Abstract

With the growth of shopping centers, it can be said that every year there are many minimarkets, supermarkets, hypermarkets, and modern markets such as malls whose existence continues to shift traditional markets in cities throughout Indonesia. People in urban areas tend to prefer to shop for their daily needs at supermarkets or supermarkets. The rapid development of shopping centers raises concerns for some people, because the irregular development of modern markets can result in the extinction of traditional markets or small shops due to their declining turnover. The growing retail giant is a threat to traditional markets, distance rules, zoning and the absence of other restrictions. Even now the modern market is side by side with the traditional market. The sustainability of the efforts of domestic producers and SMEs to encourage domestic products to enter the modern retail market is also an important issue to pay attention to.

Abstract

AbstractInteresting problem in this study discuss settlement efforts default if the collateralobject has been transferred to a third party. Associated with way of guaranteeing inthe a motor vehicle financing agreement, it is inseparable from possible risks that mayoccur, such as take over to a third party without creditor’s knowledge. This study aimsto identify and analyse the role and constraints of the Consumer Dispute ResolutionAgency (BPSK) in handling car take over instalments (analysis of decision number06/PT/BPSK.BJM/IV/2022). This type of research uses qualitative methods with caseresearch (study case). The object of this research in the office staff of the ConsumerDispute Resolution Agency (BPSK) City of Banjarmasin. The data sources used areinterview results and secondary data. Then do the analysis to draw conclusion. Theresult of this study indicate that in carrying out its duties and authorities the role ofthe Consumer Dispute Resolution Agency (BPSK) is towards efforts legal protectionregarding car take over in Decision Number 6/PT/BPSK.BJM/IV/2022 is to act as anassembly that decides disputes, the parties submit their settlement to the ConsumerDispute Resolution Agency (BPSK) because the parties to the dispute resolution chooseusing the arbitration method. Consumer Dispute Resolution Agency (BPSK)constrained to help resolve the case in the event that the BPKB cannot taken becausethe debtor cannot show the original identity of the power of attorney for taking BPKB ,so naturally the creditor has not submitted it. Based on this, the role of the ConsumerDispute Resolution Agency (BPSK) in carrying out its duties and authorities has actedin accordance with the provisions applicable law, and become a fair and objective arbiter in protecting consumer rights. Presence of the of the Consumer Dispute Resolution Agency (BPSK) provide protection and guarantees for consumer in conducting transactions financing, as well as facilitating efficient and fair dispute resolution.Keywords: Consumer Dispute Resolution Agency (BPSK); take over; installmentAbstrak Permasalahan menarik dalam penelitian ini membahas upaya penyelesaian wanprestasi apabila objek jaminan sudah berpindah ke pihak ketiga. Berkaitandengan cara penjaminan dalam perjanjian pembiayaan kendaraan bermotor, tidakterlepas dari kemungkinan risiko yang terjadi, seperti take over kepada pihak ketigatanpa sepengetahuan kreditur. Penelitian ini bertujuan untuk mengetahui danmenganalisis peran dan kendala Badan Penyelesaian Sengketa Konsumen (BPSK)dalam menangani take over mobil secara angsuran (analisa putusan nomor06/PT/BPSK.BJM/IV/2022). Jenis penelitian ini menggunakan metode kualitatifdengan penelitian kasus (case study). Objek penelitian ini adalah pegawai kantorBadan Penyelesaian Sengketa Konsumen (BPSK) Kota Banjarmasin. Adapun sumberdata yang digunakan adalah hasil wawancara dan data sekunder. Kemudiandilakukan analisis untuk menarik kesimpulan. Hasil penelitian ini menunjukkanbahwa dalam menjalankan tugas dan wewenangnya peran Badan PenyelesaianSengketa Konsumen (BPSK) terhadap upaya perlindungan hukum mengenai take overmobil pada putusan Putusan Nomor 6/PN-BPSK.BJM/IV/2022 adalah bertindaksebagai majelis yang memutuskan sengketa, para pihak menyerahkanpenyelesaiannya kepada Badan Penyelesaian Sengketa Konsumen (BPSK) karena parapihak dalam penyelesaian sengketa memilih menggunakan metode arbitrase. BadanPenyelesaian Sengketa Konsumen (BPSK) terkendala membantu menyelesaikanperkara tersebut dalam hal BPKB tidak bisa diambil disebabkan debitur tidak dapatmenunjukkan identitas asli pemberi kuasa untuk pengambilan BPKB, sehingga wajarkreditur belum menyerahkannya. Berdasarkan hal tersebut peran Badan PenyelesaianSengketa Konsumen (BPSK) dalam menjalankan tugas dan wewenangnya sudahbertindak sesuai dengan ketentuan yang berlaku, dan menjadi penengah yang adilserta objektif dalam melindungi hak-hak konsumen. Kehadiran Badan PenyelesaianSengekta Konsumen (BPSK) memberikan perlindungan dan jaminan bagi konsumendalam melakukan transaksi pembiayaan, serta memfasilitasi penyelesaian sengketayang efisien dan adil.

