Abstract

Melalui pendekatan kajian normatif, ditemukan bahwa pemerintah daerah mendalilkan kebijakan Refocusing anggaran berdasarkan pada ketentuan dalam Instruksi Presiden tentang Refocusing Kegiatan, Realokasi Anggaran, serta Pengadaan Barang dan Jasa Dalam Rangka Percepatan Penanganan COVID-19. Pengaturan demikian tentunya tidaklah terlalu kuat malah akan berpotensi menjadi celah terjadinya mensrea (niat jahat) bagi pelaksana kebijakan pemerintahan utamanya baik pengguna anggaran/kuasa pengguna anggaran. Hal yang seharusnya diatur dalam kebijakan penganggaran terkait kebijakan Refocusing anggaran adalah melalui diterbitkannya Peraturan Pemerintah Pengganti Undang-Undang yang menjadi dasar pengganti dalam Undang-Undang tentang Pemerintah Daerah yang selama ini merupakan dasar legalitas proses kebijakan keuangan daerah di samping juga peraturan lain.

Abstract

ABSTRACTThe corruption case involving the Regent of West Bandung in Decision No. 55/Pid.Sus-TPK/2021/PN.Bdg reveals legal loopholes in regulating corruption during the pandemic, despite being classified as an emergency corruption case under Article 2(2) of the Anti-Corruption Law. This study aims to analyze criminal liability for corruption during the COVID-19 pandemic based on Indonesian positive law and examine the legal application in Decision No. 55/Pid.Sus-TPK/2021/PN.Bdg. The research employs a normative juridical method. The findings indicate that pandemic-related corruption is eligible for the death penalty under the Anti-Corruption Law but has yet to be enforced. The court sentenced the Regent of West Bandung to five years in prison for misusing social assistance funds.Keywords: Emergency Conditions; Corruption; COVID-19 PandemicABSTRAKKasus korupsi yang melibatkan Bupati Bandung Barat dalam Putusan PN Bandung No. 55/Pid.Sus-TPK/2021/PN.Bdg menunjukkan celah hukum dalam pengaturan korupsi di masa pandemi, meskipun dapat dikategorikan sebagai korupsi dalam keadaan darurat menurut Pasal 2 ayat (2) UU Tipikor. Tujuan penelitian ini untuk menganalisis pertanggungjawaban pidana terhadap tindak pidana korupsi di masa pandemi COVID-19 berdasarkan hukum positif di Indonesia serta mengkaji penerapan dan analisis hukum terhadap Putusan PN Bandung No. 55/Pid.Sus-TPK/2021/PN.Bdg. metode penelitian yang digunakan adalah yuridis normarif. Hasil penelitian diketahui bahwa Korupsi dana pandemi COVID-19 berpotensi dikenai pidana mati sesuai UU Tipikor, namun belum diterapkan. Putusan PN Bandung No. 55/Pid.Sus-TPK/2021/PN.Bdg menjatuhkan hukuman lima tahun penjara bagi Bupati Bandung Barat atas penyalahgunaan bantuan sosial.Kata Kunci: Keadaan Darurat; Korupsi; Pandemi Covid-19

Abstract

Lelang merupakan salah satu mekanisme transaksi yang diakui secara hukum dan sering digunakan dalam berbagai konteks, seperti eksekusi hak tanggungan, pelelangan aset negara, serta barang sitaan. Namun, dalam praktiknya, pemenang lelang sering mengalami berbagai kendala hukum, seperti sengketa kepemilikan, wanprestasi dari pihak terkait, serta hambatan dalam proses administrasi peralihan hak atas objek lelang. Penelitian ini bertujuan untuk mengidentifikasi bentuk perlindungan hukum yang tersedia bagi pemenang lelang serta mengeksplorasi peran notaris dalam menjamin kepastian hukum dalam transaksi lelang. Pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif dengan menganalisis peraturan perundang-undangan yang berlaku, putusan pengadilan, serta berbagai dokumen hukum lainnya. Temuan penelitian menunjukkan bahwa meskipun pemenang lelang memiliki hak hukum atas objek yang dimenangkan, implementasi perlindungan terhadap hak tersebut masih menghadapi berbagai hambatan, seperti keberatan dari pihak sebelumnya, proses administratif yang panjang, serta kurangnya pemahaman masyarakat terhadap prosedur hukum lelang. Dalam hal ini, notaris memiliki peran yang sangat penting dalam memastikan keabsahan dokumen, menyusun akta autentik, serta memberikan jaminan kepastian hukum bagi pemenang lelang dalam memperoleh haknya. Selain itu, notaris juga berperan dalam mencegah potensi sengketa dengan melakukan verifikasi dokumen secara menyeluruh serta memberikan pemahaman hukum kepada para pihak yang terlibat dalam lelang. Oleh karena itu, diperlukan penguatan regulasi dan peningkatan peran notaris dalam sistem pelelangan guna memastikan adanya perlindungan hukum dan kepastian hak bagi pemenang lelang.

