Abstract

It is likely not easy to categorize IPR as human right. Based on the human right test and positivism approach, can be categorized into three schemes. : First, IPR is not human rights but it is under purely the dimension of law.  Second, some aspects of IPR have potential conflict with human rights. Third, IPR is human rights by emphasizing property rights and individual rights. The relevancy between IPR and the second generation of human rights can be considered based on Article 27.2 UDHR, Article 15 ICESCR and it General Comment No. 17 that  emphases the recognition and protection of art and literary works. Abstract

The users of electronic service provider often suffered losses caused by internet services did not work properly including losses due to leakage of personal data protection stored in cloud computing.  The study aims to examine electronic service provider liability upon their failure performing internet services properly and security attacks on cloud computing. This study was normative legal research by examining national and international legal materials. The finding shows that the electronic provider shall be responsible based on right and obligation agreed under the agreement.  Related to cloud computing, providing adequate security to avoid security attacks and misuse of private data that caused losses to the users becoming the liability of service provider. Based on the Federal Trade Commission Act, the liability arises on the grounds of deceptive and unfair trade practices.  Under the General Data Protection Regulation of the European Union, the liability arises on the basis as the controller then provider liable for compensation for user’s suffered damage. In Indonesia, based on the Electronic Information and Transaction Law Amendment, the liability to the owner of personal data whose rights are violated and suffered losses arises due to a failure of ISP protect the data security. For better protection in Indonesia, the protection of big data and clear territorial scope of protection become necessary to consider.

Abstract

Traditional Cultural Expressions have basically been protected through national law, but in their regulation traditional food is not included as part of Traditional Cultural Expressions even though traditional food is one of Indonesia's traditional cultures that also characterizes the Indonesian Nation. For this reason, it is important to study the norms that occur in this study. The purpose of this study is to analyze the traditional food protection arrangements as traditional cultural expressions and the legal consequences that will occur if a traditional food is not listed as part of traditional cultural expressions. The method in this study uses a type of normative juridical legal research with a statute approach that focuses on the study of statutory regulations regarding legal issues in this study. The sources of legal materials in this study consist of primary, secondary, and tertiary legal materials. The results of this study indicate that traditional food regulation has not been regulated as Traditional Cultural Expressions in the law in force in Indonesia precisely in Law No. 28 of 2014 concerning Copyright. The absence of arrangements related to traditional food as Traditional Cultural Expressions results in foreign parties or other countries easily recognizing the tradition, so it is necessary to regulate traditional food as Traditional Cultural Expressions.

Abstract

ABSTRAK Tujuan dari studi ini adalah untuk mengetahui bentuk tanggungjawab pelaku usaha terhadap kerugian yang dialami konsumen yang diakibatkan oleh pembelian masker bekas pakai serta memberikan informasi kepada pembaca mengenai upaya-upaya yang dapat dilakukan agar bisa mencegah terjadinya penjualan masker bekas pakai. Studi ini menggunakan metode penelitian hukum normative-informatif. Hasil dari studi menunjukkan bahwa pelaku usaha bertanggung jawab untuk mengganti kerugian dengan cara pengembalian uang maupun barang yang digantikan dengan barang sejenis yang nilainya setara dengan perawatan kesehatan maupun pemberian santunan. Upaya yang dapat dilakukan untuk mencegah penjualan masker bekas pakai antara lain yang pertama, upaya pemerintah dalam menjalankan tugasnya untuk membina serta mengawasi setiap peredaran barang yang diedarkan oleh pelaku usaha, yang kedua masyarakat harus lebih berhati-hati dalam membeli masker agar tidak mendapatkan masker begas pakai dengan cara membedakan yang mana masker baru dan yang mana masker bekas pakai. Dan yang ketiga setelah memakai masker diharapkan untuk merusak masker yang telah dipakai dengan cara merobek ataupun menggungting-guntig masker lalu dibuang ke dalam tempat sampah. Ada 3 cara untuk memastikan msker yang di beli masih baru, 3 cara itu antara lain yang harus dipastikan pertama kali adalah merek yang berada di boks dengan masker yang ada didalamnya sama, lalu adanya izin edar pada boks kemasan dan yang terakhir ada tidaknya bagian fisik masker yang kotor. Kata Kunci: Tanggung Jawab, Pelaku Usaha, Masker Bekas Pakai, Konsumen ABSTRACT The purpose of this study is to know the form of responsibility of businesses to the losses suffered by consumers caused by the purchase of used masks and provide information to readers about efforts that can be made in order to prevent the sale of used masks. This study uses normative-informative legal research methods. The results of the study show that businesses are responsible for reimbursing losses by way of refunds and goods replaced with similar goods whose value is equivalent to health care and compensation. Efforts that can be made to prevent the sale of used masks include the first, the government's efforts in carrying out its duties to foster and supervise every circulation of goods circulated by businesses, the second public should be more careful in buying masks so as not to get a disposable gas mask by distinguishing which masks are new and which masks are used. And the third after wearing the mask is expected to damage the mask that has been used by ripping or shaking the mask and then thrown into the trash. There are 3 ways to make sure the purchased msker is new, 3 ways that must be ensured first is the brand that is in the box with the mask in it is the same, then the circulation permit on the packaging box and the last there is not a physical part of the mask that is dirty. Abstract

