Abstract

Perjanjian pengusahan tanah dengan bagi hasil semula diatur dalam hukum Adat yang didasarkan pada kesepakatan antara pemilik tanah dan petani penggarap dengan mendapat imbalan hasil yang telah disepakati sebelumnya oleh kedua belah pihak. Dalam perkembangannya, perjanjian bagi hasil kemudian mendapat pengaturan dengan Undang-Undang Nomor 2 Tahun 1960  tentang perjanjian Bagi hasil yang lahir berdasarkan pada hukum adat di Indonesia. Permasalahan dalam tulisan ini adalah bagaimana implementasi Undang-Undang Nomor 2 Tahun 1960  Tentang Perjanjian Bagi Hasil Tanah di Kecamatan Kotabumi Selatan Lampung Utara? dan Faktor-faktor apa yang menjadi penghambat dalam Implementasi Undang-Undang Nomor 2 Tahun 1960  tentang Tentang Perjanjian Bagi Hasil Tanah di Kecamatan Kotabumi Selatan Lampung Utara? Artikel ini menggunakan pendekatan empris, data primer diperoleh melalui pengumpulan data di lapangan yang kemudian dilengkapi dengan  studi pustaka untuk selanjutnya dianalisis secara kualitatif. Pelaksanaan penerapan Undang-Undang Nomor 2 Tahun 1960  tentang Perjanjian Bagi Hasil Tanah Pertanian di Kecamatan Kotabumi Selatan Lampung Utara belum sepenuhnya berjalan efektif. Masyarakat cenderung memilih untuk melaksanakan dengan cara lisan, dengan dasar imbangan pembagian hasil sesuai dengan kesepakatan, alasannya adalah sudah dilakukan secara turun temurun, saling percaya untuk saling tolong menolong antara warga sehingga mereka tidak memilih secara formal namun hanya kata sepakat antara kedua pihak (pemilik tanah dan penggarap). Faktor penghambat penerapan Undang-Undang Nomor 2 Tahun 1960  tentang Perjanjian bagi Hasil Tanah Pertanian di Kecamatan Kotabumi Selatan Lampung Utara adalah  sebagian besar masyarakat tidak mengetahui adanya ketentuan Perjanjian bagi Hasil Pertanian yang diatur dalam Undang-Undang tersebut karena tidak adanyan Sosialisasi dari perangkat desa maupun dinas yang terkait; kurangnya wawasan dari masyarakat karena rendahnya tingkat pendidikan; adanya kebiasaan buruk dari masyarakat yang menyepelekan setiap peraturan yang berhubungan dengan pertanian.

Abstract

Law which is seen as one of the important aspects in society that aims to realize the formation of a comfortable and just society, is sometimes ignored by a few people. Not infrequently the law is injured, violated, even manipulated its function by people who do have an interest or people who still consider the importance of a law that exists in society. North Lampung as one of the districts in Lampung Province which has an area of 2,765.63 km² and the total population of the district is 612,100. In 2020 in September at the Resort Police (Porles) of North Lampung, reports of the occurrence of crime have exceeded 1000 (one thousand) reports, this is very concerned about legal awareness in North Lampung. Whereas in the North Lampung community, it is very thick with Lampung Indigenous culture which has behavioral values in the community called Piil Pesinggiri which is defined as a sense of shame to carry out an attitude that is insulted by religion and socio-cultural environment.

Abstract

Artikel ini membahas upaya pencegahan konflik antara masyarakat lokal dengan pendatang di kabupaten Lampung Utara dengan prinsip nemui nyimah, konflik yang terjadi didasari keberagaman suku dan adat istiadat yang dimiliki masyarakat. Metode penelitian yang digunakan adalah kualitatif dengan pendekatan socio-legal. Hasil penelitian menunjukkan upaya melakukan pencegahan konflik antara masyarakat lokal dan pendatang dengan prinsip nemui nyimah. Upaya penyelesaian konflik yang terjadi dengan prinsip nemui nyimah dapat melalui instrumen ippun aneg sebagai wadah untuk menumbuhkan sikap mendahulukan kepentingan bersama dibandingkan kepentingan pribadi. Selain itu, faktor pendukung dalam penyelesaian konflik yang terjadi didukung atas nilai yang dipegang teguh oleh masyarakat seperti budi bahaso, titei gumattei, dan lima prinsip hidup dalam pergaulan sehari-hari, konflik yang tidak kompleks, kesadaran atas kepentingan bersama, dan dukungan pemerintah dalam mengantisipasi konflik.