Abstract

Pemberian kredit dengan jaminan hak tanggungan lazim dilakukan dalam praktik perbankan, namun kerap menimbulkan persoalan hukum ketika objek jaminan yang telah dilelang tetap dikuasai secara fisik oleh debitur. Penelitian ini bertujuan untuk mengkaji perlindungan hukum terhadap pemenang lelang atas objek jaminan yang masih dikuasai oleh debitur berdasarkan studi kasus Putusan Nomor 509/Pdt.G/2022/PN.Smg. Metode yang digunakan adalah yuridis normatif dengan pendekatan deskriptif analitis. Hasil penelitian menunjukkan bahwa pemenang lelang memiliki hak hukum yang kuat untuk menguasai objek berdasarkan risalah lelang dan sertifikat hak milik, dan dapat menggugat debitur melalui Pasal 1365 KUHPerdata. Simpulan menunjukkan bahwa perlindungan hukum yang efektif harus mencakup aspek administratif, yuridis, dan faktual guna memastikan supremasi hukum dan kepastian hak milik dalam praktik eksekusi lelang.

Abstract. Problems often arise in the auction winner's control of the auctioned object, which is the collateral, mortgage, or other collateral. One such problem is the debtor's or third party's reluctance to leave and vacate the auctioned object. This clearly does not provide legal certainty for the guaranteed protection of the auction winner's rights. This research was conducted using normative legal research (normative legal research method). Based on the research results, it can be seen thatThe current procedure for protecting the rights of auction winners has obstacles in the form ofGuarantees for the protection of rights for auction winners in the Regulation of the Minister of Finance of the Republic of Indonesia Number 122 of 2023 (PMK 122/2023) have not been specifically regulated. The auction can only be canceled by the request of the Seller or a provisional decision or decision from a general judicial institution, as regulated in the Regulation of the Minister of Finance (PMK) Number: 93/PMK.06/2010. Many debtors are reluctant to hand over the HT collateral object for auction, resulting in obstacles in the process of clearing the auction object after the auction. Intervention by third parties who feel disadvantaged by the auction can hinder the process.Keywords: Auction; Law; Mortgage; Protection.

Abstract

The ethnic identity and religious affiliation of the Malay community in West Kalimantan form an inseparable unity, rendering this context one of the most complex mission fields in Indonesia. Contextual missiological studies addressing this community remain largely dominated by confrontational approaches that give insufficient attention to the ethno-religious identity dimension, while dialogical yet kerygmatic models of evangelism have not been systematically developed within Indonesian missiological literature. This study aims to formulate a conceptual framework for contextual evangelism by adopting the Apostle Paul's missionary strategy at the Areopagus (Acts 17) as a missiologically relevant foundation for the West Kalimantan Malay context. The research employs a qualitative method through a library research approach, drawing from three primary literature clusters: Pauline theological hermeneutics, socio-cultural ethnography of the West Kalimantan Malay community, and contemporary contextual missiology theory. Analysis was conducted through a thematic-hermeneutical approach to identify points of convergence between biblical mission strategy and local cultural realities. The findings yield a three-stage framework: (1) appreciative cultural observation to identify theological "contact points" within Malay values; (2) the utilization of local cultural narratives and symbols as contextual bridges for Gospel communication; and (3) the proclamation of Christ as the fulfillment of culture's spiritual longings without reducing or eliminating ethnic identity. This study contributes to the development of a three-stage contextual missiological model grounded in cultural hermeneutics, one that can be operationalized by mission practitioners within the context of Malay Muslim ethno-religious communities in Indonesia.

Abstract

Management Rights (HPL) are state-issued control rights, the implementation of which is partially delegated to rights holders, such as government agencies, local governments, or certain public legal entities. In Indonesia's property investment ecosystem, HPL plays a strategic role as a legal instrument that enables the private sector to utilize state assets. This legal relationship pattern is usually manifested in the form of the granting of Building Use Rights (HGB) or Use Rights over HPL land, which is based on a land use agreement between the HPL holder as the authority and the investor as the property developer. This study aims to analyze in depth the legal status of HPL following the enactment of regulatory transformation through Law Number 6 of 2023 concerning the Stipulation of the Job Creation Regulation into Law, which was then technically implemented in Government Regulation Number 18 of 2021. This legal reform brought significant changes, particularly in providing certainty over a longer and more integrated period for granting rights. However, on the other hand, this integration also requires strict synchronization between the public interest in protecting state assets and the private interest in obtaining certainty of return on investment. The research findings indicate that while the new regulatory regime offers significant opportunities for optimizing state and regional assets, the existence of HPLs still faces a number of legal and practical challenges. The primary challenge lies in the potential for dual authority in determining the annual mandatory fee rate and the mechanism for recommending rights extensions, which are often considered bureaucratic. This situation creates the risk of cost uncertainty for property investors, given that HPL holders have broad discretionary authority in determining the terms of the cooperation agreements that underlie the issuance of land rights over the HPL. In conclusion, the effectiveness of HPLs as a catalyst for property investment depends heavily on the implementation of transparency and accountability principles by the rights-holding institutions. Strengthening legal certainty for investors must be balanced with a robust oversight mechanism to prevent HPLs from becoming an obstacle to the investment climate due to unprofessional governance. This research recommends standardizing fairer land use agreement clauses and simplifying administrative procedures for rights extensions, in order to create a more competitive and sustainable property investment ecosystem in the future.
