Abstract

This study aims to find out and analyze the legality of the PRC's claim to the Nine Dash Line based on the historical claim of the PRC's Traditional Fishing Right in the South China Sea (SCS) from the perspective of international law sourced from the United Nations Convention on the Law of the Sea 1982 and PRC efforts to defend their claims in the SCS from countries with both claims and interests. This type of research is normative legal research using the Statute Approach and the Conceptual Approach. This study concludes that if you look at UNCLOS 1982, the PRC's claim to the Nine Dash Line cannot be maintained as a territorial claim because UNCLOS 1982 does not regulate how to determine the baseline based on historical claims, and according to UNCLOS 1982 handles the drawing of the baseline in 3 ways. Then, the PRC, in defending its claims, used various means such as the military occupation of uninhabited islands, increased military force, and deployment of ADIZs. In addition, the PRC also divided ASEAN in taking a stand on the SCS dispute.

Abstract

The title of this article is the Human Rights Aspects In The Establishment Of Law Regulations In Indonesia. The background of this writing is whereas in the constitution, one of the elements of a rule of law is the fulfillment of human rights in it, so that in this case the red thread can be drawn in this research there are still problems in the implementation of norms for the formation of laws and regulations in Indonesia. This study uses a normative juridical, the problem approach used is a statute approach and a conceptual approach. Based on the result of this research, first, that the urgency of human rights values is the basis for forming laws and regulations in Indonesia because human rights values are natural and its position has been mandated in the 1945 Constitution. Second, that laws and regulations are still found both at the central and regional levels those who have not implemented human rights aspects. Third, that the drafting of this legislation was carried out by the Directorate of Human Rights Instruments as an effort to fill the legal vacuum for a public need for human rights, the Directorate of Human Rights Instrument.Keywords: Human Rights, State Law, Legislation.

Abstract

The marital rape case is the one sexual violence case based on unequal relations between husband dan wife. In Indonesia, positive law doesn’t differentiate imprisonment or fines between sexual violence perpetrated by another person and sexual violence perpetrated by a partner in marriage. This article was written using feminist legal theory and human rights which describes the position of women in the eyes of the law and the fulfillment of the rights of wives as victims of marital rape. This study uses a juridical-normative method which aims to explain the criminal burden of rape cases based on a human rights perspective. Conclusion in this study is that cases of marital rape that occurred against wives are a form of violation of human rights in which criminal sanctions are needed to distinguish cases of sexual violence committed by other people from cases of sexual violence committed by partners in marriage.Keywords: Criminal Prosecution, Human Rights, Marital Rape.

Abstract

Pembunuhan terhadap jurnalis Jamal Khashoggi di Istanbul Turkiye menimbulkan kompleksitas terhadap penerapan yurisdiksi. Menurut fakta, kasus itu muncul sebagai akibat dari pelanggaran HAM terhadap jurnalis, pelaku yang merupakan tangan kanan kerajaan Arab Saudi mencari impunitas dan kedaulatan hukum di hadapan keinginan untuk mendestabilisasi negara. Situasi saat ini menunjukkan bahwa kehadiran organisasi internasional dan pemerintah adalah faktor penting dalam penyelidikan yang sedang berlangsung atas kematian Jamal Khashoggi untuk mendapatkan keadilan melalui sistem peradilan sesuai dengan Draft Articles on Responsibility of States for Internationally Wrongful Act 2001. Penelitian ini mencoba mencari solusi yang solutif terkait perlindungan HAM jurnalistik di kancah internasional dengan menggunakan penelitian hukum yuridis normatif, penelitian ini menemukan permasalahan-permasalahan yang dihadapi di dalam hukum internasional. Permasalahan-permasalahan tersebut diantaranya, terkait penyelesaian kasus tersebut hingga saat ini dan mengetahui penerapan prinsip yurisdiksi negara dalam pembunuhan Khashoggi. Dengan menyelesaikan permasalahan tersebut, peneliti menawarkan bahwa penerapan prinsip yurisdiksi negara berdasarkan hukum internasional adalah prinsip yurisdiksi teritorial dan nasionalitas mengacu pada Arab Saudi. Namun tidak sepenuhnya dapat diberlakukan karena adanya suatu pelanggaran. Salah satu bentuk upaya tersebut mencakup investigasi secara rinci, pengusutan pelaku kejahatan, dan kerja sama internasional dengan melibatkan pihak netral atau mediator yang dapat dijadikan sebagai regulasi tambahan antara pihak-pihak yang terlibat.Kata Kunci: Tanggung Jawab Negara; Yurisdiksi; Perlindungan Hak Asasi Manusia Jurnalis.The murder of journalist Jamal Khashoggi in Istanbul Turkiye raises complexities regarding the application of jurisdiction. According to the facts, the case arose as a result of human rights violations against journalists, the perpetrators who are the right hand of the kingdom of Saudi Arabia seeking impunity and rule of law in the face of the desire to destabilize the country. The current situation shows that the presence of international organizations and governments is an important factor in the ongoing investigation into the death of Jamal Khashoggi to obtain justice through the justice system in accordance with the Draft Articles on Responsibility of States for Internationally Wrongful Act 2001. This research tries to find solutions related to this. protecting journalistic human rights in the international arena by using normative juridical legal research, this research finds the problems faced in international law. These problems include the resolution of the case to date and knowing the application of the principle of state jurisdiction in Khashoggi's murder. By resolving this problem, the researcher offers that the application of the principle of state jurisdiction based on international law is the principle of territorial jurisdiction and nationality referring to Saudi Arabia. However, it cannot be fully enforced because there is a violation. One form of this effort includes detailed investigations, prosecuting criminals, and international cooperation involving neutral parties or mediators who can serve as additional regulations between the parties involved.Keywords: State Responsibility; Jurisprudence; Protecting the Rights of Journalists.

