Abstract

This article discusses digital transformation as an effective and efficient paradigm in court services in Indonesia. The Supreme Court has used digital transformation in court administration by developing an electronic court system or e-Court since 2018. However, procedural law has no legal basis related to electronic trials. The development of online dispute resolution is very fast, while procedural principles regarding due process and neutrality must remain the court's main task. In addition, establishing Internet courts involves three fundamental legal ethical principles: restoring the ceremonial aspects of litigation and creating risk management mechanisms between the legal and technological systems. This study aims to analyze the court's efforts to create an effective and efficient trial in Indonesia. A normative legal method was employed, incorporating various approaches such as the statute, conceptual, and comparative approaches. The research results show that the digital transformation policy was incorporated into the 2010-2035 blueprint of the Supreme Court of the Republic of Indonesia, which has brought about the need to accelerate digital transformation in the justice system. Settlement of civil disputes is carried out using an electronic court (e-court) application with an electronic litigation (e-litigation) mechanism. Meanwhile, the criminal trial was conducted through teleconference media. Still, they have encountered obstacles: limited facilities and infrastructure in conducting the trial, such as internet stability in various regions and limited courtrooms with electronic trial equipment. Need to improve infrastructure and improve the quality of human resources.

Abstract

Air limbah rumah sakit adalah seluruh buangan cair yang berasal dari hasil proses seluruh kegiatan rumah sakit. Rumah sakit wajib memiliki IPAL yang terpisah antara air limbah domestik dan air limbah kegiatan usaha, hal ini diatur Pasal 18 Peraturan Daerah Kabupaten Pekalongan Nomor 5 Tahun 2014 Tentang Pengelolaan Air Limbah. Metode pendekatan penelitian ini menggunakan penelitian yuridis normatif. Metode pengumpulan data dilakukan untuk memperoleh data dalam suatu penelitian dengan metode kepustakaan (library research). Data yang diperoleh dianalisa dengan metode kualitatif. Berdasarkan hasil penelitian dan pembahasan terkait penegakan hukum dalam pengelolaan air limbah di RSUD Kraton Kabupaten Pekalongan belum sesuai Pasal 18 Peraturan Daerah Kabupaten Pekalongan Nomor 5 Tahun 2014 Tentang Pengelolaan Air Limbah yakni sudah memiliki Instalasi Pengelolaan Air Limbah (IPAL), hal ini didasarkan IPAL yang berada di RSUD Kraton masih tercampur dengan air limbah domestik dan air limbah kegiatan usaha lainnya. Faktor-faktor yang menjadi kendala 1). faktor internal yakni kurangnya SDM yang melakukan pengawasan terhadap pengelolaan air limbah. 2). faktor eksternal yakni kurangnya perhatian dan pengawasan pemerintah daerah.

Abstract

The world of today's youth cannot be separated from the internet. In addition to using the internet for learning needs, teenagers also use the internet to interact in cyberspace through social media. Although it provides many benefits, social media in cyberspace also has the potential to cause negative impacts in the form of cyberbullying, namely mental violence by a person or group of people against another person or group of people in cyberspace so that the victim feels mistreated. According to Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions (UU ITE), cyberbullying is categorized as a crime and has legal sanctions. The purpose of the science and technology activity for the community "Legal Aspects of Cyberbullying Among Adolescents in the Perspective of Law Number 19 of 2016 concerning Amendments to Law Number 11 of 2008 concerning Information and Electronic Transactions" is to provide understanding to students at the Purwokerto Muhammadiyah Women's Orphanage about cyberbullying. and its regulation in the ITE Law so that female students can use social media on the internet wisely.

Abstract

The high number of cases of violence against women and children must be a common concern. Women and children are very vulnerable to violence, therefore all parties must make a joint movement to prevent all acts of violence.Women must be literate or aware of their reproductive health rights in order to avoid various types of violence. The types of violence experienced by female victims, both adults and children, are physical, psychological, sexual, neglect, trafficking, exploitation and others.This service focuses oncounseling on women's reproductive health rights as a preventive effort so that people are able to be literate/aware of women's reproductive health rights.The number of women in Purbalingga Regency over the age of 18 who became victims of violence in 2019 was 23 cases, in 2020 there were 17 cases and in 2021 there were 3 cases. Meanwhile, the number of girls aged 0-18 years who experienced violence in 2016 was 31 cases, in 2017 there were 18 cases and in 2018 there were 23 cases.This service activity focuses on educating women's reproductive health rights as an effort to increase public knowledge, especially women so that they are able to improve women's health and lives.The method used is lecture, discussion and question and answer.Participantactively participate in discussions and ask questions about things that are not understood. The discussion process discussed issues related to women's reproductive health rights.The result of the activity is that there is an increase in knowledge about women's reproductive health rights.

