Abstract

In business practice, the agreement is something fundamental matter aimed to protecting the rights of businesses in doing business. The implementation of business agreements it’s became disputes later taken to court to be decided by the judge to protect the rights of businesses. In practice, the judge in deciding civil cases implement the principle of seeking truth material, which is seeking the judge’s conviction, in addition to still use the principle of seeking formal truth in deciding a civil case. Results of the research is the judge assessing evidence submitted by the plaintiff turned out to have applied the principle of seeking truth material by putting the judge’s conviction, obtained by deepening the witness testimony in the trial, although formally evidence have been met and sufficient. Judge indeed should to apply the principle of truth material in order to find the formal truth in deciding a case, it is to convince the judge absolutely convinced before giving the verdict of a civil case. Abstract

This study investigates the Efficiency of Combining Compensation Claims in Criminal Cases, focusing on Decision Number 196/Pid.Sus/2021/PN. Jkt.Utr. Crime victims' rights are addressed by Law Number 8 of 1981, specifically in Articles 98 to 101 of the Code of Criminal Procedure (KUHAP), while compensation in Civil Law is governed by Article 1365 of the Civil Code. However, seeking compensation through civil law procedures can be time-consuming. A normative juridical approach was employed, utilizing statutory analysis and a case study method. Primary, secondary, and tertiary legal materials provided secondary data. The analysis, framed by justice theory and legal certainty theory, reveals that merging compensation lawsuits with criminal cases under Article 98 of the Criminal Procedure Code can expedite resolution. Prerequisites for consolidation include alignment of defendant actions with charges, resulting losses, and a request from the aggrieved party to the Judge. This study underscores the potential of combining cases to streamline compensation claims, offering implications for enhancing victims' access to justice within the legal system.

Abstract

This article analyzes the criminal law policy of diversion in the juvenile criminal justice system. The purpose of this article is to find out where diversion is regulated and analyze whether diversion meets the principles of justice for perpetrators and victims of criminal acts. The findings prove that regarding the regulation of diversion criminal law policies in the juvenile criminal justice system that there is a difference in regulation between Law Number 11 of 2012 concerning the Juvenile Criminal Justice System and Supreme Court Regulation Number 4 of 2014 concerning Guidelines for the Implementation of Diversion in the Juvenile Criminal Justice System regarding the threat of imprisonment which is a condition for the imposition of diversion on children and the age limit of children is further expanded within PERMA where children who have been married but are not yet 18 (eighteen) are still included in the category of children

Abstract

AbstrakAnak bagian anggota keluarga, kerapkali menjadi sasaran kekerasan baik itu fisik, seksual atau dimanfaatkan untuk diperkerjakan. Menjadi peminta-minta, pemulung, pekerja bangunan bahkan pekerja seksual, atau diperdagangkan, dimedia cetak/elektronik memberitakan menimbulkan reaksi dan simpati, tetapi larangan agar anak itu terlindungi tidak tersampaikan.  Jawaban atas masalah hukum yang dikaji digunakan metode Tinjauan juridis normatif mengkaji bentuk tanggungjawab negara, masyarakat, dan keluarga dalam Perlindungan Anak di Indonesia. Hasil penelitian menegaskan Upaya perlindungan anak dilaksanakan oleh negara melalui terbitnya UU No. 23 Tahun 2002 Jo. UU No. 35 Tahun 2014 tentang Perlindungan Anak, UU Sistem Peradilan Pidana Anak. Hak  anak diakui, dalam UU No 27 Tahun 2007 tentang Pemberantasan Tindak Pidana Orang, Undang-undang RI No. 1 Tahun 2000 tentang pengesahan ILO convention No. 182 concening the pro hibition and imidiate action for the elemation of the worse form of child labor (konfensi ILO No 182, masih perlu tanggungjawab negara, tanggung keluarga serta masyarakat. AbstractChildren, as part of the family, often become targets of violence, whether physical, sexual, or being exploited for labor. Becoming beggars, scavengers, construction workers, or even sex workers, or being trafficked, is reported in print/electronic media, evoking reactions and sympathy, but the prohibition to protect the child is not conveyed.  The answer to the legal issue under review uses the normative juridical review method to examine the forms of responsibility of the state, society, and family in Child Protection in Indonesia. The research results emphasize that child protection efforts are carried out by the state through the issuance of Law No. 23 of 2002 Jo. Law No. 35 of 2014 concerning Child Protection, the Child Criminal Justice System Law. Children's rights are recognized in Law No. 27 of 2007 concerning the Eradication of Human Trafficking, and the Republic of Indonesia Law No. 1 of 2000 concerning the ratification of ILO Convention No. 182 concerning the Prohibition and Immediate Action for the Elimination of the Worst Forms of Child Labor (ILO Convention No. 182). However, there is still a need for state, family, and community responsibility.

