Abstract

Marriages can be annulled when they do not comply with the provisions of the Marriage Law. Parties involved in a marriage can request an annulment of the marriage because there was a misunderstanding in the form of identity falsification or unrecorded polygamy, for example in Decision Number 2479/Pdt.G/2020/PA.JU. This lawsuit was filed by the first wife to annul the marriage between the second wife and her deceased husband whose marriage had been broken up due to death. The issue lies in the legitimacy of filing for an annulment of a marriage that has ended due to death and the legal consequences of the decision in this case. This study utilized the Normative Juridical method by examining literature studies. The results of the study indicate that the basis for the annulment proposed by the plaintiff is valid based on three articles: Article 27 paragraph (2) and Article 24 of the Marriage Law, as well as Article 71 letter a Compilation of Islamic Law. There are two legal consequences resulting from this decision, the husband and wife relationship, and joint assets.

Abstract

This study is to determine what kind of efforts are obtained legally against bank customers in bad credit problems during the pandemic and whether execution is a final solution in a bad credit problem, using normative legal research methods, it was concluded that the protection of debtors who have access to credit facilities during the Covid-19 pandemic includes; First, the government issued a policy in the form of Presidential Regulation No. 12 of 2020, which concerns the determination of Corona virus disease in natural disasters nationally in 2019. The spread of natural disasters (Covid-19). Regulation of the Financial Services Authority of the Republic of Indonesia Number 11/POJK.03/2020, . regarding the impact of the national economic stimulus counter cyclical policy on the spread of the corona virus disease in 2019, by itself Law No. 8 of 1999 Consumer legal protection, including debtors, is guaranteed according to the provisions. 2. The bank's actions in assisting the settlement of bad loans during the Covid-19 pandemic have several stages, so legal protection to debtors applies, so banks do not necessarily execute debtors' collateral or guarantees. However, banks provide settlement solutions to bad debtors so that the ability to pay the stuck debtors will slowly return to normal during this pandemic, so that the bad collectibility can become smooth, namely through the Restructuring process.

Abstract

Buy back guarantee adalah jaminan membeli kembali yang terdapat di dalam perjanjian jual beli yang lahir dari adanya asas kebebasan berkontrak. Dalam pelaksanaannya buy back guarantee dapat dilihat pada perjanjian antar bank dengan Perusahaan Pembangunan Rumah (developer) pada Kredit Pemilikan Rumah (KPR). Penelitian ini bertujuan untuk mengetahui dan mendalami mengenai pengaturan dan legalitas perjanjian buy back guarantee sebagai bentuk jaminan dalam KPR antara bank dengan developer serta tanggung jawab developer pada user (nasabah) dan bank terkait buy back guarantee pada KPR. Penelitian ini menggunakan metode pendekatan Yuridis-Normatif yang bersifat preskriptif. Hasil penelitian ini ialah legalitas perjanjian buy back guarantee antara bank dengan developer dilakukan berdasarkan asas kebebasan berkontrak dan konsensualisme di mana para pihak dibebaskan untuk menyepakati isi perjanjian dan objek perjanjian sesuai dengan kebutuhan dan kesepakatan bersama sepanjang tidak bertentangan dengan undang-undang yang berlaku. Sedangkan pertanggung jawaban developer pada KPR didasari adanya perjanjian dengan bank dan user.

Abstract

Climate change has always been a major issue and a long discussion in the international community. One of the tangible manifestations of climate change is rising sea levels. Sea level rise also has a significant impact on small island countries or micro-countries which are geographically small and have very low land elevations. The impact of sea level rise will pose a threat that is quite dangerous for the existence of a small island nation like the Maldives. This article applies normative legal research methods using a conceptual approach, cases and regulations. This study aims to examine the implications of sea level rise on the Maldives perspective and provide options in the form of legal construction to solve this problem. This research  found that The UNCLOS does not provide explicit reference against the sea-level rise effected by climate change. However, International community have been making progress to address this issue with a numbers of conferences. This study suggest that The Maldives government should have maximized the implementation of its laws and regulation to mitigate air space pollution coming from GHG Emission. The consistency of its  implementation is the important key to mitigate the impact of this sea level rises.