Abstract

During the COVID-19 pandemic, it affected the education system which directed the learning system to the implementation of distance learning, so that education continued to work to achieve the functions and objectives of education in Article 3 of Law Number 20 of 2003 concerning the National Education System. The method used in this research is empirical legal research to see directly and observe the objects and circumstances that exist in the research area and their legal effectiveness. A learning policy can be said to be effective and successful if it can realize the functions and objectives of education. The components involved in the learning system such as educators, materials and curriculum, learning methods, infrastructure and learning environments are evaluated to see whether or not the educational functions and objectives are implemented. In online learning during the COVID-19 era, the functions and objectives of education have not been fully achieved due to obstacles in their implementation. The inhibiting factors in its application are lack of concentration, inadequate facilities and infrastructure, limited internet access and limitations in the use of technology. As long as there is no solution to quell the pandemic, online learning must continue and educator practitioners must increase creativity to create quality and interesting learning.

Abstract

public regulations that apply in Indonesia, standard regulations themselves are undeniably more present than the material of public regulations, for that reason what is the reason or for now the standard regulations in North Lampung are still in effect and with imaginable assumptions, what kind of standard discipline can be imposed on someone who has made a mistake and whether there are various standard powers to be recognized or even consequences to bear. the culprit is known by imposing standard discipline on criminal demonstrations and how it functions, whether in carrying out settlements according to standard regulations in force in the Abung Pekurun area, Abung Pekurun Local, North Lampung regulations. When a dispute occurs, it would be nice if a problem was discussed in a deliberation manner and not to cause a conflict between the two parties, in which one of these incidents someone has become a victim of the dispute, we are both civilized Lampung, we should take care of each other customs and culture and preserve what is in the Lampung community

Abstract

In accordance with Article 72 of Law 6 of 2014 concerning Rural Areas, village income sourced from the APBN or village funds comes from central spending by increasing the efficiency and equity of village programs. The amount of the budget allocation that is allocated directly to the village is set at 10%. the amount paid to the area (above). In addition, Law Number 6 of 2014 also strengthens the allocation of village funds (ADD) from district/city balancing funds. Given the enormous power of the village head in administering village government based on the Decree of the Government of the Republic of Indonesia Number 72 of 2005 Article 14, it is necessary to review and balance the administration of village governance. The agency authorized to supervise village heads on village household expenditures is the BPD. The role of the village council as the controlling body of the village government requires responsibility and ability in carrying out its duties. It is also clear that according to the Decree of the Government of the Republic of Indonesia Number 72 of 2005, the BPD is an institution that embodies democracy under the leadership of the village government as part of the village administration with the village head.

Abstract

hak-hak konstitusional pekerja dapat dilindungi dari tindakan pengabaian dan pelanggaran. Sebab pemberi kerja senangtiasa berada di atas kaum pekerja di dalam lapangan social ekonomi. Perlindungan dan Pelayanan Ketenagakerjan haruslah berorientasi pada kepuasan masyarakat meliputi kesederhanaan prosedur, Kepastian waktu, kejelasan persyratan, keamanan, akurasi, bertanggung jawab, disiplin, kemudahan akses, ramah dan lingkungan yang nyaman. Penelitian ini menggunakan pendekatan hukum normative, yang sumber datanya didapatkan dari data sekunder terdiri dari hukum primer seperti norma atau kaidah dasar sedangkan bahan hukum sekunder seperti buku-buku, hasil penelitian serta doktrin pakar hukum. Bahwa Hak Konstitusional para pekerja tertulis pada Pasal 28D ayat (2) “Setiap orang berhak untuk bekerja serta mendapat imbalan dan perlakuan yang adil dan layak dalam hubungan kerja”. Ditambah pelaksanaan Pelayanan publik merupakan hak sosial dasar masyarakat tetapi dalam kenyataan masih banyak hambatan atau penyimpangan, terjadinya penyimpangan-penyimpangan dan kasus-kasus maladministrasi yang seharusnya harus berlandaskan pada pelayanan prima dengan prinsip makin cepat, makin sederhana, aktual, makin baik dan makin murah.

