Abstract

Societal welfare is the achievement that should be supported by Government which essentialy has the obligation for the societal welfare through the arrangements within the scope of authority under the mandate of the preamble and articles of   the Indonesian Constitution of 1945 and relevant laws. The mandate of ASEAN Charter, which was ratified by House of Representative by Law Number 38 of 2008 concerning Ratification of the Charter of the Association of Southeast Asian Nations, is not an opponent of the Constitution of 1945 in terms of societal welfare, as long  as the legislation is implemented on the right way, which can protect Indonesian. The legislative action must reflect the needs and the factual conditions of Indonesian. Regulation relating to the implementation of the ASEAN Charter should always be accompanied by exemption or exception to the path of liberation from the regional competition law which is a logical consequence of the free market of ASEAN in some fields.

Abstract

Preliminary ruling procedure seperti yang diterapkan di Uni Eropa dapat menjadi metode alternatif dalam pelaksanaan constitutional complaint di Indonesia. Undang-Undang Dasar 1945 sebagai hukum tertinggi di Indonesia dikawal oleh lembaga yang bernama Mahkamah Konstitusi Republik Indonesia, dan dalam preliminary ruling procedure untuk pemberlakuan constitutional complaint maka dibutuhkan Peran Pengadilan Negeri dimana melalui preliminary ruling procedure tersebut dapat melakukan constitutional question kepada Mahkamah Konstitusi, dan berlanjut sampai dengan memutuskan perkara constitutional complaint tersebut atas nama Mahkamah Konstitusi, jadi secara tidak langsung Mahkamah Konstitusi memutuskan perkara melalui Pengadilan Negeri. Hal ini untuk menjamin konsistensi antara Mahkamah Konstitusi sebagai lembaga peradilan yang berwenang mengawal konstitusi serta menjamin akan adanya kepastian hukum yang harus diterima oleh warga negara secara efektif. Sehingga konstitusi memiliki direct effect secara individual dalam kehidupan sehari-hari rakyat Indonesia.Preliminary ruling procedure as applied in the European Union can be an alternative method for the implementation of the constitutional complaint in Indonesia. Constitution of Republic of Indonesia of 1945 can be assumed as the highest law in Indonesia which been guarded by the institution called the Constitutional Court of Republic of Indonesia, the preliminary ruling procedure for the implementation of the constitutional complaint required the seminal role of the District Court which can exercise the constitutional question to the Constitutional Court and continues it into the judgement of the constitutional complaint on behalf of the Constitutional Court indirectly. This method is to ensure not only the consistency between the Constitutional Court as the guardian of the constitution but also to guarantee the legal certainty which can be accepted by citizens effectively. So the constitution has a direct effect on an individual basis in the daily life of the people of Indonesia.

Abstract

Abstract

The Conflict in South China Sea involves several countries in Southeast Asia, such as the Philippines, Vietnam, Malaysia, Brunei Darussalam, and Indonesia. It is dealt with the rights of ownership, as a result of the People Republic of China (PRC) to unveil nine-dashed line which partially claims over South China Sea. But, it is followed by other countries to release new evidences on the territorial status of South China Sea. Though the Permanent Court of Arbitration had decided the petition of the Philippines in 2013, PRC could not admit the Arbitration. Essentially, Indonesia is not directly involved as a party in the case. But as the evidence provided by PRC, Natuna Islands is part of nine-dashed line in which it asserts that such islands are regarded part of PRC. As a result, Indonesia needs to anticipate on the further potential contention of territorial claims as it has islands around the South China Sea. Abstract