Abstract

In the Indonesian Criminal Code (KUHP), there is a concept known as a criminal elimination reason, which allows a person who commits an act that would normally be considered a crime to go unpunished. One such reason is the concept of forgiveness, which eliminates the perpetrator's guilt. This means that even though their actions are proven to violate the law, the perpetrator is not punished due to the elimination of their guilt. An example of such a concept is Forced Defense that exceeds the limit (noodweer excesses). This study focuses on the regulation of excessive forced defense (noodweer exces) according to criminal law in Indonesia, as well as the application of this concept in a specific court decision. The research method used is normative legal research, with a case approach, using various legal materials such as legislation, decisions, expert opinions, legal dictionaries, law journals, and encyclopedias. The study's findings indicate that the defendant has fulfilled all the elements of excessive forced defense (noodweer exces) as regulated in Article 49, Paragraph (2) of the Criminal Code. It was found that the defendant did not intentionally stab the victim with a knife due to being in a state of great shock at the time

Abstract

Retaliatory criminal law is a fundamental paradigm in the criminal justice system that emphasizes appropriate retribution against perpetrators of crimes. This study comprehensively examines the concept of retaliatory criminal law, its implementation in the Indonesian legal system, and its implications. Through a normative juridical approach and comparative analysis, this study reveals that although retaliatory criminal law has strong philosophical legitimacy, its implementation faces various challenges in the context of modern criminal law developments. The New Criminal Code (Law No. 1 of 2023) demonstrates a paradigm shift from pure retribution to a neoclassical approach that integrates corrective, restorative, and rehabilitative elements. This study finds that the implementation of supervisory punishment as an alternative to sentencing reflects the evolution of a more humanistic concept of retaliatory criminal law. However, technical challenges in its implementation, especially for law enforcement officials such as prosecutors, require comprehensive supporting regulations. The study's conclusions demonstrate the need to balance the goal of retribution with aspects of victim recovery and perpetrator rehabilitation to achieve more holistic justice.

Abstract

Penelitian ini bertujuan untuk mengetahui makna delik penodaan agama dalam pasal 156A KUHP dan Undang-Undang nomor 1 tahun 2023 tentang KUHP.Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan yuridis-normatif. Objek penelitian adalah pasal 156A KUHP dan UU No. 1 Tahun 2023 tentang KUHP. Metode pengolahan dan penyajian menggunakan bahan hukum primer melalui pengkajian sumber-sumber yang sudah terdokumentasikan dalam bentuk bahan- bahan hukum. Metode analisis penelitian kualitatif yaitu dengan memberikan analisis pada bahan-bahan hukum yang telah tersedia. Hasil dari penelitian ini menyatakan bahwa penerapan ketentuan Pasal 156a KUHP dalam perkara-perkara Penistaan Agama telah keluar dari jalur makna yang sesungguhnya. Hal ini menimbulkan ketidakpastian hukum dalam penegakan hukum pidana. Dengan terbitnya UU Nomor 1 Tahun 2023 tentang KUHP, yang baru diberlakukan pada 2036 mendatang, maka pemaknaan norma hukum pidana terkait tindak pidana agama atau kepercayaan harus dilakukan secara hati-hati dan sangat dibutuhkan penjelasan ahli hukum pidana secara kasuistis.
