Abstract

The dependency on imports may increase the risk of the spreading of pest and other animal disease and quarantined plants which can destroy Indonesia?s biodeversity. One of the preventive steps which may be taken in order to avoid the worse effect of this trade liberalization attack is by enforcing a stricker sanctions in agriculture and trade to save Indonesia?s food market. This study examines the effect of the implementation quarantine rules towards the produce bussines fosterage between countries in Batam. The research method used empirical jurisdiction. The result shows that the effect of implementation quarntine rules in Batam has been carried out in accordance with the applicable acts and regulations. the effectiveness of implementation quarantine rules were caused by obstacles that raised because of the ignorance of the business, importers, exporters, and society in the things dealing with the rules or administrative provision in document issue or quarantine certification, Efforts taken by the Quarantine Batam in making quarantine rules as well as its rules effective were giving guidance to the officers in the Quarantine to minimalize violation of rules.   Dengan ketergantungan akan impor maka semakin besarnya kemungkinan tersebarnya hama dan penyakit hewan dan tumbuhan karantina yang dapat memusnahkan keanekaragaman hayati Indonesia. Salah satu langkah preventif yang dapat dilakukan untuk menghambat serangan dampak liberalisasi perdagangan yang lebih buruk adalah ketegasan penerapan sanksi hukum dalam pertanian dan perdagangan untuk menyelamatkan pasar pangan di dalam negeri. Penelitian mengkaji tentang pengaruh  implementasi aturan karantina terhadap perdagangan produk pertanian antar negara di Batam. Metode penelitian menggunakan pendekatan yuridis empiris. Hasil penelitian menunjukkan bahwa Pengaruh implementasi aturan karantina pertanian di Batam telah dilaksanakan berdasarkan Perundang-undangan yang berlaku. Efektifitas Implementasi tentang karantina disebabkan oleh kendala yang timbul dikarenakan ketidak tahuan pengusaha, importir, eksportir, serta masyarakat dalam hal-hal yang berkaitan dengan peraturan atau ketentuan administrasi dalam pembuatan dokumen atau sertifikasi karantina, Upaya - upaya yang ditempuh oleh Balai Karantina Kelas 1 Batam dalam mengefektifkan aturan karantina dengan Proses peningkatan pelayanan publik di Balai Karantina Kelas 1 Batam adalah mengenai kesadaran petugas itu sendiri harus selalu dibina untuk meminimalisir terjadinya pelanggaran

Abstract

Regional Regulation (PERDA) is a political product that is formed by the Regional Government and the Parliament. Regional Government is divided into provincial government that has the authority to establish a Provincial Regulation is the Governor together with the Provincial Parliament. The District Governement that has the authority to establish a District Regulation is the Regency Head or Mayor together with the District Parliament. The regional regulations as Legal Product are a form of written law that contains the rules of behavior that are binding in general. The substance of Regional Regulation must be further elaborated  from the higher law by taking into account the specificity of each region. The Regulation must not contradict with higher laws and regulations and as well as public interest. The purpose of this study is to explain the establishment of the villages which is located in Natuna regency. It examines whether it has fulfilled the requirements that are regulated by the Law and to explain its legal implications. The data collection is obtained from study of documents and literature. The method used in this study is a normative legal research method. The results showed that the Establishment of Natuna Regency Regulation No. 15 of 2014 concerning the Establishment of the Village did not follow the procedures / mechanisms that are regulated in the Government Regulation, therefore the Riau Islands Governor has not issued a register code for Village Preparation Establishment, and Registration Number to regulate the village establishment.  Consequently, the Minister of the Interior has not issued Village codes.  Accordingly,  the Regional Regulation may be declared  as not aligning with the legal procedures. === Peraturan Daerah atau disingkat Perda merupakan produk politik hukum daerah yang dibentuk oleh Pemerintah Daerah dan DPRD. Dimana Pemerintah Daerah terbagi menjadi pemerintahan Provinsi yang memiliki kewenangan untuk membentuk Perda Provinsi adalah Gubernur bersama-sama dengan DPRD Provinsi. Sedangkan untuk pemerintahan Kabupaten/Kota yang memiliki kewenangan untuk membentuk Perda Kabupaten/Kota adalah Bupati/Walikota bersama-sama dengan DPRD Kabupaten/Kota. Peraturan Daerah sebagai produk hukum daerah merupakan bentuk hukum yang tertulis yang berisi aturan tingkah laku yang bersifat mengikat secara umum. Pengaturan Perda secara substansi haruslah merupakan penjabaran lebih lanjut dari peraturan perundang-undangan yang lebih tinggi tingkatannya, dengan memperhatikan kekhususan masing-masing daerah dan tidak bertentangan dengan peraturan perundang-undangan yang lebih tinggi serta kepentingan umum. Tujuan penelitian ini adalah untuk menjelaskan pembentukan desa-desa yang berada di Kabupaten Natuna apakah telah memenuhi persyaratan sebagaimana yang diatur dalam Peraturan Perundang-undangan dan untuk menjelaskan implikasi hukum. Pengumpulan data dilakukan dengan studi dokumen dan kepustakaan. Metode penelitian yang digunakan dalam penulisan ini adalah metode penelitian hukum Normatif. Hasil penelitian menunjukkan bahwa Penetapan Peraturan Daerah Kabupaten Natuna Nomor 15 Tahun 2014  tentang Pembentukan Desa yang tanpa melalui prosedur/mekanisme sebagaimana diatur di dalam Peraturan Perundang-Undangan sehingga Gubernur Kepulauan Riau tidak mengeluarkan Kode Register untuk Desa Persiapan, Nomor Registrasi untuk Peraturan Daerah dan Kode Desa oleh Menteri Dalam Negeri sehingga Peraturan Daerah tersebut dapat dinyatakan ?tidak mengikuti prosedur hukum yang berlaku?.

