Abstract

The purpose of writing this journal is to find out what women's rights are, and what companies should provide to fulfill the rights of women workers, and besides that to find out how the role of Law Number 2 of 2004 concerning industrial dispute resolution in resolving disputes over women's rights carried out by companies through the mechanism contained in Law Number 2 of 2004, specifically by way of Bipatrit settlement. The writing method used is the normative juridical method (statute approach) because in this writing it examines several statutory regulations, especially the law regarding the settlement of industrial relations disputes. then the approach taken is a statutory approach. Based on the results of the presentation of the material that has been written, it can be seen that the fulfillment of the rights of women workers has not been fully fulfilled, there are still many companies that do something about fulfilling the rights of women workers, it is not uncommon for women to even take leave on the first day and secondly when menstruation is subject to wage deductions, this is contrary to the Labor Law, in the case of not fulfilling the rights of female workers, female workers can sue the company to ask for their rights to be fulfilled, an easy settlement is done first before going further can be done by bipatrit, in this way women workers can claim to get their rights as explained in the Manpower Act.

Abstract

Karawang Regency, which is currently the largest industrial city in Indonesia, has the possibility of a large risk of environmental pollution or damage. This can happen because of business activities that are not in accordance with the company's operational standards and also the Laws and Regulations. For this reason, this writing discusses the role of the Karawang Regency Government in overcoming and preventing violations of environmental protection due to company activities. And the form of social responsibility of PT Pindo Deli Pulp and Paper Mills II based on Regional Regulation of Karawang Regency No. 14 of 2012. This article uses a normative juridical research method with a statue approach and a case approach, in which the data collection technique uses a literature study derived from primary legal materials and secondary legal materials. The results of this study are that the Karawang Regency Government has the authority to supervise the implementation of environmental protection and management, which is based on Karawang Regency Regional Regulation Number 14 of 2012 concerning Environmental Protection and Management. In carrying out the supervision of environmental protection and management, the Government of Karawang Regency formed an Environmental Protection Agency (EPA) and also a Regional Environmental Monitoring Officer which was formed to facilitate the bureaucratic system in overseeing the implementation of environmental protection and management. And companies that violate the protection and management of the environment are absolutely responsible for the losses they cause.

Abstract

Indonesia merupakan negara hukum dan bukan negara kekuasaan, hal ini termuat dalam konstitusi negara Undang-undang Dasar 1945 Pasal 1 ayat (3). Dalam sebuah negara hukum, lembaga peradilan menjadi sangat penting karena dalam sejarah, selalu ada pihak-pihak baik penyelenggaraan negara atau pemerintahan maupun rakyat yang melanggar ketentuan hukum. Dengan berlakunya Undang-Undang Nomor 14 Tahun 2002 tentang Pengadilan Pajak maka penyelesaian sengketa pajak dapat dilakukan melalui Pengadilan Pajak. Dengan urgensi pada penelitian yang dilakukan ini, bahwa bagaimana kedudukan Badan Pengadilan Pajak menurut Undang-Undang Nomor 14 Tahun 2002 tentang Pengadilan Pajak dalam Peradilan di Indonesia dan apakah yang menjadi kelemahan peradilan pajak sehingga dapat terjadi timbulnya penyimpangan. Dengan menggunakan jenis penelitian pada penulisan ini ialah metode penelitian hukum normatif empiris ini pada dasarnya merupakan penggabungan antara pendekatan hukum normatif dengan adanya penambahan berbagai unsur empiris. Hasil dari penelitian ini adalah Pengadilan Pajak merupakan pengadilan khusus bagian dari Peradilan Tata Usaha Negara (PTUN), dan sebagai pengadilan yang bersifat khusus sudah selayaknya memiliki hukum acara tersendiri. Kemudian kelemahan akan penyimpangannya terdapat dalam pengadilan pajak harus ditata ulang, baik secara hukum, administrasi, organisasi dan finansialnya.

Abstract

The existence of local political parties in Indonesia is a tangible form of the existence of special autonomy in a certain area. The specificity of a certain area is regulated in the 1945 Constitution Article 18B paragraph (1). In addition, the formation of local political parties is one of the human rights in the political field, as stated in Article 28E paragraph (3) of the 1945 Constitution. The research method uses a normative juridical approach with secondary data and analyzed descriptively qualitatively. Based on research, Papua Province has the right to form political parties (see Article 28 paragraph (1) of the Papua Province Special Autonomy Law). However, the phrase "political party" is considered to have multiple interpretations, thus creating legal uncertainty. Through the decision of the Constitutional Court Number 41/PUU-XVII/2019, the legal uncertainty can be guaranteed by the Constitutional Court Decision. In the future, by looking at the background and real needs of the Papua Province, it is possible to form a Local Political Party in the Papua Province, considering the condition of the Papua Province as a special autonomous region.Partai politik lokal di Indonesia merupakan wujud nyata adanya otonomi khusus di suatu daerah. Kekhususan suatu daerah diatur dalam UUD 1945 Pasal 18B ayat (1). Selain itu, pembentukan partai politik lokal merupakan salah satu hak asasi manusia di bidang politik, sebagaimana tercantum dalam Pasal 28E ayat (3) UUD 1945. Metode penelitian menggunakan pendekatan yuridis normatif dengan data sekunder dan dianalisis secara deskriptif kualitatif. Berdasarkan penelitian, Provinsi Papua berhak membentuk partai politik (lihat Pasal 28 ayat (1) UU Otsus Provinsi Papua). Namun, ungkapan “partai politik” dianggap memiliki multitafsir sehingga menimbulkan ketidakpastian hukum. Melalui putusan MK Nomor 41/PUU-XVII/2019, ketidakpastian hukum dapat dijamin oleh Putusan MK tersebut. Ke depan, dengan melihat latar belakang dan kebutuhan riil Provinsi Papua, dimung­kinkan dibentuknya Partai Politik Lokal di Provinsi Papua, mengingat kondisi Provinsi Papua sebagai daerah otonomi khusus.

Abstract

The integrity of Indonesia’s democratic elections depends on the impartial enforcement of electoral laws and the protection of citizens’ political rights. The Election Supervisory Board (Bawaslu), although not explicitly established in the Constitution, serves as a key institution mandated by statutory law to oversee electoral neutrality and protect the fairness of electoral processes. Its supervisory mandate intersects with broader constitutional principles and human rights norms, particularly in addressing violations of political neutrality by state officials and safeguarding the right to political participation. This study aims to critically analyze the extent to which Bawaslu incorporates constitutional oversight and human rights considerations into its supervisory practices and how these frameworks influence its effectiveness. Using a normative legal research method with statutory, conceptual, and comparative approaches, the study evaluates national legal instruments, Bawaslu regulations, and selected case studies. Findings indicate that Bawaslu’s oversight capacity is constrained by gaps in legal clarity, inconsistent inter-institutional coordination, and the absence of explicit constitutional grounding for its human rights obligations. Strengthening its institutional independence, refining the legal framework, and aligning domestic electoral oversight with international human rights standards are crucial steps for enhancing both electoral integrity and political neutrality. Beyond the Indonesian context, this study contributes to the global discourse on the role of non-constitutional electoral oversight bodies in consolidating democratic governance, offering comparative insights relevant to emerging democracies worldwide.