Abstract

Perkembangan produk bank syaraiah sangat fleksibel mengikuti kebutuhan masyarakat, salah satu produk yang sangat berkembang saat ini adalah kartu kredit syariah. Semakin banyaknya transaksi yang menggunakan kartu kredit mendorong bank syariah juga ikut berinovasi dalam produk kartu kredit, akan tetapi banyak pendapat yang mengatakan bahwa kartu kredit syariah lebih mendekatkan diri kepada sifat israf (berlebih-lebihan) sehingga mendorong umat Islam bersikap konsumtif, boros dan membiasakan untuk berutang. Tulisan ini hadir beranjak dari permasalahan perkembangan teknologi pada bidang ekonomi syariah. Melalui metode penelitian yuridis normatif, pendekatan deskriptif kualitatif, serta metode desk study sebagai teknik pengolahan data dan informasi mengenai hal yang berkaitan dengan penelitian yang dilakukan sebagai penjelas, dengan cara mempelajari, mengkaji, menelaah secara mendalam hingga mendapatkan hasil yang memiliki keterkaitan terhadap permasalahan yang diteliti. Hasil penulisan menunjukkan bahwa terkait dengan pola hidup konsumtif masyarakat melalui pemanfaatan kartu kredit syariah, jika ditinjau dari perspektif maslahah mursalah, kegiatan yang dilakukan tidak sesuai dengan prinsip ekonomi syariah karena pola hidup konsumtif merupakan suatu hal yang menyalahi aturan dalam ajaran Islam yang memerintahkan umatnya agar tidak menghambur-hamburkan harta untuk hal yang tidak bermanfaat dan menghindari hal yang bersifat mendatangkan kemudharatan dikemudian hari, sebagaimana Fatwa DSN MUI Nomor 54/DSN-MUI/X/2006 yang menerangkan bahwa diperbolehkannya penggunaan daripada kartu kredit salah satunya adalah tidak menggunakannya untuk menunjang perilaku hidup yang bersifat konsumtif atau berlebih-lebihan (israf). Sehingga diperlukan edukasi dan imbauan agar masyarakat memanfaatkan kartu kredit syariah secara bertanggung jawab, dan tidak terjebak pola konsumtif yang merugikan.

Abstract

This research is motivated by the problem of joint property controlled by the former husband after divorce in Banua Kepayang Village, Labuan Amas Selatan District, Hulu Sungai Tengah Regency. In this case, when a divorce occurs, the joint property is controlled by the former husband. It should be based on the Compilation of Islamic Law Article 97 states that "Widows or divorced widowers are entitled to one-half of the joint property as long as it is not specified otherwise in the marriage agreement." This type of research uses empirical legal research with a qualitative descriptive approach and a legal sociology approach. The data collection technique is done by interview. The data explored regarding the description of the control of joint property and the reasons behind the control of joint property by the ex-husband after divorce. The data source is informants with three former families. Data processing techniques through editing, categorization, description, and matrication. Data were analyzed using descriptive techniques. The results showed that the control of joint property was carried out by the ex-husband with a description of the joint property in each case varying. In the first case, the joint property was controlled entirely by the former husband. In the second case and the third case, the joint property was only partially controlled by the former husband by selling the joint property without distributing it to the former wife. There are several reasons behind the control of joint property. First, there is a signed agreement on stamp duty. Second, based on the understanding of the former husband that the former husband feels that he has contributed more in producing joint property, the existence of daily maintenance while still being husband and wife, iddah maintenance, and mut'ah maintenance, besides that because the former wife had cheated on him with another man when she was still a husband and wife. As according to the former wife, it was due to the ambition to fulfill all the wishes of the former husband such as buying a new car, a new motorcycle, building a house with a new wife, and others.