AbstractSince its inception in 1967, the Association of Southeast Asian Nations (ASEAN) has been based upon the common interests of its member states and the principle of solidarity. These two cornerstones have played an important role in the efforts for development of this regional organization. Under the principle of solidarity, ASEAN configures a distinct intergovernmentalism subjected to collective decision-making which emphasizes common understanding, including on how it approaches security concerns. This article aims to discuss and analyze the prospect of the collective food security in ASEAN by taking into account the legal frameworks of food security in the ASEAN community and Indonesia. Specifically, this article reflects the development of ASEAN and the member states’ common problem of providing food for national consumption. ASEAN’s development shows that it has committed to food security. For instance, ASEAN signed the Agreement on the ASEAN Food Security Reserve. However, this institution has not paid enough significant attention to food security and the ASEAN integration pillars are often justified to exempt food security amongst its priorities. Therefore, this article clarifies that food security is an essential part of the pillars. By the inclusion of food security to such pillars and taking account of Indonesia’s experiences, there is an importance for ASEAN to re-consider food security. This consideration is not only to achieve part of its ultimate objectives to bring prosperity but also to ensure regional stability.Ketahanan Pangan Kolektif dalam Kerangka Komunitas ASEAN: Sebuah Refleksi dari Kebijakan Pangan IndonesiaAbstrakSejak didirikan pada 1967, Association of Southeast Asian Nations (ASEAN) berlandaskan pada kepentingan bersama para negara anggota dan prinsip solidaritas. Kedua landasan utama ini memainkan peran penting dalam upaya pembangunan organisasi regional ini. Berdasarkan pada prinsip solidaritas, ASEAN membentuk sebuah kelembagaan intergovernmental yang berbeda dengan keputusan kolektif yang menekankan pada pemahaman bersama, termasuk dalam kaitannya bagaimana organisasi ini menyikapi urusan ketahanan. Artikel ini bertujuan untuk mendiskusikan dan menganalisis prospek ketahanan pangan kolektif di ASEAN dengan mempertimbangkan kerangka hukum ketahanan pangan di komunitas ASEAN dan Indonesia. Artikel ini secara spesifik merefleksikan perkembangan ASEAN dan permasalahan bersama pada negara-negara anggotanya dalam penyediaan pangan untuk memenuhi konsumsi nasional. Perkembangan ASEAN menunjukkan bahwa terdapat komitmen mengenai ketahanan pangan. Misalnya, ASEAN telah melakukan penandatanganan Perjanjian Cadangan Ketahanan Pangan ASEAN. Namun, institusi ini tidak begitu menunjukkan keseriusan terhadap ketahanan pangan dan pilar-pilar integrasi ASEAN seringkali dijustifikasi untuk mengecualikan ketahanan pangan dalam ke dalam daftar prioritas. Oleh karena itu, artikel ini mengklarifikasi bahwa ketahanan pangan sebenarnya sudah tercakup di dalam pilar-pilar tersebut. Dengan dimasukkannya ketahanan pangan dan belajar dari pengalaman Indonesia, ASEAN perlu mempertimbangkan kembali pentingnya ketahanan pangan. Abstract

This paper aims to examine problems regarding the possible abuse by refugees inconsistent with Indonesia’s laws and regulations. In the context, the government can make efforts to deal with refugees who enter Indonesia illegally and the government can formulate new laws and regulations that can discuss problems caused by refugee actions in more detail, clearly and in detail, starting from the arrest process to the sanctions process that is obtained. Because until now Indonesia has not had this policy. Those refugees' status then serves the purpose to get a decent living in a recipient country such as Australia. Misuse of visas is widely used by refugees because Indonesia implements a visa-free system of visits to 169 countries in the world. Visa-Free Visit Policy based on President Regulation Number 125 of 2016 concerning Visa-Free Visit. In this regard, the country needs to anticipate the increasing number of visa misuse for refugees entry to Indonesian territory by sending them to immigration detention centers as a form of sanctions imposed before returning to their country and making deportation the last step in resolving the visa misuse problem committed by refugees. Abstract

This community service is entitled "Prevention and Handling of Domestic Violence from a Legal Perspective". In family life it is undeniable that conflict can occur in family relationships, conflict resolution should be resolved properly by realizing and understanding the feelings, personality and emotional control of each family member so that happiness in the family is realized. Healthy conflict resolution occurs when each family member does not prioritize personal interests, look for the root of the problem and make solutions that are mutually beneficial to family members through good and smooth communication. But on the other hand, conflicts that exist in the family, can happen badly so that it can lead to domestic violence (KDRT). This outreach activity was carried out using the problem inventory method, lectures, discussions and direct questions and answers with the participants. This activity was successful and has the potential to be followed up into a more concrete and contributive agenda. This community service was carried out on January 27, 2022 at the Head of the Muslimat Nahdahtul Ulama Branch of Karangpring Village, Sukorambi District, Jember Regency. The form of the activity is counseling, by providing socialization on Law Number 23 of 2004 concerning the Elimination of Domestic Violence, with the aim of forming the public to know and understand the law while at the same time fostering community sensitivity and solidarity.
