Abstract

The insolvency of the debtor has legal consequences on the rights and obligations of the parties involved, including the collateral guarantor. Collateral guarantors have the responsibility to fulfil debt payment obligations if the main debtor is unable to pay off his obligations. This study aims to analyse the obligations of collateral guarantors in cases of debtor bankruptcy based on bankruptcy law in Indonesia. The research method used is normative juridical with a statutory and case approach. The results showed that collateral guarantors still have an obligation to fulfil debt payments even though the main debtor is declared bankrupt, unless there is an agreement that regulates otherwise. In addition, in practice, there are problems related to the execution of collateral and legal protection for guarantors in the bankruptcy system. Therefore, there is a need for legal certainty and a clearer protection mechanism for collateral guarantors in order to create a balance between the interests of creditors and guarantors. This research will discuss how bankruptcy law in Indonesia regulates the obligations of collateral guarantors in the event that the debtor experiences bankruptcy. This research will also analyse the problems that often arise in practice, and provide recommendations to clarify the legal protection mechanism for collateral guarantors.

Abstract

The Merdeka Belajar policy in the Indonesian education system aims to create an education process that is more flexible, innovative, and oriented to student needs. These principles are in line with John Dewey's philosophy of progressivism, which emphasizes direct experience, active student involvement, and the relevance of education to real life. This study aims to analyze the alignment between John Dewey's principle of progressivism and Merdeka Belajar policy in Indonesia. Using the literature study method, it was found that Merdeka Belajar has adopted elements of progressivism, such as experiential learning and the role of the teacher as a facilitator. However, its implications face challenges such as teacher readiness and uneven infrastructure. In conclusion, the implementation of Merdeka Belajar needs to be strengthened through a holistic approach involving various stakeholders to realize relevant, inclusive, and progressive education in accordance with John Dewey's thinking.ABSTRAKKebijakan Merdeka Belajar dalam sistem pendidikan Indonesia bertujuan untuk menciptakan proses Pendidikan yang lebih fleksibel, inovatif, dan berorientasi pada kebutuhan siswa. Prinsip-prinsip ini sejalan dengan filsafat progresivisme John Dewey, yang menekankan pengalaman langsung, keterlibatan aktif siswa, serta relevansi pendidikan dengan kehidupan nyata. Penelitian ini bertujuan menganalisis keselarasan antara prinsip progresivisme John Dewey dan kebijakan Merdeka Belajar di Indonesia. Dengan metode studi literatur, ditemukan bahwa Merdeka Belajar telah mengadopsi unsur progresivisme, seperti pembelajaran berbasis pengalaman dan peran guru sebagai fasilitator. Namun, implikasinya menghadapi tantangan seperti kesiapan guru dan infrastruktur yang belum merata. Kesimpulannya, implementasi Merdeka Belajar perlu diperkuat melalui pendekatan holistik yang melibatkan berbagai pemangku kepentingan guna mewujudkan pendidikan yang relevan, inklusif, dan progresif sesuai dengan pemikiran John Dewey.

Abstract

The people of Taddan Village, located in Camplong District, Sampang Regency, recognize zakat fitrah as a religious obligation for Muslims, as it constitutes the third pillar of Islam. However, their comprehensive understanding of zakat fitrah remains limited. The tradition of distributing zakat fitrah to Kyai represents a form of implementation that has been passed down through generations and continues to be preserved in Taddan Village. This study aims to examine the underlying factors behind this tradition, to describe the distribution process, and to assess its role in shaping the community’s social, cultural, and religious life. This research employs a qualitative approach with a descriptive design, focusing on social facts, cultural practices, events, and lived experiences. The findings reveal that the tradition originated from the habit of the Taddan Village community, who gave zakat fitrah to the Islamic boarding schools where their children studied, as an expression of gratitude and respect. Over time, this practice became deeply rooted and evolved into a hereditary tradition. However, when the distribution of zakat fitrah becomes overly centered on Kyai, there is a risk that the poor, who are more in need—receive less benefit. This indicates that the community tends to prioritize fulfilling religious obligations as a form of obedience, without adequately considering the social dimensions, particularly the fairness of distribution and the productive use of zakat fitrah.

Abstract

The study was conducted to see whether or not there was a significant improvement in reading narrative comprehension achievement between the students who were taught by using Story Mapping and those who were taught by Guided Reading, to know what the students’ reading motivation, and to know whether or not reading motivation significantly contributed to reading narrative comprehension achievement of tenth grader of SMAN 1 Kotapadang Bengkulu. The experimental research with non-equivalent control design was applied in this study. The population was the tenth graders of SMAN 1 Kotapadang and sixty students were selected as the sample purposefully; they were equally grouped into experimental and control ones. To collect the data, Reading Comprehension Test and Motivation Reading Questionnaire (MRQ) were used. The results showed that there was significant improvement in reading narrative comprehension achievement of the students who were taught by Story Mapping, students’ reading motivation was high, and reading motivation was significantly contributed to reading narrative comprehension achievement of tenth graders of SMAN 1 Kotapadang.