Abstract

This research aims to find out the sales of Qiana Cell Counter in 2020 from January to December. Qualitative and quantitative research methods by attaching sales data based on profit and deepening with interviews. The results of the study provide data that sales at the Qiana Cell counter increased and increased from January to December 2020 from Counters to 4 Counters. This increase is also influenced by HR and strategic location and also the sales strategy carried out by Qiana Cell.

Abstract

Islamic boarding schools are required to be agents of development, playing an active role in contributing to and transforming the field of economic empowerment and the quality of their resources. Many Islamic boarding schools have adapted and transformed into institutions that participate in economic empowerment efforts, but the programme only involves motivators and target groups without the involvement of the students, both cognitively and in terms of action. Thus, students must be empowered. Among the skills that students should be prepared with are those that will enable them to support the pesantren's economy and also add value for them when they return to society. The objective of this assistance is to enhance the understanding and awareness of students and pesantren on the significance of the creative industry for the advancement of pesantren and as a precursor for students after graduating from these educational institutions. Therefore, the research team/servant and the pesantren together explore the potential or assets that they have, develop appropriate programmes, and also evaluate the implemented programmes. The ABCD approach is a service methodology employed in this mentoring programme. This service technique is broadly divided into five stages: (1) Identification of community strengths; (2) Asset mapping of the community, (3) Planning the form of the mentoring programme; (4) programme implementation; (5) monitoring and evaluation (M&E) is conducted using the Most Significant Change (MSC) technique.

Abstract

IntroductionThe palm sugar industry in Hulu Sungai Tengah, South Kalimantan, is a traditional sector that supports the local economy and provides employment in the informal workforce. Despite its cultural and economic significance, the industry faces serious challenges, including unstable raw material supply, limited innovation, weak market access, and the absence of legal protection for workers. These issues raise critical questions regarding the long-term sustainability of this local industry.ObjectivesThis study aims to analyze the sustainability of the palm sugar industry in Hulu Sungai Tengah from the perspectives of local economic development, public policy, and labor law, while also integrating insights from Islamic economics and finance to propose a holistic framework for industry revitalization.MethodThis research applies a qualitative descriptive-exploratory approach involving in-depth interviews, field observations, and document analysis. The participants consist of palm sugar artisans, policymakers, small and medium enterprise representatives, and local government officials. Data were examined using a triangulation technique to ensure validity, and the Triple Bottom Line framework guided the analysis.ResultsThe findings reveal that the palm sugar industry retains strong economic potential due to naturally growing sugar palms and established cultural practices. However, systemic challenges persist, including lack of planned cultivation, reliance on traditional processing methods, weak branding, and widespread informality in labor practices. Islamic finance mechanisms such as profit-and-loss sharing, as well as instruments like zakat and waqf, offer promising pathways to strengthen capital access, innovation, and social welfare within the sector.ImplicationsThe study highlights the need for integrated policies between local government, financial institutions, and community stakeholders. Practical recommendations include cultivating sugar palms systematically, introducing innovation and digital marketing, providing fair labor protection, and mobilizing Islamic social finance. These steps can enhance resilience, competitiveness, and sustainability in line with both national development priorities and Islamic economic principles.Originality/NoveltyThis study contributes a multidisciplinary perspective by linking local economic analysis, public policy, labor law, and Islamic finance in the context of a traditional industry. It offers a novel framework for understanding how ethical and Shariah-compliant economic instruments can support the sustainable transformation of rural industries, an area that has received limited scholarly attention in South Kalimantan.

