Abstract

Anak sebagai generasi penerus bangsa adalah penerus perjuangan bangsa yang diberikan ilmu pengetahuan dan pengajaran. Undang-undang Nomor 3 tahun 1997 Pasal 1 ayat (1) tentang Pengadilan Anak, mengatur bahwa anak adalah orang yang dalam perkara Anak Nakal telah mencapai umur 8 (delapan) tahun tetapi belum mencapai umur 18 (delapanbelas) tahun dan belum pernah kawin. Anak tidak terlepas melakukan tindak pidana, pidana merupakan salah satu alat dan bukan tujuan dari hukum pidana, yang apabila dilaksanakan tiada lain adalah berupa penderitaan atau rasa tidak enak bagi yang berangkutan disebut terpidana. Yang salah satunya adalah turut serta melakukan tindak pidana oenyekunduoan manusia. Pengertian tindak pidana penyelundupan manusia sendiri adalah perbuatan kejahatan yang mencari untuk mendapat keuntungan langsung maupun tidak langsung keuntungan finansial atau materi lainnya dari masuknya seorang secara ilegal ke suatu bagian negara dimana orang tersebut bukanlah warga negara asli atau memiliki izin tinggal. Pengertian turutserta disini adalah turut sertanya seseorang atau lebih pada waktu seseorang lain melakukan tindak pidana. Di dalam pasal 55 KUHP jenis penyertaan yaitu pelaku atau Plegger, orang yang menyuruh melakukan (doenplegen), orang yang turut serta (medepleger), penganjur (uitlokker), pembantuan (medeplichtige). Pemidanaan anak di Indonesia haruslah sesuai dengan Undang-undang PengadilanAnak. Pemidanaan anak adalah suatu proses pemberian atau penjatuhan pidana kepada anak oleh hakim anak. Pidana penjara yang dapat dijatuhkan kepada anak nakal sebagaimana dimaksud dalam pasal 1 angka 2 huruf a, paling lama 1/2 ( satu per dua ) dari maksimum ancaman pidana penjarabagi orang dewasa. Abstract

Kekerasan bisa menimpa siapa saja, tidak terecuali seseorang yang mempunyai pekerjaan atau profesi di bidang hukum seperti Notaris. Ada saja seseorang atau sekelompok orang yang melakukan kekerasan terhadap Notaris. Meskipun demikian, Notaris dalam menjalankan profesinya terikat pada perannya yang memang harus kuat dan berani menghadapi tantangan apapun, termasuk kekerasan guna memberikan layanan yang terbaik pada masyarakat atau pihak-pihak yang membutuhkan dirinya. Kekerasan hanya sebagai bagian kecil dari beragam tantangan yang dihadapinya dalam menjalankan kewenangan, kewajiban, atau tugas-tugas profesionalitasnya.Kata kunci: Notaris, kekerasan, profesionalisme, layananViolence can happen to anyone, including someone who has a job or legal profession such as a Notary. There is a person or group of people who commit violence against a Notary. Even so, the Notary in carrying out his profession is bound to his role that indeed must be strong and brave to face any challenges, including violence in order to provide the best service to the society or those who need him. Violence is only a small part of various challenges that has to be faced in carrying out his authority, obligations or professional duties.Keywords: Notary, violence, professionalism, service

Abstract

Pemidanaan yang diberlakukan atau dikenakan pada seseorang jelas mempunyai tujuan, termasuk pada notaris. Tujuanya bukan hanya membuat jera dan mereformasi pribadi notaris yang terlibat melakukan tindak pidana, tetapi juga untuk mencegah supaya di kemudian hari tidak ada lagi notaris yang berani melakukan kejahatan atau tindak pidana yang sama. Notaris juga manusia biasa, meskipun dirinya menyandang profesi khusus, yang bisa saja terjerumus melakukan tindak pidana, sehingga pemberlakuan pemidanaan juga harus berlaku padanya secara egaliter, dan bahkan karena profesinya ini pula, penjatuhan hukuman yang bersifat pemberatan pantas diberlakukan padanya.Kata kunci: notaris, profesi, tindak pidana,  pemidanaan Punishment enforced or imposed on someone clearly has a purpose, including the notary. The aim is not only to deter and reform the notary who is involved in committing a criminal act, but also to prevent the notary from daring to commit the same crime or criminal act in the future. Notaries are also ordinary human beings, even though they carry a special profession, which can be caught in criminal acts, so that the imposition of punishment must also apply to him in an egalitarian manner, and even because of his profession, appropriate sentencing is imposed on him.Keywords: notary, profession, criminal act, punishment

Abstract

This study aims to analyze and clarify the application of criminal law principles in cases of euthanasia. The concept of euthanasia is a new thought in criminal law that arises because of humans' desire to determine life's direction. The realization of life's ownership of oneself gives birth to the thought that one can hasten one's death. The conception of self-determination in euthanasia is by realizing the right to autonomy, which is an essential principle in medical law. However, the manifestation of euthanasia as the fulfillment of autonomy has a conflict with criminal law, especially in Indonesia. In Indonesia, the conflict of norms on euthanasia and the provisions of criminal law can be seen in the legislative product, namely the Criminal Code (KUHP), which clearly reflects euthanasia prohibition. A study of euthanasia in criminal law principles shows that health regulation, especially regarding euthanasia, needs to pay attention to the right to patient autonomy as its main principle. The conflict over the right to autonomy and Indonesian criminal law creates a conflict of norms that further tests euthanasia's legality in Indonesia. KEYWORDS: Indonesian Criminal Code. Abstract

