Abstract

The purpose of this research is to understand the implementation of agricultural profit-sharing conducted by the customary law community in Pijorkoling Village, Dolok District, North Padang Lawas Regency, and to determine the compliance of agricultural land profit-sharing implementation with Law No. 2 of 1960. The research method used is a sociological juridical approach, with descriptive-analytical specifications, and purposive non-random sampling for sample determination. The analysis was conducted qualitatively to address the research problem. The research findings indicate that the implementation of the profit-sharing agreement for agricultural land in Pijorkoling Village, Dolok District, North Padang Lawas Regency does not use the profit-sharing agreement according to Law No. 2 of 1960 concerning profit-sharing agreements for agricultural land. Instead, they conduct profit-sharing agreements based on customary law that has been passed down through generations, which are agreements based on the approval and agreement between the landowner and the prospective cultivator, conducted verbally on the basis of trust. Regarding rights and obligations as well as the balance of profit-sharing, it is also based on the agreement of both parties. The profit-sharing ratio from the research is referred to as "mertelu" or 1:3, one part for the landowner and two parts for the cultivator from the total net harvest. Then, the termination or dissolution of the working relationship between both parties occurs when the agreed-upon period ends at the end of the harvest season, or it can also be the termination of the agreement due to one party breaching the initial agreement.

Abstract

Salah satu masalah yang muncul di tengah-tengah masyarakat adalah terjadinya perselisihan dalam pembagian warisan antar keluarga, bagian anak angkat, poligami, bagian anak bayi tabung, surat keterangan membuat warisan, bahagian keluarga yang mengurus harta dalam jangka waktu yang lama. Solusi yang ditawarkan, memberikan bimbingan kepada masyarakat pembagian waris menurut Islam di Lingkungan 1 Kelurahan Padangmatinggi Lestari, Kec. Padangsidimpuan Selatan Kota Padangsidimpuan. Dalam hukum waris telah ditentukan siapa-siapa yang menjadi ahli waris, dan siapa-siapa yang berhak mendapatkan bagian harta warisan tersebut, berapa bagian mereka masing-masing, bagaimana ketentuan pembagiannya, serta diatur pula berbagai hal yang berhubungan dengan soal pembagian harta warisan. Bimbingan waris Islam ini memproleh hasil, 1. Peningkatan Pemahaman terhadap konsep dasar waris Islam. 2. Kesadaran hokum mayoritas peserta menyatakan kesadaran pentingnya menyelesaikan pembagian waris secepatnya sesuai syariat, agar tidak menimbulkan konflik di masa depan.3. Permintaan konsultasi lanjutan terjadi peningkatan minat masyarakat untuk berkonsultasi secara privat tentang kasus waris di keluarga masing-masing.4. Pembentukan ruang diskusi waris Islam sebagai tindak lanjut, dibentuk ruang diskusi edukasi waris Islam lingkungan 1 yang akan difasilitasi oleh tokoh agama dan pendamping dari tim pengabdi

Abstract

One of the problems that arises in society is the occurrence of disputes in the distribution of inheritance between families, the share of adopted children, polygamy, the share of IVF children, certificates of making inheritances, the part of the family that manages assets for a long period of time. The solution offered provides guidance to the community regarding the distribution of inheritance according to Islam in Environment 1, Padangmatinggi Lestari Village, District. South Padangsidimpuan Padangsidimpuan City. In inheritance law, it is determined who is the heir, and who is entitled to a share of the inherited assets, how much each of them will share, what the distribution provisions are, and various matters related to the distribution of inherited assets are also regulated. This Islamic inheritance guidance has produced results, 1. Increased understanding of the basic concept of Islamic inheritance. 2. Legal awareness. The majority of participants expressed awareness of the importance of completing the division of inheritance as quickly as possible according to the Shari'a, so as not to cause conflict in the future. 3. Requests for further consultations have increased public interest in private consultations regarding inheritance cases in their respective families. 4. Establishment of an Islamic inheritance forum as a follow-up, an Islamic inheritance education forum for Environment 1 will be formed which will be facilitated by religious figures and assistants from the service team.
