Abstract

Climate change has always been a major issue and a long discussion in the international community. One of the tangible manifestations of climate change is rising sea levels. Sea level rise also has a significant impact on small island countries or micro-countries which are geographically small and have very low land elevations. The impact of sea level rise will pose a threat that is quite dangerous for the existence of a small island nation like the Maldives. This article applies normative legal research methods using a conceptual approach, cases and regulations. This study aims to examine the implications of sea level rise on the Maldives perspective and provide options in the form of legal construction to solve this problem. This research  found that The UNCLOS does not provide explicit reference against the sea-level rise effected by climate change. However, International community have been making progress to address this issue with a numbers of conferences. This study suggest that The Maldives government should have maximized the implementation of its laws and regulation to mitigate air space pollution coming from GHG Emission. The consistency of its  implementation is the important key to mitigate the impact of this sea level rises.

Abstract

Cyber warfare terhadap Ukraina mengakibatkan melemahnya kemampuan pemerintah dan militer untuk berkomunikasi serta beroperasi, akibatnya legitimasi dan otoritas institusi politik dan militer Ukraina ikut terdampak. Tujuan penelitian ini untuk mengetahui pengaturan tentang cyber warfare dalam konflik bersenjata menurut hukum humaniter internasional dan analisis pertanggungjawaban hukum terhadap Rusia yang telah melakukan cyber warfare. Metode penelitian yang digunakan adalah yuridis normative. Spesifikasi penelitian dalam penelitian ini adalah deskriptif analitis. Penelitian ini menggunakan jenis data sekunder. Hasil penelitian yang telah dilakukan didapati hasil bahwa pengaturan tentang Cyberwarfare dalam konflik bersenjata menurut Hukum Humaniter Internasional didasarkan pada Pasal 22 dan Pasal 23 Konvensi Den Haag 1907, Pasal 35 dan 36 Protokol I/1977, dan Konvensi Senjata termasuk Tallinn Manual on the International Law Applicable to Cyber Warfare (“Tallinn Manual 1.0”). Pertanggungjwaban hukum terhadap Rusia didasarkan pada Konvensi Jenewa 1949 di mana Rusia sebagai anggota PBB telah meratifikasi konvensi ini.

Abstract

Marine pollution has a significant impact on the waters of the coastal states, especially in the strait routes used for international trade. The traffic density of large ships which is not proportional to the wide geographical conditions, makes the Strait of Malacca a potential area that is prone to high marine pollution. This article aims to examine the use of the Marine Electronic Highway in the Malacca Strait and the success story which is applied to the territorial waters of other countries that have the same conditions. The results of the study show that in the Dover strait region, the French and British Governments are collaborating by investing in infrastructure to regulate the navigation of these areas. Meanwhile, at The Torres Straits, the Australian Government implemented a Pilotage policy by requiring ships passing through to pay a maintenance fee of 3% for the conservation of the waterways and security zones. However, the Indonesian and Malaysian governments had to negotiate beforehand to determine the delimitation of their respective maritime boundaries in Malacca Straits.
