Abstract

This article discusses the process of examining marriage dispensation cases prior to and following the enactment of Supreme Court Regulation Number 5 of 2019 concerning Guidelines for Adjudicating Marriage Dispensation Cases. This paper was written using a qualitative research method, specifically normative and empirical juridical approaches. According to the findings of this study, the provisions of Supreme Court Regulation Number 5 of 2019 have explicitly regulated several things that are not specifically regulated in the formal and material rules governing marriage dispensation. The adoption of this regulation is anticipation and standardization for judges in making legal decisions so that court decisions pay more attention to the best interests of children when granting a marriage dispensation application.

Abstract

Dalam Islam poligami dibolehkan tanpa perlu izin istri pertama, tetapi dalam hukum Indonesia, suami yang ingin berpoligami harus mengajukan izin kepada pengadilan dan atasannya (untuk PNS). Peraturan Pemerintah Nomor 10 Tahun 1983 dan 45 Tahun 1990 mengatur bahwa PNS pria yang ingin berpoligami harus memperoleh izin dari pejabat yang berwenang. Ketentuan ini dianggap kurang sesuai dengan Hak Asasi Manusia (HAM) karena membedakan perlakuan antara laki-laki dan perempuan dalam hal perkawinan. Penelitian ini bertujuan untuk mengeksplorasi aturan izin poligami bagi PNS dalam perspektif hukum Islam dan HAM. Hasil penelitian menunjukkan bahwa meskipun dalam hukum Islam tidak ada kewajiban meminta izin, dalam peraturan Indonesia dan Kompilasi Hukum Islam (KHI), suami yang ingin berpoligami harus memperoleh izin dari pengadilan agama dan mengikuti prosedur yang berlaku. Selain itu, HAM tidak mengatur poligami karena mengutamakan kesetaraan gender dalam perkawinan monogami. Penelitian menyarankan agar PNS yang ingin berpoligami harus mematuhi persyaratan yang ditentukan oleh undang-undang dan peraturan yang berlaku, serta berlaku adil terhadap istri-istri mereka, sesuai dengan ajaran Islam dan ketentuan hukum yang ada.

Abstract

This study conducts an epistemological analysis of the jurisprudential reasoning (fiqh) of KH. Abdul Ghofur, a charismatic Islamic scholar from Lamongan widely recognized as a reformist figure in contemporary Islamic thought. His notable contribution lies in the effort to integrate social, humanitarian, and economic values into a dynamic and solution-oriented framework of Islamic law. Employing the maqāṣid al-syarī'ah approach, this research focuses on re-examining the intellectual framework of KH. Abdul Ghofur in the context of reconstructing Islamic law to be more contextual, adaptive, and responsive to the challenges of modernity and the social changes confronting Muslim societies. This qualitative study employs a library research method, examining KH. Abdul Ghofur's writings, speeches, and social practices in conjunction with classical and modern Islamic legal theories. A descriptive-analytical approach is applied to uncover the structure of his jurisprudential thinking, which emphasizes the balance between normative texts and social contexts. The findings reveal that KH. Abdul Ghofur's jurisprudential reasoning does not solely rely on formal legalistic interpretations of texts but is firmly rooted in the ethics of public welfare (maṣlaḥah 'āmmah) as the core of maqāṣid al-syarī'ah. Consequently, his thought can be categorized as a model of social jurisprudence (fiqh ijtimā'ī) that prioritizes substantive justice and advocates for the welfare of the Muslim community. This thinking demonstrates significant relevance to efforts at re-actualizing Islamic law to address the socio-economic challenges facing the community in a transformative and sustainable manner.

Abstract

Phenomenon wedding early in Bluri Village, District Solokuro, Lamongan Regency, reflects reality social where tradition matchmaking and pressure economy Still become factor dominant in determine age marriage. Research This aim For analyze background behind social, views figure society, as well as implications law and religion of practice wedding early consequence parental coercion. Approach used is qualitative descriptive with method interviews, observations, and documentation. Research results show that practice wedding early in Bluri Village driven by four factor main, namely economy, tradition matchmaking, low education, and moral concerns. Although public look at wedding as form not quite enough responsibility and honor, in a law practice This contradictory with Constitution Number 16 of 2019, as well as religiously not reflect principle ridha ( willingness ) and the benefits that arise base wedding in Islam. Therefore that, is necessary effort awareness proportional law and religious education For prevent occurrence wedding children under future age.