Abstract

Responsiveness to the aspirations of the community members is very important in order to formulate the aspirations of the community in the form of legal products. Community participation in law-making is expected to be a power control (the agent of social control) and the power balance between the interests of the government and society. Within the democracy political system, the opportunity to participate to formation legal products is widely open. This research used a normative research method. The research was conducted through inteviews of the Chairman of the Regional House of Representatives of Tanjungpinang City, including the Chairman of the Commission and Chairman of the Legislative Council of Tanjungpinang City. It reveals that the Regional House of Representatives (DPRD) of Tanjungpinang City that has the legislative, budgetary and supervisory function plays an important role in accommodating and following up the expectations, desires and aspirations of  people, especially people of Tanjungpinang City. The House of Representatives (DPRD) of Tanjungpinang City has effectively supervise the implementation of the Regional Budget or  the prescribed public policy in order to create an accountability of financial management. === Responsivitas anggota dewan terhadap aspirasi masyarakat menjadi amat penting guna memformulasikan aspirasi masyarakat dalam bentuk produk hukum. Keikutsertaan masyarakat dalam pembuatan hukum diharapkan menjadi kekuatan kontrol (agent of social control) dan kekuatan penyeimbang antara kepentingan pemerintah dan masyarakat. Dengan dianutnya sistem politik yang demokrastis, kesempatan untuk berpartisipasi dalam pembentukan hukum lebih terbuka. Penelitian yang berhubungan dengan lembaga legislatif ini menggunakan metode penelitian yuridis normatif. Metode penelitian seperti ini disebut juga penelitian hukum dengan pendekatan doktrinal yang bersifat normatif. Penelitian ini melakukan interview kepada Pimpinan Dewan Perwakilan Rakyat Daerah Kota Tanjungpinang, termasuk Ketua Fraksi dan Ketua Komisi Dewan Perwakilan Rakyat Daerah Kota Tanjungpinang. Hasil Penelitian mengungkapkan bahwa Dewan Perwakilan Rakyat Daerah (DPRD) Kota Tanjungpinang yang memiliki fungsi legislasi, anggaran dan pengawasan berperan penting dalam menampung dan menindaklanjuti harapan dan aspirasi masyarakat khususnya masyarakat Kota Tanjungpinang. Dewan Perwakilan Rakyat Daerah (DPRD) Kota Tanjungpinang telah melakukan  pengawasan  secara  efektif  terhadap  Kepala  Daerah  dalam  pelaksanaan Anggaran Pendapatan dan Belanja Daerah (APBD) atau kebijakan publik yang telah ditetapkan sehingga dapat tercipta akuntabilitas pengelolaan keuangan daerah.

Abstract

One of the national problems that are often ignored by the government. Yet to this day, there are still many women who are the object of sexual violence. However, there are very few legal instruments that can protect their rights. Most victims who try to fight sexual violence are discriminated against and intimidated. What is even more surprising is that the intimidation does not only come from perpetrators of sexual violence, but also from law enforcement. Therefore, it is necessary to revamp the legal instruments that regulate sexual violence. The urge to immediately ratify the draft law on the elimination of sexual violence (RUU PKS) is even more massive. This paper uses a normative juridical research method that examines various laws and regulations related to sexual violence. If it is based on the results of the research, it can be concluded that the instruments in the national legal system have not been able to answer this problem. The Criminal Code (KUHP) has not been able to provide maximum protection and recovery for victims of sexual violence. Considering that the current Criminal Code does not provide a clear definition of the term sexual violence. The Criminal Code only focuses on punishing perpetrators, but does not focus on restoring the rights of victims. Likewise with the Law on the Elimination of Sexual Violence in the Household. The law also does not mention the elements of sexual violence committed against people in the household. Then, sexual violence is also an act that violates human rights because there is unfair treatment for the victim.

Abstract

Indonesia is a country that has the objective of ensuring the welfare of its citizens. One effective way to achieve prosperity for its citizens is by implementing excellent public services, especially when it comes to the fulfillment of rights concerning the legalization of public documents. Therefore, this study is aimed to analyze the application of the Apostille convention in the legalization of public documents, and to investigate the changes in the law of public services related to the legalization of documents after the Apostille enactment. This legal study is categorized as a type of doctrinal analysis. Specifically, it is descriptive and analytical. Juridical and theoretical foundations were used for data analysis and the theoretical basis employed was the Theory of Legal Reform. The finding is consistent with the principles of the Legal Reform Theory. Legalization of public documents has undergone legal reform because legalization of public documents can be done online and in a short time. This shows that law, as a means of reform, has been realized because it has met the needs of society for the public. Despite the enhancement of public services, several aspects require careful consideration and improvement. This includes establishing effective cooperation with the Regional Office of Law and Human Rights, which acted as a liaison for Apostille services at the regional level. Additionally, the Regional Office of Law and Human Rights assume a pivotal role in overseeing the printing of certificates to ensure accessibility for the public.