ABSTRAK Tujuan dari penulisan artikel ini untuk mengetahui pengaturan mekanisme pembayaran royalti melalui Lembaga Manajemen Kolektif terkait cover lagu di Situs Youtube serta upaya hukum yang dapat dilakukan dalam hal terjadi pelanggaran hak cipta lagu di media sosial. Metode penelitian yang digunakan dalam tulisan ini adalah penelitian hukum normatif yaitu dengan mengkaji Peraturan Perundang-undangan dan bahan literatur yang berkaitan dengan pokok bahasan dengan analisis konsep hukum. Hasil studi menunjukkan bahwa dalam hal cover lagu tidak dikategorisasikan pelanggaran jika mendapatkan ijin dari pencipta berdasarkan pasal 80 Undang-Undang Nomor 28 Tahun 2014 Hak Cipta, pencipta memiliki hak ekslusif berupa hak ekonomi dan hak moral atas karya cipta lagunya. Mekanisme izin diikuti dengan pembayaran fee melalui mekanisme peranan Lembaga Manajemen Kolektif kepada pemegang hak cipta berdasarkan pasal 87 Undang-Undang Nomor 28 Tahun 2014 Hak Cipta. Upaya hukum atas pelanggaran hak cipta berupa Cover Lagu tanpa ijin pencipta dapat melalui jalur litigasi dan non litigasi. Kata Kunci: Hak Cipta Lagu, Cover Lagu, Royalti, Lembaga Manajemen Kolektif, Youtube ABSTRACT The purpose of this article is to ensure management through a Collective management system regarding song covers on the Youtube Site and legal remedies that can be taken in the event of song copyright on social media. The research method used in this paper is normative legal research, namely by examining the invitation regulations and literature materials related to the subject matter with the analysis of legal concepts. The results of the study show that in terms of song covers are not categorized if they get permission from the creator based on Article 80 of Law No.28 of 2014 Copyright, the creator has exclusive rights in the form of economic rights and moral rights to the song's copyright. The permit mechanism follows the payment of fees through Collective Management institutions to copyright holders based on Article 87 of Law Number 28 of 2014 Copyright. Legal remedies for copyright in the form of cover songs without the author's permission can be through litigation and non-litigation channels. Abstract

