Abstract

Power of human intelligence and reasoning power as God's creation that has such a great ability and accompanied with such advanced technology to create or creation something, make something that is often beyond the limits of existing rules at the level of human life itself. The result of creativity and creations that appear either truly original creation or a form can not be separated from adaptations of copyright law. Copyright laws are made with the intent to regulate and protect the rights, in fact, considered to still have the weakness, therefore this paper tries to lift the adaptations within the framework of copyright law. In this article the author uses qualitative and descriptive methods are based on secondary data. From the results have not been found the regulations or laws that specifically deal about adaptations

Abstract

Ojo Dumeh is the old philosophy that comes from Javanese language that has meaning do not being arrogant. If the value of this philosophy is implemented, it will have incredible power because old values never fade. The three main pillars of this are Ojo Dumeh, Ojo Gumunan, Ojo Kagetan; each of which has implemented power. The message is always delivered by parents to their children from childhood with the intention that their children do not become someone who are arrogant and always appreciate a friend or someone else. Research at BINUS University students are to learn about the importance of Ojo Dumeh in everyday life among students and to know more deeply about the relationship between philosophies Ojo Dumeh with changes in student behavior. The methodology of the research is exploratory, data used are primary data and secondary data obtained from the first source of BINUS University students, and the data obtained from the teaching philosophies that are books and literature. Based on the research, it can be concluded that the Ojo Dumeh philosophy needs to be implemented in the lives of students and believe that by applying this philosophy Ojo Dumeh the relationship will be better.

Abstract

Perlindungan hukum atas komersialisasi pada bidang olahraga merupakan bagian dari objek hukum kekayaan intelektual, khususnya hak cipta. Dengan ketiadaan aturan hukum hak cipta yang secara eksplisit mengatur tentang komersialisasi di bidang olahraga, boleh jadi manfaat ekonomi dari olahraga menjadi kurang optimal. Atas dasar tersebut maka tulisan ini mencoba mengkaji secara lebih dalam tentang pengaturan hak cipta dalam bidang olahraga. Metode yang digunakan dalam tulisan ini adalah yuridis normatif dengan menggunakan pendekatan perundang-undangan. Tujuan dari tulisan ini adalah memberikan gambaran tentang perlindungan hak cipta di bidang olahraga. Temuan dari tulisan adalah belum diaturnya secara eksplisit di dalam undang-undang hak cipta dalam kaitannya di bidang olahraga antara lain matchday revenue, merchandising right, dan olahraga elektronik (e-sport) yang menjadi salah satu tumpuan dalam komersialisasi di bidang olahraga

Abstract

On 27 January 2023, the Dispute Settlement Body established a panel as requested by the European Union in document WT/DS611/5, pursuant to Article 6 of the Understanding on Rules and Procedures Governing the Settlement of Disputes. In fact, the European Union has proposed the formation of a panel according to Article 6 of the Dispute Settlement Understanding (DSU) to respond to the Action against China's lawsuit against high technology in the European Union. China imposed a preservation measure, Anti-Suit Injunction (ASI), that prohibit patent holder for asserting their rights before non-Chinese courts. Such movement is inconsistent to international principles, namely National Treatment (NT) and Most-Favored-Nation (MFN). As the EU claimed China on the subject of patent use on high technology, this discussion will further dissect the WTO Agreement on the Trade-Related Aspects of Intellectual Property Rights (TRIPS). Specifically, Article 3 on National Treatment and Article 4 on Most-Favored-Nation Treatment. The issuance of ASI itself is not listed under Appendix 1 of the DSU that regulates laws that are applicable and recognized as WTO norms under a WTO panel. The WTO panel has never adjudicated any cases relating to the issuance of ASI. This questions whether a WTO norm will be formed before the WTO panel and whether or not China has violated the principles of the WTO and the TRIPS Agreement.