Abstract

Settlement of medical malpractice cases using litigation is deemed ineffective in terms of benefits both for the health profession as perpetrators and for patients who are victims. Law Number 17 of 2023 concerning health in handling medical malpractice using the principles of restorative justice is expected to be the answer to this problem. Research This study uses a doctrinal legal research method which aims to test the suitability of the principles of restorative justice in legislation with a victimology perspective, which is then updated through reorientation of the suitability of criminal law policy formulations with a victimology perspective in medical malpractice. The results of this research are in principle the current criminal law policy. with the perspective of postmodern victimology in terms of handling medical malpractice, it is compatible. Regarding the issue of criminal liability for perpetrators of medical malpractice, it lies in individuals, namely medical personnel and/or health workers, then corporations, namely health service facilities, but it does not rule out the possibility that criminal liability can be prosecuted against both of them. Even though according to the principles of justice restorative justice has been included in the Health Law but there are no regulations regarding the minimum requirements for suspected medical malpractice that can be resolved using the principles of restorative justice and guidelines for implementing efforts to apply the principles of restorative justice outside of court. Cases of alleged medical malpractice are like icebergs that are more likely to remain untouched than which is already in legal proceedings at both the investigation/investigation and trial levels, while at this stage it is the spearhead of the success of implementing the principles of restorative justice. Therefore, it is necessary to formulate a criminal law policy in the form of material legal rules related to minimum requirements for medical malpractice that can be pursued with restorative justice and formal law related to alternative implementation guidelines. dispute resolution outside of court.Keywords: Medical malpractice, Criminal Law Policy, Victimology, Restorative Justice.

Abstract

The omnibus law model has become a new method of legislative drafting in Indonesia, first applied to the Job Creation Law and later enacted as Law 11/2020. While there were no implicit guidelines in Legislative Drafting Law 12/2011, this adoption was imported from several countries like the United States and Ireland to simplify regulations before the method was subsequently formalized and included in Legislative Drafting Law 13/2022. This paper explored the pathway and dynamics of the omnibus law adoption in Indonesia's law-making procedure and analyzed its further impacts on whether such a method has fruitfully improved the quality of the enacted regulation in establishing a more friendly investment policy. Through doctrinal method, this study showed that the opportunity to apply the omnibus model in Indonesia depends on the effectiveness, success, and benefits of respective regulations. In contrast, the application of the omnibus law model should respect democratic principles and avoid public harm. As shown in three different countries, i.e., Indonesia, the United States, and Canada, public concerns on lack of participation should be taken seriously to hinder undemocratic ends through "democratic" means. Alternatively, accountability of the drafting process should be considered a priority. In summary, the increasing trend of adopting the omnibus model should be first adopted and promulgated through legislative products whose promulgation must be with a formidable law-making procedure.