Abstract

Land disputes are a prevalent legal issue in Indonesia, often arising from conflicting ownership claims among individuals, families, or communities. Mediation has emerged as an alternative dispute resolution mechanism that offers a more efficient, expeditious, and flexible approach compared to litigation. This study aims to examine the key factors influencing the effectiveness of mediation in resolving land disputes in Plaosan Village, Wonosari District, Malang Regency, as well as the challenges faced by the disputing parties. Employing a normative juridical research method with a descriptive-analytical approach, this study integrates both primary and secondary data collection techniques. The findings highlight that the success of mediation is significantly influenced by public awareness, the competence of mediators, and the legal framework supporting mediation practices. Strengthening regulatory mechanisms and enhancing public understanding of mediation are crucial in optimizing its role as a viable solution for land disputes in rural communities.

Abstract

The judiciary is a mechanism provided by the state to resolve disputes. However in practice, dispute resolution in court is not in accordance with the principles of justice, namely effective and efficient judicial institutions. This research aims to analyze the legality and development of mediation in court. The research method used is library research with secondary data sources in the form of laws and regulations, research results and literature. One of the progressive ideas of the Supreme Court of the Republic of Indonesia in order to realize effective and efficient courts, among others, is to strengthen the institution of mediation in the Court for the settlement of civil disputes. However, it seems that the efforts of the Supreme Court institutions need to be further refined through improving the quality and quantity of human resources, improving supporting infrastructure and court institutions are consistent in supporting the mediation development programs in the Court.

Abstract

One of the goals of the Basic Agrarian Law (Undang-Undang Pokok Agraria, UUPA) is to provide legal certainty for all individuals and to facilitate the functioning of the earth, water, and space, as well as natural resources. In reality, however, the law has not yet provided legal certainty over land in the case of double certificates, as stated in Supreme Court Decision No. 976 K/PDT of 2015. The problem posed by this study is how and what the obstacles are for prevent the development of duplicate certificates. This is normative legal research employing secondary data, the statute approach, and the conceptual approach. To prevent the occurrence of double certificates, it is necessary to implement a computerization/digitization program for land registration maps to reduce error by humans, acquire data on land parcels that have certificates, make plotting efforts utilizing GPS (Global Positioning System) technology, restrict the land registration process and administration pertaining to village land, and implement blockchain technology in land administration. Meanwhile, the public's lack of interest in registering their land through the Comprehensive Systematic Land Registration (Pendaftaran Tanah Sistematis Lengkap, PTSL) scheme, procedural errors in the land assessment procedure, a negative land publication system in which the data presented is not necessarily valid, and the state's inability to guarantee the accuracy of the data presented are impediments to these efforts. Moreover, the present agrarian law is a colonialist relic that is not in the community's best interests.

Abstract

Penelitian ini bertujuan untuk mengkaji pemikiran Sunaryati dalam proporsionalitas pembangunan Hukum Ekonomi Pembangunan dan Hukum Ekonomi Sosial di Indonesia. Metode penelitian menggunakan metode penelitian normative dengan pendekatan perundang-undangan dan history. Hasil dari penelitian menunjukan bahwa Sunaryati membagi hukum ekonomi menjadi dua dimensi yakni hukum ekonomi pembangunan yang berbicara pada tataran keseluruhan aspek kebijakan pembangunan hukum ekonomi nasional, sedangkan hukum ekonomi sosial adalah berbica pada tataran hasil yang dinikmati dari pembangunan untuk kesejahteraan sosial rakyat. Pada konteks terkini, kebijakan pembangunan nasional yang tertuang dalam dokumen kebijakan Rencana Pembanguanan Jangka Panjang dan Jangka Menengah Nasional belum mampu terimplementasi dengan baik yang mengindikasikan bahwa hukum ekonomi sosial belum tercapai, hal ini dapat dilihat dari tingginya angka kemiskinan, Indeks Pembanguan Manusia (IPM) yang rendah dan juga akses hak terhadap hal fundamental seperti pendidikan, Kesehatan dan pekerjaan serta perlindungan sosial yang belum merata
