Abstract

Bullying crime is a crime against humanity, it is a violation of human rights, a crime of bullying is an action taken because of an imbalance in the strength of the victim there are four elements in the crime of bullying, an element of power imbalance, imbalance to hurt (desire to heart), an existence threat, terror. There are several factors that cause children to commit bullying crimes including the influence of internal factors and extraterrestrial factors. In the view of Islam, bullying is an act that is prohibited by religion, because it contains elements of humiliating other people, and makes them feel wronged, children as perpetrators of bullying according to the child protection law and the juvenile justice system can be used. criminal sanctity as adults, Islam itself is very concerned about children, the rights of children in detail in Islam, so it is impossible for children who get a good education from parents, according to Islamic teachings are able to commit crimes, for that in Islam's view a child who commits a crime bullying cannot be sanctioned until they are of age

Abstract

The Indonesian nation has the motto bhineka tunggal ika, different but still one, a country that has religious diversity, ethnicity, skin color, and language. With the uniqueness and specialty of the Indonesian nation as plural and sovereign nation, the value of the unity of the Republic of Indonesia, must be instilled in every citizen. To maintain harmonization against existing differences, especially religious differences, it must be planted with moderate attitudes. As a country with a Muslim-majority population, tolerance must be forward so that there is no action that leads to the division of the nation. With the expectation of cases of violence that in the name of religion must immediately get attention and the concept of religious moderation is expected to be the right solution. Moderation of Beragama does not make weak in religion and the practice of religion, because religious moderation remains guided by the Qur'an and hadith, as well as recognized schools. in Indonesia. As a legal country, Indonesia has an obligation to maintain the unity of the Republic of Indonesia (NKRI) state, through positive law in Indonesia. In religious moderation, believers should not extremely practice religious teachings but must always find common ground. One of the principles of religious moderation is to find common ground by embracing and protecting extreme groups, happiness, and positive laws in the world. Indonesia adopts the principle of moderation through the concept of deradicalization because basically terrorism originated from radicalization, so the deradicalization program is an effort to fight terrorism effectively. As stipulated in law No. 5 of 2018 on combating terrorism crimes, to neutralize radical understanding through the concept of deradicalization.

Abstract

The phenomenon of children as perpetrators of crimes, is increasing and in children's courts, when children commit criminal acts, the system of restorative justice applies as in criminal law, while children are valuable assets, for parents, families and the state, The purpose of the research is to find out whether the concept of restorative justice does not contradict Islamic values and local wisdom, the research is a normative research with a legal and conceptual approach, The results of the study show that the concept of restorative justice as an action that is very appropriate to be applied to child offenders, considering that children are the shoots of the nation that must be maintained as the next generation of the nation in addition to the philosophical value The concept of restorative justice has long been applied in solving every problem in the majority Muslim society in Indonesia.
