Abstract

ABSTRACT: Diversion is the transfer of resolution of children's cases from the criminal justice process to a process outside criminal justice. Diversion is carried out at three levels, namely at the investigation, prosecution and court levels. In this case, if the diversion deliberation process is successful, the case will not proceed to the next stage, but if diversion deliberations fail to be carried out at the investigation level, the next effort is to conduct diversion deliberations at the prosecution level. If there is no common ground at the prosecution level, then diversion will be attempted at the court level. The aim of this research is to find out whether the diversion process in this research has fulfilled the principle of legal certainty or not and to find out what factors cause the success of diversion in court. Based on the results of this research, it was concluded that it does not fulfill the principle of legal certainty, because children who make mistakes are not given a deterrent effect by being sentenced to 15 years in prison as regulated in article 81 paragraph (1) and/or paragraph (2) Jo. Article 76D of Law number 35 of 2014 is an amendment to Law 23 of 2002 concerning child protection and the factors causing the success of diversion in court, namely consideration of the customs of Supreme Court Regulation No. 4 of 2014 Article 3.

Abstract

This study examines the Supreme Court's decision in the premeditated murder case involving Ferdy Sambo, focusing on the reduction of the sentence from the death penalty to life imprisonment. The research aims to identify non-legal factors influencing the verdict, analyze its implications for Indonesia's criminal law paradigm, and evaluate public responses following the cassation decision. A descriptive-analytical approach was employed, utilizing legal document analysis and the post-positivist paradigm as the theoretical framework. The study interprets judicial considerations within a dynamic legal context, integrating legal norms with reflective interpretations. The findings reveal that the sentencing change reflects a shift in Indonesia's criminal law paradigm from retributive to rehabilitative, as adopted in the new Penal Code. The defendant's remorse was a key factor in the sentencing reduction. However, public response to the cassation decision indicated a decline in public trust and engagement with the judiciary, evidenced by reduced public discourse compared to the case's initial stages. The shift from retributive to rehabilitative justice served as the basis for the cassation decision. This study highlights challenges in strengthening public trust in the judicial system, emphasizing the need for greater transparency and accountability in legal decision-making processes.

Abstract

Introduction: Difference or disparity in sentencing is one of the important topics in criminal law. The disparity in sentencing means that there are differences in the amount of punishment handed down by the court in cases that have the same characteristics.Purposes of the Research: The purpose of this study is to find out why there is a disparity in criminal penalties in court verdicts in cases of corruption in the misuse of village funds in Maluku.Methods of the Research: This study uses a normative juridical method.Results of the Research: Based on the results of the study, essentially the disparity in imposing criminal penalties in court verdicts on corruption cases of misuse of village funds is due to strafmaat (criminal threats) for different perpetrators.

Abstract

The condition of sectoral regulation in Indonesia has been obese, the problem of obese sectoral regulation will have an impact on the death of economic growth and development. The number of overlapping sectoral regulations needs serious attention from the government, by applying the concept of the omnibus law the condition of obesity regulation can be cured, the choice of the concept of the omnibus law can be done through legal codification, both on the law and various implementing regulations at the central level, so for a the field of law can be recorded in one integrated and integrated text. With the concept of the omnibus law, which rearranges sectoral regulations that overlap in one law in a comprehensive, comprehensive and simple manner. This study tries to see from the perspective of state administration law in the framework of clarifying the conditions of obesity in sectoral regulations in Indonesia, this study uses a normative juridical method, by analyzing secondary data in the form of laws and libraries related to sectoral regulations. The results of this study indicate that the sectoral regulatory conditions in Indonesia are obese and need to be addressed by applying the concept of the omnibus law

Abstract

Introduction: Corruption of village funds is still an astonishing phenomenon in the midst of the implementation of village government. It is even recorded that villages are one of the largest contributors to corruption cases in Indonesia today.Purposes of The Devotion: This service aims to provide education to the community, how important it is to prevent potential corruption of village funds and how to involve community participation in prevention. Method of The Devotion: This activity was carried out in the form of legal counseling in Waipirit Village, Kairatu District, West Seram through a panel discussion where the presenters delivered material in turn and then continued with questions and answers between the presenters and the community.Results Main Findings of the Devotion: Based on the legal counseling activities carried out, one of which is a discussion, it shows that many participants, especially from the community, initially consider corruption in the management of village funds as a trivial problem. However, after participating in the discussion, they became more aware of the negative impact of corruption and the serious legal consequences for the perpetrators.