ABSTRACTIn the digital era, mobile banking become the main choice for urban communities; Even though it practical, but it’s threaten by fraudsters such as SIM card swabs; This research aim to examine legal regulations related to transactions via mobile banking and protection steps from banks and telecommunications companies to protect mobile banking users; This research uses a normative juridical method, then analyzed qualitatively and conclusions drawn by deductive method; Even though it has not been regulated in Banking Law no. 7 of 1992, but the OJK has issued POJK which regulates banking digitalization in detail; Meanwhile, the Telecommunications Law has regulated the protection of consumers who use telecommunications facilities via SIM cards; Banks and telecommunications companies have both taken protection step for their users.Keywords: Consumer Protection; Mobile Banking; SIM Card SwabABSTRAKDi era digital, transaksi melalui mobile banking menjadi pilihan utama masyarakat urban; Meskipun memudahkan transaksi, pembayaran melalui sistem perbankan memiliki celah yang dapat dimanfaatkan oleh fraudster salah satunya melalui SIM card swab; Tujuan penelitian ini untuk mengkaji peraturan hukum terkait transaksi melalui mobile banking dan langkah apa yang telah dilakukan perbankan dan perusahaan telekomunikasi untuk melindungi pengguna mobile banking; Penelitian ini menggunakan metode yuridis normatif, yang kemudian dianalisis secara kualitatif dan ditarik kesimpulan mengunakan metode deduktif; Meskipun belum diatur dalam Undang-Undang Perbankan No. 7 tahun 1992, namun OJK telah mengeluarkan POJK yang mengatur terkait digitalisasi perbankan ini secara rinci; Sementara itu, Undang-Undang Telekomunikasi telah mengatur terkait perlindungan konsumen pengguna sarana telekomunikasi melalui SIM card; Perbankan dan perusahaan telekomunikasi sama-sama telah melakukan langkah perlindungan bagi pengguna mobile banking.Kata Kunci: Perlindungan Konsumen; Mobile Banking; SIM Card Swab

Abstract

The blue economy is an emerging concept that emphasizes the protection of marine life and ecosystems while promoting economic growth through the sustainable utilization of ocean resources. This principle is gaining increasing traction among ASEAN member states. Strategically positioned geographically, these nations possess significant potential to leverage their marine resources. However, disparities in technological capabilities and human resources continue to hinder the optimal utilization of these resources across the region.This paper identifies and analyzes the challenges and opportunities faced by ASEAN member states in implementing the blue economy within their respective territories and across the region. It also offers a new and in-depth perspective by examining Indonesia’s pivotal role during its ASEAN Chairmanship in advancing the blue economy agenda. Indonesia’s efforts go beyond merely emphasizing the importance of the blue economy; they also include strategic initiatives to promote cooperation, knowledge sharing, and the development of robust legal frameworks within ASEAN to foster sustainable marine governance and resource management.Indonesia’s leadership presents a unique opportunity to address critical issues and to catalyze the expansion of the blue economy in Southeast Asia, ensuring sustainable development and a balanced approach to the utilization of marine resources

Abstract

One of the legal consequences of marriage is related to the status and position of the child born. If a child is born out of wedlock, then the child is considered a child out of wedlock. A child out of wedlock can be legalized as a legitimate child if the parents submit an application for validation of the child's recognition to the Court. The purpose of this study was to find out the basis for the judge's consideration of the decision of the Salatiga District Court Number 24/Pdt.P/2021/PN Slt after the validity of the Constitutional Court decision Number 46/PUU-VIII/2010 and the legal consequences of the decision of the Salatiga District Court Number 24/Pdt. P/2021/PN Slt on the ratification of children out of wedlock. The research method used in this research is normative juridical legal research which is descriptive-analytical by using secondary data sources and supported by primary data to strengthen the research results. Data analysis was carried out using qualitative analysis methods. The results of the study show that  The judge's considerations in determining Number 24/Pdt.P/2021/PN Slt are in accordance with the laws and regulations in force in Indonesia, especially Law Number 24 of 2013 concerning Population Administration and Presidential Regulation Number 96 of 2018 Concerning Requirements and Procedures for Civil Registration and Registration. 2. With the granting of the stipulation, the Petitioner can use a copy of this stipulation to register the registration of the validation of his child's recognition at the Salatiga City Population and Civil Registration Service.
