Abstract

Disahkannya Perpres No. 191 Tahun 2014 tentang Penyediaan, Pendistribusian dan Harga Jual Eceran Bahan Bakar Minyak pada 31 Desember 2014 lalu menandakan komitmen Indonesia dalam mengurangi penggunaan energi tak ramah lingkungan. Perpres No. 191 Tahun 2014 ini membatasi pendistribusian Premium untuk wilayah yang menghasilkan gas buang kendaraan bermotor dengan jumlah besar seperti Jawa dan Bali. Namun, pada 24 Mei 2018 lalu, Presiden Jokowi mengesahkan Perpres No. 43 Tahun 2018 yang kembali mewajibkan pendistribusian Premium di wilayah Jawa dan Bali. Rencana ini bertentangan dengan komitmen Indonesia dalam mengimplementasikan baku mutu emisi gas buang Euro 4 yang diadopsi melalui Permen LH No. 20 Tahun 2017 tentang Baku Mutu Emisi Gas Buang Kendaraan Bermotor Tipe Baru Kategori M, N, dan O. Artikel ini mengaplikasikan metode penelitian audit kebijakan. Simpulan dari artikel ini adalah evidence-based policy making tidak diimplementasikan dalam perumusan Perpres No. 43 Tahun 2018. Meskipun bukti ilmiah menunjukkan bahwa Premium tidak memenuhi standar Euro 4, Pemerintah tetap bersikeras mewajibkan kembali pendistribusian Premium di wilayah Jawa dan Bali.

Abstract

The problem of outsourcing workers extends to the tourism industry. The unique challenge of 'seasonality' makes it more difficult to protect the outsourcing workers' legal rights in the said sector. The research examines the outsourcing regulation in Indonesia by referring to the Job Creation Law, by questioning whether the existing regulations provide prominent legal protection for outsourcing workers, especially in tourism sectors, and how the future law allows for improved protection. The research method used is normative legal research with statutory and legal conceptual approaches. The results of the study show that the amendment of the Manpower Law incorporated into the Job Creation Law and its implementing legal instruments significantly changed outsourcing regulation. As the Job Creation Law has abolished Article 64 of the Manpower Law, the scheme established by the Constitutional Court to prevent companies from exploiting workers in their decisions has become vague in the Job Creation Law. Following global practices, the country can implement a flexible workers policy while simultaneously protecting their rights which Indonesia must adopt.Keywords: Outsourcing, Rights Protection, Tourism Business.

Abstract

In the Political advertising, and the AdTech industry that powers it, have been raising concerns about data protection, potential manipulation, and selective information exposure to voters in the European Union. Against this backdrop, this article aims to answer the following question: What are the human rights implications of political advertising, and to what extent does the European Union’s regulatory framework address these problems? Research method applied in this article is normative legal research, using a combination of statutory and critical analytical approach. In conclusion, sectoral regulations in the election and political advertising, strengthened by comprehensive data protection regulations, are essential to mitigate the harm political advertising on online platforms causes.

Abstract

This article aims to discuss further the importance of the characteristics of non-litigationdispute resolution through mediation in resolving industrial relations disputes. Thisresearch is descriptive with a normative research type, using a statutory approachand data collection using literature study, then the data is analyzed qualitatively. Theresults obtained from this research are that each type of dispute resolution has itscharacteristics. One of the main reasons why disputes cannot be resolved througharbitration is limited authority. Apart from that, the lack of information, abilities,and knowledge of the parties regarding conciliation and negotiation is the cause ofthese problems. Therefore, mediation is chosen due to its distinctive characteristicscompared to other non-litigation resolutions, such as the mediator's role in assistingthe parties, the absence of decision-making authority, the mediation process focusingon the future, and fostering the creation of win-win solutions.

Abstract

This study aims to identify, locate, and analyze constitutional issues regarding the impact of foreign capital ownership above 50% (fifty percent) in government-business cooperation projects, particularly in the area of public interest projects involving air transportation infrastructure. This normative research examines legal texts, mainly primary and secondary legal materials. This research found that, first, the changes in the Presidential Regulation regarding foreign investment in the field of public interest, such as airport services, were incompatible with the Constitution. The changes abolished the maximum percentage limit of foreign investment regulated in the previous provisions so that currently, foreign investment may carry out Government Cooperation with Business Entities on air transportation infrastructure projects without a percentage limit. Second, based on the Indonesian Constitution, ownership of air transportation should be under the state's authority, learning from China, which excessively applies foreign investors in the air transportation sector, causing consumer welfare to be affected by very high airplane ticket prices.