Abstract

The crime of obscenity is a form of crime that has a serious impact on the victim, both physically, psychologically and socially. Juridical studies of criminal acts of sexual immorality are important to understand how Indonesian law regulates, protects and provides sanctions against perpetrators of these crimes. In the context of Indonesian criminal law, sexual abuse is regulated in the Criminal Code (KUHP) and special regulations such as the Child Protection Law. This article examines the elements of criminal acts of obscenity, the law enforcement process, and the obstacles faced by law enforcement officials in handling obscenity cases. Apart from that, efforts to protect victims and the role of the community in preventing this criminal act were also discussed. This study concludes with recommendations for improving regulations and more effective implementation of the law to provide justice for victims and prevent the recurrence of similar crimes. To find out the views of individualization theory, the views of individualization theory on criminal acts of sexual abuse and legal protection for children who are victims of family abuse. The research method in this research is normative juridical. The problem approaches used are the statutory approach, conceptual approach and case approach. From the results of this research, it can be concluded that sexual immorality is a crime which in Indonesian laws and regulations, if the elements of a criminal act of sexual immorality are met, criminal sanctions must be applied in accordance with the provisions of the applicable laws and regulations, namely Article 289 and supported by Law Number 23 of the Year. 2002 concerning Child Protection as a specialist leg of the Criminal Code. Meanwhile, legal protection for children who are victims of criminal acts of sexual abuse in accordance with statutory regulations stipulates the obligation to carry out rehabilitation efforts, namely in Article 6 of Law Number 31 of 2014 concerning Protection of Witnesses and Victims, as well as Article 69A of Law Number 35 of 2014. 2014 concerning Child Protection.

Abstract

Introduction: The laws and regulations in force in Indonesia have given the BPK the authority to determine and determine state losses which are the basis for investigating corruption by investigating agencies, both the Prosecutor's Office and the Police. Purposes of the Research: To examine the authority of state institutions in determining losses as the basis for investigating corruption crimes. Methods of the Research: The type of research used in this paper is normative juridical research, which is also called doctrinal research. Results Originality of the Research: The results of the study indicate that the Government Internal Supervision apparatus including BPKP according to the legislation does not have the authority to determine state financial losses as the basis for investigations by investigating agencies in corruption. The results of the determination of state losses carried out by the Government Supervision Apparatus in this case the BPKP are often used as the basis for investigating criminal acts of corruption. This will raise the question of the validity of government actions carried out by the investigative apparatus, both the Prosecutor's Office and the Police in the investigation of criminal acts of corruption

Abstract

Pengakuan terhadap hak keperdataan anak luar kawin dalam sistem hukum Indonesia mengalami perkembangan signifikan sejak Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010. Namun, pengakuan konstitusional tersebut belum diiringi dengan pembaruan regulasi teknis yang memadai, sehingga pelaksanaan hak-hak tersebut masih menemui banyak hambatan di tingkat praktik. Ketidakhadiran mekanisme administratif yang menjamin pencatatan hubungan ayah-anak berbasis bukti biologis menciptakan ketimpangan struktural yang merugikan anak dan ibu, serta membuka ruang bagi penyangkalan tanggung jawab oleh pihak ayah biologis. Artikel ini mengkaji gap hukum dalam perlindungan anak luar kawin, dengan menyoroti lemahnya harmonisasi antarperaturan perundang-undangan, ketimpangan beban pembuktian, dan ketiadaan pendekatan yuridis yang progresif dan berorientasi pada keadilan substantif. Melalui pendekatan normatif dan studi kasus kontemporer, penulis menunjukkan bahwa perlindungan hukum terhadap anak luar kawin di Indonesia masih bersifat simbolik dan belum menyentuh kebutuhan nyata. Artikel ini mengusulkan reformasi hukum yang berpijak pada prinsip hukum progresif dan kepentingan terbaik anak, termasuk pembentukan kelembagaan lintas sektor yang terintegrasi. Gagasan ini diharapkan dapat mendorong penyusunan kebijakan afirmatif yang lebih inklusif dan responsif terhadap realitas sosial anak luar kawin sebagai subjek hukum yang otonom dan setara.
