Abstract

Abstrak This study examines the importance of halal certification for micro, small, and medium enterprises (MSMEs/UMKM) in Indonesia as mandated by Article 4 of the Halal Product Assurance Law (UUJPH), which requires all products circulating in the country to be halal-certified. Despite government efforts through regulations, online registration, and free certification programs such as SEHATI, many UMKM products remain uncertified or use non-legal halal labels, leaving consumers without legal protection and certainty. Using normative legal research with a qualitative approach based on secondary data, this study finds that halal certification is crucial for UMKM products as it increases sales, expands market access, strengthens competitiveness in national and international markets, supports community economic growth, and ensures legal protection for Muslim consumers’ rights.

Abstract

Perjanjian keanggotaan dalam sistem Multi Level Marketing merupakan dasar terbentuknya hubungan hukum antara perusahaan dan distributor yang melahirkan hak serta kewajiban bagi para pihak. Penelitian ini bertujuan menganalisis konstruksi dan keabsahan perjanjian keanggotaan distributor PT Avail Elok Indonesia berdasarkan Pasal 1320 Kitab Undang-Undang Hukum Perdata. Penelitian menggunakan metode hukum normatif dengan pendekatan perundang-undangan dan pendekatan konseptual. Bahan hukum yang digunakan terdiri atas peraturan perundang-undangan, Formulir Permohonan Anggota Baru, dokumen Peraturan & Prosedur PT Avail Elok Indonesia, buku, jurnal ilmiah, dan hasil penelitian terdahulu. Pengumpulan bahan hukum dilakukan melalui studi kepustakaan dan studi dokumen, kemudian dianalisis secara kualitatif menggunakan interpretasi gramatikal, sistematis, dan teleologis. Hasil penelitian menunjukkan bahwa hubungan antara PT Avail Elok Indonesia dan distributor dibentuk melalui perjanjian baku yang memuat identitas calon distributor, data sponsor dan upline, pernyataan persetujuan, masa keanggotaan, biaya pendaftaran, kewajiban pembelian, tanggung jawab, larangan, dan pembatasan aktivitas distributor. Distributor ditempatkan sebagai pihak mandiri dalam hubungan kedistributoran atau kemitraan pemasaran, tetapi tetap tunduk pada kode etik, program pemasaran, dan kebijakan perusahaan. Secara formal, perjanjian tersebut telah memenuhi unsur kesepakatan, kecakapan, objek tertentu, dan causa yang halal sebagaimana diatur dalam Pasal 1320 KUHPerdata. Keabsahan secara substansial tetap bergantung pada transparansi klausul, pemahaman distributor, kejelasan produk, struktur komisi, kewajaran kewajiban pembelian, serta sumber utama keuntungan. Perjanjian dapat dinilai sah dan mengikat apabila kegiatan usaha bertumpu pada penjualan produk nyata dan sistem komisi yang transparan. Sebaliknya, apabila keuntungan lebih dominan berasal dari perekrutan anggota atau kewajiban pembelian yang tidak wajar, unsur objek tertentu dan causa yang halal dapat dipersoalkan.

Abstract

The enhancement of judicial welfare represents a pivotal aspect in the attainment of a just and respectable legal system. A financially secure judiciary will be better positioned to fulfill its obligations in an impartial and ethical manner, eschewing the allure of corruption. The objective of this research is to examine the necessity of enhancing the welfare of judges in the context of a fair and dignified judiciary. The research method employed is a normative research method with a statute approach, which was analyzed using content analysis. The findings of this study indicate the necessity for action to improve the welfare of judges, including the implementation of salary and allowance increases, the provision of adequate facilities and infrastructure, and the establishment of legal protection for judges in the performance of their duties. Furthermore, it is imperative to consider the necessity of rigorous oversight of judges' ethical conduct and the provision of incentives for exemplary performance. The improvement of judges' welfare is expected to facilitate the creation of a conducive working environment for fair and dignified law enforcement. This will reinforce public trust in the judicial system, guarantee the protection of people's rights, and maintain the integrity and dignity of the judiciary in carrying out its function as the upholder of justice. This research will address the urgency of improving judges' welfare in order to realize a fair and dignified judiciary.

Abstract

The development of information technology has changed the pattern of conventional trade transactions into electronic transactions through e-commerce platforms . This study aims to analyze consumer legal protection in buying and selling transactions through e-commerce platforms , the validity of electronic contracts, and legal remedies for dispute resolution available in Indonesia. The research method used is normative legal research with a statute approach , a case approach , and a theoretical approach . Secondary data was obtained through a literature study of relevant laws and regulations, legal literature, and court decisions. The results of the study indicate that the validity of electronic contracts in Indonesia has been regulated in Law Number 11 of 2008 concerning Information and Electronic Transactions as amended by Law Number 19 of 2016, which provides legal recognition for electronic signatures and electronic documents. Consumer protection in e-commerce transactions is guaranteed through Law Number 8 of 1999 concerning Consumer Protection and Government Regulation Number 80 of 2019 concerning Trading Through Electronic Systems. Legal dispute resolution can be pursued through litigation and non-litigation channels, including mediation, arbitration, and consumer complaint mechanisms through e-commerce platforms. The study's conclusions emphasize the importance of regulatory harmonization and strengthening law enforcement mechanisms to provide optimal consumer protection in e-commerce transactions
