Abstract

One of the objectives of the Basic Agrarian Law (UUPA) is to provide legal certainty for all people and enable the functioning of earth, air, and space, as well as natural wealth that aspired. However, the Basic Agrarian Law (UUPA) has not provided legal certainty over land, one of which is a plot of land with more than one certificate with the same object. The factors causing the occurrence of multiple certificates are caused by the community and the government from the National Land Agency, which does not have a valid database as referred to by Supreme Court Decision Number 976 K/PDT/2015. The formulation of the problem in this research is how efforts to prevent the occurrence of multiple certificates (overlapping) and what are the obstacles in preventing their occurrence double certificate (overlapping). This research aims to determine and analyze the prevention efforts and constraints in preventing the occurrence of double certificates (overlapping). The problems in this study were studied using a normative juridical method using a statutory approach and a conceptual approach—data collection techniques using studies bibliography and assistance and defense of legal facts. According to the research findings, efforts to prevent the occurrence of double certificates (overlapping), specifically by optimizing administration land use and creating land registration maps, so that if there are indications of the occurrence of double certificates, they can be canceled as soon as possible, as well as obstacles in preventing double certificates (Overlapping), specifically the lack of understanding and enthusiasm from the community in applying for their land in Complete Systematic Land Registration (Pendaftaran Tanah Sistematis Lengkap, PTSL), are shown.Keywords: Double certificate; legal certainty; overlapping.

Abstract

By examining the current state of customary land control and the judge's factors in granting the petition in Constitutional Court Decision Number 35/PUU-X/2012, this research seeks to identify and analyse customary land in Kampar Regency, Riau Province. This study employs a normative juridical approach, which examines the features of legal rules with a particular emphasis on the language used to describe socially occurring facts. The research findings were thoroughly examined and debated in order to shed light on the customary control situation in Kampar Regency, Riau Province, and the factors that the judge took into account when granting a request for judicial review in the 2012 Constitutional Court decision (No. 35/PUU-X). Along with the research's findings, the authors offer suggestions for future studies. Penelitian ini menggunakan pendekatan yuridis normatif, yang mengkaji ciri-ciri aturan hukum dengan penekanan khusus pada bahasa yang digunakan untuk menggambarkan fakta-fakta yang terjadi dalam masyarakat. Temuan penelitian ini dikaji dan diperdebatkan secara mendalam untuk menjelaskan situasi penguasaan adat di Kabupaten Kampar, Provinsi Riau, dan faktor-faktor yang menjadi pertimbangan hakim dalam mengabulkan permohonan uji materiil dalam putusan Mahkamah Konstitusi tahun 2012 (No. 35/PUU-X). Abstract

National Food Security in Indonesia faces threats from agricultural land conversion, especially with a projected 324.05 million population by 2045 and only 5.2 million ha of paddy fields left. Policy and community involvement are essential to curb land conversion and sustain food production. While regulations exist, their implementation remains suboptimal due to community support for land conversion to housing. This study delves into public participation's role in agricultural land conversion for food security. It employs two approaches: a statutory approach to understand regulations and a case approach to study their practical application. Data sources encompass laws, regulations, literature, and documents on Indonesian agriculture and food security. Factors driving land conversion include economic challenges like low incentives and high production costs, societal perceptions deeming farming less prestigious, a rising population, increased land values near cities, and irrigation water shortages.  To combat land conversion, the strategy advocates for active stakeholder involvement, emphasizing community participation in planning, execution, monitoring, and evaluation. This approach, backed by legal analysis, aims to effectively thwart land conversion and preserve agricultural lands. Keywords: land conversion; national food security; agriculture.

Abstract

Land disputes are a prevalent legal issue in Indonesia, often arising from conflicting ownership claims among individuals, families, or communities. Mediation has emerged as an alternative dispute resolution mechanism that offers a more efficient, expeditious, and flexible approach compared to litigation. This study aims to examine the key factors influencing the effectiveness of mediation in resolving land disputes in Plaosan Village, Wonosari District, Malang Regency, as well as the challenges faced by the disputing parties. Employing a normative juridical research method with a descriptive-analytical approach, this study integrates both primary and secondary data collection techniques. The findings highlight that the success of mediation is significantly influenced by public awareness, the competence of mediators, and the legal framework supporting mediation practices. Strengthening regulatory mechanisms and enhancing public understanding of mediation are crucial in optimizing its role as a viable solution for land disputes in rural communities.

Abstract

One of the goals of the Basic Agrarian Law (Undang-Undang Pokok Agraria, UUPA) is to provide legal certainty for all individuals and to facilitate the functioning of the earth, water, and space, as well as natural resources. In reality, however, the law has not yet provided legal certainty over land in the case of double certificates, as stated in Supreme Court Decision No. 976 K/PDT of 2015. The problem posed by this study is how and what the obstacles are for prevent the development of duplicate certificates. This is normative legal research employing secondary data, the statute approach, and the conceptual approach. To prevent the occurrence of double certificates, it is necessary to implement a computerization/digitization program for land registration maps to reduce error by humans, acquire data on land parcels that have certificates, make plotting efforts utilizing GPS (Global Positioning System) technology, restrict the land registration process and administration pertaining to village land, and implement blockchain technology in land administration. Meanwhile, the public's lack of interest in registering their land through the Comprehensive Systematic Land Registration (Pendaftaran Tanah Sistematis Lengkap, PTSL) scheme, procedural errors in the land assessment procedure, a negative land publication system in which the data presented is not necessarily valid, and the state's inability to guarantee the accuracy of the data presented are impediments to these efforts. Moreover, the present agrarian law is a colonialist relic that is not in the community's best interests.
