatkan karena didukung oleh bukti-bukti yang cukup serta mempertimbangkan asas manfaat, keadilan dan kepastian hukum. Disamping itu alasan hakim merujuk Pasal 49 dan 56 (1) Undang-Undang No. 7 Tahun 1989 tentang Perkawinan dan Pasal 27 Undang-Undang No. 14 Tahun 1970. Akibat dikabulkannya permohonan tersebut maka PT. Taspen ada kewajiban memberikan dana pensiunan kepada termohon. Penetapan ini berorientasi dalam asas manfaat dan asas hak mendapat keadilan bagi setiap warga negara.

Abstract

The aim of this research is to look at several existing hilal visibility criteria and see the extent of the impact that occurred after the implementation of the new MABIMS imakunurukyah criteria. In this research the author uses qualitative research with library data sources (library research) using qualitative descriptive analysis techniques where in this research the author describes in detail the existing criteria for visibility of the new moon and explains the impact of implementing the new MABIMS criteria from the perspective of ushul fiqh rules. The results of this research have the impact of applying the new MABIMS criteria to provide wider benefits in that at least we as Indonesian Muslims are moving forward in thinking about abandoning the old criteria which are no longer in accordance with the development of the world of astronomical science. Even with the implementation of the new MABIMS criteria, there are still differences in starting and ending the month of Qomariyah between Islamic organizations and the government. Differences will still be unavoidable if there is no agreement on the criteria used in determining the start of the Qomariyah month.