As the nation's future generation, children have the right to a protected environment, as a lack thereof endangers their growth. One form of child protection is specifically regulated in Law Number 35 of 2014 on the Amendment to Law Number 23 of 2002 on Child Protection (Child Protection Act). Decency crimes against children as in case Number 535 / Pid.sus / 2015 / PN.Bls, the judge drops Article 82 Paragraph (1) of the Child Protection Act. This article contains two problems, inter alia, the judge's decision in case Number 535 / Pid.sus / 2015 / PN.Bls whether it is in accordance with Article 82 paragraph (1) or Article 81 Paragraph (2) of the Child Protection Law and whether the witnesses are examined in case Number 535 /Pid.sus/2015/PN.Bls complies with Article 171 of the Criminal Procedure Code (KUHAP). This study uses the method of legal research with conceptual approach. The results and conclusions obtained in the writing of this article states that the judge must be more thorough in proving the elements of the article, and examine the witness more carefully to see the provisions of Article 171 of the Criminal Procedure Code. Abstract

Tax avoidance has become a significant problem that adversely impacts the state's financial system, and its impact can obstruct the state, resulting in distrust of the government. The distrust towards the government, generally due to the reason for tax avoidance. Tax avoidance is fundamentally people's awareness of economic democracy. In Indonesia, the current discussion refers to the Tax Procedure Act, specifically regulates the obligation of the taxpayer, but limiting the rights of taxpayers. It becomes a crucial problem of transparency as part of social rights. Although the activities indicate, democracy practice but other critical challenges affect its implementation. The state, as a people's forum, has an unrealized purpose and has the potential national disintegration. The potential of disintegration forms transparency in the taxation system. Transparency in the tax management can provide accountability between the government and citizens to maintain the effectiveness of tax administration. Using transparency in the taxation system is an excellent solution for a democratic economy. By using doctrinal research, tax transparency has aspects of being balanced to realize the welfare of the country. Balancing the features of the taxation system requires the right transmission to achieve the country's purpose for people's welfare. Keywords: Transparency, Tax Avoidance, Tax Law.

Abstract

This paper aims to examine the implementation of the Child Friendly Cities and Districts in Indonesia, as part of the decentralized agenda of current Indonesian reform. Child protection has become one of the current problematic issues. This protection includes the effort to guarantee and ensure the right to live, grow, develop, and participate fully in realizing each child's future. The Indonesian government introduces regional child protection, it is Child-Friendly Cities and Districts as a part of the critical address responding to the issue to the extent the government provide a serious protection for the infant generation. Historically, the United Nations Children's Fund (UNICEF) initiated this concept, whose purpose was to aspire to children's rights through the goals, programs, policies, and local governance structures. To date, there remain many regional governments that do not have regulations on child-friendly cities or districts. This paper considers Indonesia's regions experiencing in regulating and implementing the child-friendly cities and districts that have become a benchmark for the other regions. In the end, this paper concludes that each region must regulate and implement the child-friendly cities with regional characteristics into a series of regional regulations, particularly preceded by the regional regulation. Abstract

The Covid-19 pandemic, which has become a global epidemic, requires the implementation of health protocols in order to prevent its spread, creating its own social problems, especially for the growth and development of children, so that they are the most affected. This study uses empirical juridical methods and uses a conceptual approach. The results of this study indicate that the problem of fulfilling children's rights during the pandemic is still a priority scale program by the government in Jember Regency which must be resolved immediately, especially in terms of health and education. In the context of health, children still have not received vaccination facilities. On the other hand, online children's education is also not optimal due to limited interaction between teachers and students. This research also formulates recommendations for formulating precise policies in terms of mainstreaming the fulfillment of rights to children during the Covid-19 pandemic, especially in Jember Regency, establishing an accountable and accurate information system regarding the distribution of children affected by the Covid-19 pandemic, and making new breakthroughs related to mechanisms. education, health and the environment in favor of the fulfillment of children's rights

Abstract

This study aims to analyze the legal rules governing legal protection for victims of repressive actions carried out by police officers when securing demonstrations or what are commonly called rallies. The right to express opinions is a human right that is guaranteed in Article 28 of the 1945 Constitution of the Republic of Indonesia. In the implementation of demonstrations that result in casualties, it is clear that there is an error or a form of violation, including Human Rights which are clearly regulated in the Constitution. some pre-existing rules. This study uses a juridical-normative method with a conceptual approach and legislation. The authors in this study used primary legal materials derived from legislation and secondary sources from legal books and journals that were relevant to the discussion. Then to enrich the references in this study, the authors use non-legal materials. This research shows that, there has been legal protection that has been provided by the Government in the form of preventive and repressive protection and the existence of PROPAM is considered helpful in protecting the rights of the community. Abstract

Notaries basically work to get fair and proper compensation and treatment in an employment relationship, so a notary should be able to re-apply as a notary after completing the bankruptcy process. Because the notary who has been declared bankrupt and has been dismissed by the minister has paid compensation to the creditor, so that the creditor has received his rights. The UUJN provides provisions if a notary who has been declared bankrupt will be dishonorably dismissed from his position as regulated in Article 12 letter a of the UUJN. The type of research used is normative juridical, with a statutory approach and a conceptual approach as well as a historical approach. The regulation of the bankruptcy notary in Article 9 and Article 12 of UUJN is vague, ambiguous and inconsistent. A Notary as a General Officer is given the authority to make an authentic deed. Future arrangements regarding the reappointment of notaries who have completed the bankruptcy process, that there needs to be complete and specific regulations, because there is a void in norms regarding the reappointment of notaries who have completed the bankruptcy process.