Abstract

Virus Corona atau yang selanjutnya diberi nama resmi oleh organisasi kesehatan dunia World Health Organization (WHO) sebagai Corona Virus Disease 19 (Covid-19) mulai merebak sejak akhir bulan Desember 2019 di ibukota provinsi Hubei yaitu Wuhan China telah merambah ke seluruh negara di dunia. Kedatangannya mendadak, mengejutkan dan sangat massif, sehingga membuat gagap dan panik semua penduduk dunia tidak terkecuali Indonesia.Permasalahan pokok yang hendak penulis bahas dalam artikel ini adalah bagaimanakah aspek hukum sistem pembelajaran daring/jarak jauh di masa pandemi covid-19?Harus adanya regulasi khusus yang mengatur tentang sistem pendidikan atau pembelajaran daring atau pendidikan jarak jauh untuk masa darurat yang dapat dijadikan sebagai acuan apabila terjadi bencana seperti covid-19 ini. Aturan yang dikeluarkan oleh Menteri Pendidikan dan Kebudayaan saat ini bersifat ad hoc dan belum menyentuh secara substansi terkait pembelajaran daring dan masih terjadi pertentangan antar aturan, hal ini disebabkan peraturan yang ada di dalam UU memang dibuat untuk keadaan normal bukan dalam situasi darurat.Aturan yang akan diterapkan dalam keadaan darurat tentu saja akan memperhatikan hal-hal yang berkaitan langsung dengan keadaan darurat tersebut, sehingga tidak ada aturan atau undang-undang yang dilanggar atau bertentangan satu sama lain.

Abstract

the issuance of Law No. 06 of 2014 concerning Villages, villages get better attention from the central government and local governments because there is a village fund policy from the central government to finance village community development and empowerment worth hundreds of millions plus the Village Fund Allocation from the Regional Government for finance the administration of government, implementation of development, community development and empowerment of rural communities worth tens of millions. The size of the budget obtained by the village makes the election of the village head more attractive.In North Lampung, there are 141 villages that will conduct village head elections simultaneously and 463 Village Head Election Participants. In Law No. 6 of 2014 concerning villages, the administration of village government is in accordance with the characteristics, culture and local wisdom of each region. However, at the stages of village head elections, problems arise that are not in accordance with local wisdom in North Lampung, such as indications of alleged violations of money politics, persecution perpetrated by one of the candidates for village head

Abstract

This study aims to identify the implementation of bureaucratic reform and offer several solutions for improving licensing administration services. This research uses a qualitative approach with the type of instrumental case study research. The research was carried out at the North Lampung Regency Licensing Service. Data collection techniques were used: in-depth interviews, document studies and observation. The results showed that the implementation of bureaucratic reform in licensing administration services, from the institutional aspect to the licensing service for North Lampung Regency, was a Stop Service. Aspects of Human Resources show that the qualifications of existing employees are not following the organization's needs, as well as the fact that discipline and responsibility of employees are still relatively low. Regional governance reform begins with the form of regional autonomy. Regional autonomy represents the authority to regulate government businesses that have a local character following initiatives that follow the community's aspirations. Regional governance reform aims to maximize service functions with a more public locality character. Reform of the implementation of regional governance can be carried out by relating to the conception of a new public service oriented towards community services that are responsive to various public values ​​and interests and are also non-discriminatory.