Abstract

As modern stores dominate and traditional shops cannot compete, various threats emerge, including the loss of traditional shops owing to changing consumer behaviors. The existence of modern shops today creates a dilemma for the government, including in the Tanah Laut Regency area. On the one hand, it creates job opportunities, but on the other, it has the potential to paralyze established traditional shop businesses. It requires the participation of the state, which has the authority to issue regulations. This is a descriptive field research using qualitative methods, with a focus on the sustainability of traditional stores following the existence of modern shops, the aspirations of small traders, and Tanah Laut district government regulations. This research, conducted in 2023, Traditional shop owners experience the influence of modern stores both before and after they open, particularly in terms of income. Because modern stores are more organized and tidier, and rooms are air-conditioned, consumer preferences have shifted. Their aspirations are to progress together, and the site or development zone for modern shops is not close to traditional shops, despite the fact that some are already barely 50 meters away. The sustainability of modern shops today has a significant impact on the sustainability of traditional shops in Tanah Laut Regency. This involves shop development zoning arrangements, collaboration between modern and traditional stores, government assistance in the construction of traditional shops to balance the development of modern shops.

Abstract

The study aspect of this research is the Banjar community's custom for women who are seven months pregnant, in which a traditional procession is carried out in which the woman is bathed by her parents, grandmother, and family relatives in turn. The purpose of this research is to find out how an Islamic legal review is taken from the implementation of the Banjar community for generations. With this custom occurring in Indonesia, especially the Banjar tribe, although it is known that when a wife is pregnant in Islam, she can pray and put her trust in Allah ﷻ, but this research has differences in the approach to the meaning of the concept. The research method used in this research is a field research method that occurs in several places in the city of Banjarmasin and is analyzed descriptively qualitatively, namely the discussion obtained by collecting data from interviews and literature sources about the seven-month bath which is then examined using a review of Islamic law. From the results of this study it can be concluded that the custom or custom of bathing seven monthly there are those who say it is not allowed and there are also those who say it is allowed in Islamic law, because something is a matter of difference of opinion in fiqh is a natural thing. The term "Mandi-Mandi Manujuh Bulanan" appears among the Banjar people because it is more widely known, although in fact this "bamandi-mandi" custom for the Banjar people there are many kinds and certain conditions. Aspek kajian pada penelitian ini adalah oleh masyarakat Banjar dalam melakukan adat bagi perempuan yang hamil tujuh bulan yang dilaksanakan suatu prosesi adat dari perempuan tersebut dimandikan oleh orang tuanya perempuannya, neneknya, maupun kerabat keluarganya secara bergantian. Tujuan dari penelitian ini adalah untuk mengetahui bagaimana suatu tinjauan hukum islam yang diambil dari pelaksanaan masyarakat Banjar tersebut secara turun menurun. Dengan kebiasaan tersebut terjadi di Indonesia khususnya suku Banjar yang walaupun sudah dapat diketahui bahwa ketika istri hamil dalam Islam dapat dido'akan dan bertawakal kepada Allah ﷻ, namun penelitian ini memilik perbedaan dari pendekatan maksud dari konsep itu. Metode penelitian yang digunakan dalam penelitian ini adalah metode penelitian lapangan yang terjadi di beberapa tempat di kota Banjarmasin dan dianalisis secara deskriptif kualitatif, yaitu pembahasan yang diperoleh dengan mengumpulkan data dari wawancara dan sumber kepustakaan tentang mandi tujuh bulanan yang kemudian ditelaah dengan menggunakan tinjauan hukum Islam. Dari hasil penelitian ini dapat disimpulkan bahwa kebiasaan atau adat mandi tujuh bulanan itu ada yang menyatakan tidak boleh dan ada juga yang mengatakan boleh dalam hukum Islam, karena sesuatu hal persoalan dalam perbedaan pendapat pada fiqih adalah suatu hal yang wajar. Adaphn Istilah "Mandi-Mandi Manujuh Bulanan" ini muncul di kalangan masyarakat Banjar karena lebih banyak dikenal, meskipun sebenarnya adat "bamandi-mandi" ini bagi masyarakat Banjar terdapat banyak macam dan keadaan tertentu.