ABSTRAK Penelitian ini bertujuan untuk mengkaji standar keamanan operasional jasa bank yang dapat menimbulkan kerugian bagi nasabah dan tanggung jawab bank berkaitan dengan kerugian nasabah atas hilangnya uang nasabah yang tersimpan dalam tabungan pada suatu bank. Metode yang dipergunakan adalah jenis penelitian normatif dengan pendekatan perundang-undangan khususnya hukum perbankan. Hasil studi menunjukkan bahwa sistem standar keamanan bank yang kurang maksimal memungkinkan terjadinya skimming, phising, system error, atau human error yang dapat merugikan nasabah penyimpan.Perlindungan hukum terhadap Penabung berkaitan dengan dana simpanannya di bank dapat mengacu pada UU Perlindungan Konsumen,Peraturan BI No. 16/1/PBI/2014 tentang Perlindungan Konsumen Jasa Sistem Pembayaran dan Peraturan OJK Nomor 1/POJK.07/2013 tentang Perlindungan Konsumen Sektor Jasa Keuangan, serta Pasal 1365 KUHPer.Pihak Bank wajib bertanggungjawab pada nasabah penyimpan dalam hal kerugian nasabah disebabkan oleh pihak Bank. Penyelesaian sengketa kerugian nasabah dapat ditempuh melalui dua proses yaitu mekanisme persidangan(litigasi) dan mekanisme diluar persidangan (non litigasi). Kata Kunci: Tanggung Jawab Bank, Nasabah Penyimpan, Perlindungan Konsumen, Human Error, Sistem Error ABSTRACT This study aims to review the operational security standards of bank services that can cause losses to customers and bank responsibilities related to customer losses for the loss of customer's money stored in savings at a bank. The method used is a type of normative research with a statutory approach, especially banking law. The results showed that the bank's lack of maximum security standard system allows for skimming, phishing, system error, or human error that can harm storage customers. Legal protection of depositoment customers in connection with their deposits in banks may refer to Law No. 8 of 1999 on Consumer Protection, Bank Indonesia Regulation Number 16/1/PBI/2014 concerning Consumer Protection of Payment System Services and Regulation of the Financial Services Authority Number 1/POJK.07/2013 concerning Consumer Protection of Financial Services Sector, as well as Article 1365 of the Civil Code. The Bank shall be responsible to the depositoment customer in the case of customer losses caused by the Bank. Settlement of customer loss disputes can be reached through two process, there are judicial or litigation mechanisms and non-judicial or non-litigation mechanisms. Abstract

Automated Taller Machine (ATM), is one of the banking products to facilitate customers in financial transaction. However, on the other hand the customer as an ATM product user, may experience losses due to damage of the ATM machine. Any utilization of product and services that offered by the bank, the customer have to follow all of the regulation that only determined by the bank. Therefore, this scription will explain about costumer protection as an ATM user, as well as the responsibility of the bank against losses suffered by the customer due to damage to the ATM machine.

Abstract

Keberadaan konten karya intelektual seperti lagu banyak disebarluaskan melalui transaksi elektronik oleh suatu entitas dengan merek tertentu. Spotify adalah salah satu entititas yang menawarkan akun premium yang menyediakan layanan streaming musik digital, podcast, serta video yang menyediakan jutaan lagu dan konten lain dari berbagai artis di seluruh dunia berbasis perjanjian lisensi. Namun, kecanggihan teknologi mempermudah konten premium tersebut diperjualbelikan melalui e-commerce. Penelitian ini mengkaji model perjanjian yang melandasi perlindungan penyebaran konten kekayaan intelektual serta potensi pelanggarannya. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan pendekatan perundang-undangan dan konsep. Hasil studi menunjukkan bahwa model perjanjian yang melandasi penyebarluasan konten karya intelektual dalam transaksi e-commerce adalah perjanjian lisensi. Keberadaan perjanjian lisensi memberikan hak kepada pihak yang melesinsi untuk menggunakan dan mendapat perlindungan terkait penggunaan hak ekonominya. Penjualan dan penyebarluasan akun premium milik suatu entitas tertentu melalui situs belanja online atau e-commerce oleh pihak yang tidak memiliki lisensi dengan menggunakan merek tertentu seperti Spotify dapat dikategorikan sebagai pelanggaran atas merek. Entitas yang dirugikan dengan perbuatan penggunaan suatu merek tanpa izin, termasuk sebagai pemegang Hak Cipta atas lagu dapat mengajukan gugatan pelanggaran merek dan pelanggaran Hak Cipta.

Abstract

Sengketa kepailitan merupakan sengketa yang disidangkan pada Pengadilan Niaga. Peraturan Mahkamah Agung No. 1 Tahun 2016 tentang Prosedur Mediasi di Pengadilan mengatur bahwa sidang yang pemeriksaannya di pengadilan Niaga di kecualikan dari mediasi. Demikian juga pada undang-undang kepailitan tidak mengatur mediasi. Tujuan dari studi ini adalah untuk membahas pengaturan kepailitan di Indonesia serta relevansi dari penggunaan model mediasai dalam penyelesaian sengketa kepailitan. Jenis penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan, analisis, konsep dan pendekatan kasus. Hasil studi menunjukan bahwa sengketa kepailitan relevan diselesaikan dengan prosedur mediasi dengan syarat penyelesaian sengketa tersebut dikehendaki dan menguntungkan para pihak. Hal ini telah diterapkan dalam sengketa kepailitan yang diselesaikan dengan mediasi pada Penetapan Pengadilan Niaga Surabaya Nomor 07/Pailit/2014.Pn.Niaga.Sby.
