Abstract

Penelitian ini bertujuan untuk mencari jawaban dan alasan mengapa hakim dapat mengabulkan dan memberikan dispensasi nikah  kepada pasangan yang belum cukup umur. Untuk memperoleh jawaban tersebut peneliti menggunakan penelitian lapangan (field research) yang didukung dengan data primer berupa wawancara langsung dengan hakim dan panitera permohonan di Mahkamah Syar’iyah Jantho. Hasil penelitian menunjukkan bahwa dasar kewenangan hakim menerapkan diskresi adalah dengan melakukan pemilihan fakta-fakta yang diajukan sehingga dapat dipilih fakta yang relevan dan benar-benar menjadi alasan hukum yang tepat. Dengan begitu, hakim dapat membuat suatu keputusan yang bijaksana yaitu keputusan yang memenuhi unsur keadilan, kepastian, kemanfaatan hukum dan menimbulkan kemaslahatan bagi pasangan tersebut. Temuan lainnya, dasar pertimbangan hakim dalam menerapkan dispensasi nikah dikarenakan khawatir dan takut akan timbulnya fitnah, disebabkan banyak kemudharatan atau dampak negatif yang timbul apabila tidak diberikan dispensasi nikah tersebut.

Abstract

Corruption in Aceh has become a serious issue, with its corruption rates over the past decade being above average compared to other provinces in Sumatra and nationally. Efforts to eradicate corruption do not solely rely on law enforcement agencies but also require the participationof various parties, including religious leaders. Thestudy aimedto analyze the perspectives and participationof ulama (scholars) in Aceh in combating corruption. It employedan empirical legal research method with a sociological anthropological approach. The results of this study indicated that corruption in Aceh wasa complex issue that requires a holistic approach and cross-sector collaboration. Ulama plays an important role in eradicating corruption through preaching and religious education that instills the values of amar ma’ruf nahi munkar (enjoining what is good and forbidding what is wrong).However,their involvement is limited to the general public without direct access to policymaking. Effective efforts require synergy between ulama, law enforcement, the government, and society to create a corruption-free culture.

Abstract

The implementation of the Qanun No. 11/2018 on Sharia Financial Institutions (SFIs) has led all conventional banks to suspend their operation in Aceh. The Qanun has imposed Acehnese people to use sharia banking services. It raises the question of the extent non-Muslims accept the implementation of the Qanun on SFIs considering their civil rights and how they view the Qanun in terms of their religiosity, legal compliance, and motivation for submitting to it. This study aims to analyze the reasons why non-Muslims submit to and comply with the Qanun, as well as their experiences in receiving sharia banking services. This juridical and empirical legal research collected data from observation and in-depth interviews with nine respondents in several districts in Aceh and three people outside Aceh. It concludes that non-Muslims are generally in favor of the Qanun's implementation. They do not mind utilizing sharia financial products and services, and the Qanun's provisions do not restrict their access and interests. The administration of the banks can generally satisfy the legal requirements of offering sharia banking clients quality services irrespective of their religious background. All engagement elements are fulfilled under the civil law. The sharia banking principles has not only become shared values among different religious adherents in Aceh but also do not conflict with non-Muslim customers' beliefs, religions, and rights in terms of the priniciple of equality before the law. Abstrak: Penerapan Qanun Nomor 11 Tahun 2018 tentang Lembaga Keuangan Syariah (LKS) telah menyebabkan seluruh bank konvensional menghentikan operasionalnya di Aceh. Qanun tersebut telah mewajibkan masyarakat Aceh untuk menggunakan layanan perbankan Syariah. Hal ini menimbulkan pertanyaan sejauh mana non-Muslim menerima penerapan Qanun tentang LKS dengan mempertimbangkan hak-hak sipil mereka dan bagaimana mereka memandang Qanun dalam kaitannya dengan keberagamaan, kepatuhan hukum, dan motivasi untuk tunduk pada Qanun tersebut. Penelitian ini bertujuan untuk menganalisis alasan non-Muslim tunduk dan patuh terhadap Qanun, serta pengalaman mereka dalam menerima layanan perbankan syariah. Penelitian hukum yuridis dan empiris ini mengumpulkan data melalui observasi dan wawancara mendalam terhadap sembilan responden di beberapa kabupaten di Aceh dan tiga orang di luar Aceh. Laporan ini menyimpulkan bahwa non-Muslim pada umumnya mendukung penerapan Qanun tersebut. Mereka tidak keberatan memanfaatkan produk dan jasa keuangan syariah, serta akses dan kepentingan mereka tidak dibatasi oleh ketentuan Qanun. Secara umum, administrasi bank dapat memenuhi persyaratan hukum dalam menawarkan layanan berkualitas kepada klien perbankan syariah terlepas dari latar belakang agama mereka. Seluruh unsur perikatan dipenuhi berdasarkan perspektif hukum perdata. Prinsip perbankan syariah tidak hanya menjadi nilai bersama antar umat beragama di Aceh tetapi juga tidak bertentangan dengan keyakinan, agama, dan hak nasabah non-Muslim dalam prinsip kesetaraan di hadapan hukum.

Abstract

Divorce is a matter that is always fascinating to explore within Islamic law since it affects not only legal but also social and cultural issues. Therefore, various ways are carried out by the community to suppress the divorce rate so that family resilience should be maintained. This study aims to discuss to proleptic divorce practices that occur in Aceh, community response, and the socio-capital in the form of traditional values and religious leaders in Acehnese society to realize family resilience. This is an empirical legal study employing a sociology of law methodology. Interviews and literature reviews were utilized as methods of data collection. The data demonstrated that social changes in Aceh contributed to an increase in divorce rates. The response of the community to divorce is litigation, peudame (reconciling), and non-litigation (through the court). Traditional and gampong (village) officials with cultural and legal authority, such as the keuchik(village head), tuha peut, head Jurong (neighborhood chief), and teungku imuem, are involved in the resolution of disputes. Meanwhile, divorces that cannot be handled by customary means will be moved to the Religious Courts. In the context of legal sociology theory, however, customary and cultural values as social capital in the form of support from traditional and religious leaders can help the maintenance of family resilience.
