Abstract

Latar belakang: Peradilan pidana dalam KUHAP dibagi menjadi tiga tahap, yaitu pra-Ajudikasi, Ajudikasi, dan pasca-Ajudikasi. Dalam kaitannya dengan tugas penegakan hukum, Kepolisian diberikan wewenang oleh undang-undang melakukan penyelidikan dan penyidikan, yang mana merupakan bagian dari tahap pra ajudikasi dalam peradilan pidana. Tahap ini merupakan permulaan dari serangkaian proses acara pidana, tujuan dari tahap ini untuk mendapatkan Berita Acara Pemeriksaan (BAP). Tujuan Penulisan: tujuan artikel ini adalah untuk mengetahui tentang kewenangan penghentian penyidikan dalam perkara dengan pelaku gangguan kejiwaan Metode Penulisan: Tulisan ini menggunakan metode penelitian hukum normatif karena fokus kajian berangkat dari kekaburan norma, dengan menggunakan pendekatan statute approach, conceptual approach serta analytical approach. Teknik penelusuran bahan hukum menggunakan Teknik studi dokumen serta analissi kajian menggunakan analisis kualitatif. Hasil/Temuan Penulisan : Berdasarkan pada Pasal 109 ayat (1) KUHAP, maka seorang penyidik yang telah memulai melaksanakan penyidikan terhadap peristiwa tindak pidana, penyidik harus sesegera mungkin untuk memberitahukan telah mulai penyidikan kepada Penuntut Umum. Untuk mencegah penyidikan yang berlarut-larut tanpa adanya suatu penyelesaian, seorang penyidik kepada Penuntut Umum, sementara di pihak Penuntut Umum berwenang minta penjelasan kepada penyidik mengenai perkembangan penyidikan yang dilakukan oleh penyidik. Apabila dalam hal penghentian penyidikan karena tidak terdapat cukup bukti atau peristiwa tersebut ternyata bukan merupakan tindak pidana atau penyidikan dihentikan demi hukum, maka penyidik wajib mengeluarkan SP3 (Surat Penghentian Penyidikan) yang mana tembusan surat tersebut dismpaikan kepada Penuntut Umum, tersangka dan keluarganya (Pasal 109 ayat (2) KUHAP).

Abstract

Introduction: Difference or disparity in sentencing is one of the important topics in criminal law. The disparity in sentencing means that there are differences in the amount of punishment handed down by the court in cases that have the same characteristics.Purposes of the Research: The purpose of this study is to find out why there is a disparity in criminal penalties in court verdicts in cases of corruption in the misuse of village funds in Maluku.Methods of the Research: This study uses a normative juridical method.Results of the Research: Based on the results of the study, essentially the disparity in imposing criminal penalties in court verdicts on corruption cases of misuse of village funds is due to strafmaat (criminal threats) for different perpetrators.

Abstract

Introduction:Protection for victims of criminal acts can be interpreted as protection to obtain guarantees or legal compensation for the suffering or losses of victims of criminal acts so that they are paid more attention to by the State, one of which is the victims of rape crimes because victims are entitled to compensation provided by the State.Purposes of the Research:This study aims to review and discuss the Mechanism for Providing Compensation to children victims of the Rape Crime and the reasons for the judge so that in his decision compensation for children is handed over to the State treasury.Methods of the Research:The type of research used in this writing is nomative juridical. The problem approach used is the Statutory approach, the conceptual approach and the case approach. Legal materials used primary legal materials and secondary legal materials. The technique of collecting legal materials is carried out by means of literature studies. The management and analysis of materials is analyzed qualitatively.Results of the Research:Based on the results of the study, the compensation mechanism is regulated in Government Regulation No. 44 of 2008 concerning the Provision of Compensation, Restitution, and Legal Assistance to Witnesses and Victims. Compensation must be filed prior to a court decision that does not yet have permanent legal force. The Witness and Victim Protection Agency (LPSK) may apply for compensation to the public prosecutor to be included in criminal prosecutions because the compensation application must be submitted by the victim or the victim's family or their attorneys through the Witness and Victim Protection Agency (LPSK). The judge in his ruling so that the compensation of the child as a victim of the crime of rape is handed over to the State treasury because the child as a victim of a criminal act does not apply for compensation through the Witness and Victim Protection Agency to the Public Prosecutor and proceed to the Court so that in the judgment the rights of the child victim of the rape crime is handed over to the treasury.

Abstract

Femicide is the taking of the life of a woman or girl because she is a woman or because of gender-based violence. The type of femicide that is often found in the field is intimate femicide, which is committed by people who have a relationship with the victim. Indonesia has various laws and regulations that regulate the protection of women and girls, including the Human Rights Law, the Child Protection Law, the Domestic Violence Law, and the TPKS Law, but the specific regulation of femicide has not been explicitly described in these various laws and regulations. This research uses a normative juridical method, which is legal research that places the law as a building system of norms that are studied through principles, norms, rules of laws and regulations, agreements, and doctrine. Based on the results of the discussion, it is found that there are 7 types of femicide that occur in the society, including the Indonesian society. the regulation of femicide has not been explicitly regulated in the Human Rights Law or in the TPKS Law. The Human Rights Law regulates the protection of human rights including women's rights in Article 45. Meanwhile, the TPKS Law further regulates the types of femicide that occur in Indonesia such as gender-based sexual violence, pornography, dating and domestic violence.
