Abstract

Terorisme sebagai bentuk kejahatan yang melibatkan kekerasan memiliki ciri dan karakter yang berbeda dibandingkan dengan kejahatan pada umumnya. Ancaman terorisme bukan hanya masalah satu negara atau wilayah tertentu, melainkan merupakan ancaman berskala global. Terorisme termasuk dalam kategori kejahatan yang tidak dapat dianggap sebagai kejahatan biasa. Secara akademis, terorisme diklasifikasikan sebagai kejahatan luar biasa atau extraordinary crime dan juga digolongkan sebagai kejahatan terhadap kemanusiaan atau crime against humanity. Rumusan dalam penelitian ini yaitu bagaimana penerapan hukum Pidana Bagi Pelaku Tindak Pidana Terorisme? Dan bagaimanakah analisa pertimbangan hukum Hakim Pengadilan Negeri Jakarta Utara dalam menjatuhkan putusan terkait tindak pidana terorisme dalam putusan nomor 1108/Pid.Sus/2020/PN Jkt.Utr?. Metode penelitian yang dilakukan dalam penelitian ini adalah metode penelitian yuridis normatif. Pendekatan yuridis normatif adalah pendekatan yang dilakukan berdasarkan bahan hukum utama dengan cara meneelah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Hasil penelitian diantaranya yaitu bahwa berkaitan dengan penerapan hukum terhadap tindak pidana terorisme tertuang dalam ketentuan Pasal 6 Undang-Undang Nomor 15 Tahun 2003 Tentang Pemberantasan Tindak Pidana Terorisme bahwa setiap orang yang dengan sengaja menggunakan kekerasan atau ancaman kekerasan menimbulkan suasana teror atau rasa takut terhadap orang secara meluas atau menimbulkan korban yang bersifat massal, dengan cara merampas kemerdekaan atau menghilangkan nyawa dan harta benda orang lain atau mengakibatkan kerusakan atau kehancuran terhadap obyek-obyek vital yang strategis atau lingkungan hidup atau fasilitas publik atau fasilitas internasional dipidana dengan pidana mati atau penjara seumur hidup atau pidana penjara paling singkat 4 (empat) tahun dan paling lama 20 (dua puluh) tahun. Berdasarkan penjelasan pasal 15 jo. 6 Peraturan Pemerintah Pengganti Undang-Undang (Perpu) No. 1 Tahun 2002 tentang Pemberantasan Tindak Pidana Terorisme, bentuk penyertaan yang masuk kedalam pasal ini adalah bentuk penyertaan dalam jenis pembantuan.

Abstract

Kasus penyalahgunaan narkoba terus terjadi di Indonesia, narkoba terus menghantui siapapun, tidak pandang usia dan kalangan tertentu. Menurut Undang-Undang No. 35 Tahun 2009 tentang Narkotika pasal 1 ayat 1 menyatakan bahwa narkotika merupakan zat buatan atau pun yang berasal dari tanaman yang memberikan efek halusinasi, menurunnya kesadaran, serta menyebabkan kecanduan. Undang-Undang No. 35 Tahun 2009 tentang Narkotika mengatur sanksi bagi penyalahgunaan narkoba serta pengedar narkoba didasarkan pada golongan, jenis, ukuran dan jumlah narkotika. Rumusan dalam penelitian ini yaitu bagaimana Penerapan Hukum Terhadap Pelaku Tindak Pidana Penyalahgunaan Narkotika dan bagaimana Analisa pertimbangan hakim dalam menjatuhkan putusan 369/Pid.Sus/2024/PN Jkt.Utr terkait dengan penyalahgunaan narkotika. Metode penelitian yang digunakan dalam penelitian ini yaitu pendekatan yuridis normatif adalah pendekatan yang dilakukan berdasarkan bahan hukum utama dengan cara menelaah teori-teori, konsep-konsep, asas-asas hukum serta peraturan perundang-undangan yang berhubungan dengan penelitian ini. Kesimpulan dari penelitian ini yaitu ketentuan hukum bagi pelaku penyalahgunaan narkotika telah dituangkan dalam pasal 111 sampai dengan Pasal 148 Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Pertama, sanksi pidana mati diatur dalam Pasal 116 ayat (2), Pasal 119 ayat (2) dan Pasal 121 ayat (2). Kedua, hukuman pidana penjara terdapat dalam pasal 111 sampai Pasal 148). Ketiga, hukuman pidana kurungan sebagaiman diatur dalam Pasal 128. Dan Keempat yaitu hukuman pidana denda tertuang dalam pasal 111 sampai Pasal 148). Kelima, Pidana juga dapat dijatuhkan pada korporasi yakni berupa pencabutan izin usaha; dan/atau. pencabutan status badan hukum sebagaiman dinyatakan dalam Pasal 130. Dan yang terakhir hukuman dalam bentuk rehabilitasi Medis dan Sosial yang dijelaskan dalam pasal 54 sampai Pasal 59 Pasal 103 ayat (1) dan ayat (2) dan Pasal 127. Dasar pertimbangan hakim Pengadilan Negeri Jakarta Utara dalam menjatuhkan putusan nomor 369/Pid.Sus/2024/PN Jkt.Utr dengan pidana penjara selama 8 (delapan) tahun denda sebesar Rp1.000.000.000,- (satu miliar rupiah), dengan ketentuan apabila denda tersebut tidak dibayar, maka diganti pidana penjara selama 1 (satu) tahun. Penjatuhan hukuman tersebut didasarkan pada terpenuhinya pasal yang didakwakan oleh JPU yaitu Pasal 114 ayat (2) Undang-Undang No.35 Tahun 2009 tentang Narkotika dan pertimbangan non yuridis yaitu hal-hal yang memberatkan dan meringankan terdakwa.

Abstract

This study analyzes students’ concept understanding ability on fluid material in Kupang City and Sabu Raijua Regency. Using the descriptive quantitative method, this study involved 332 high school students in grades XI and XII of science specialization in the age range of 14-18 years, with research samples in Kupang City including 91 male students and 160 female students, while samples in Sabu Raijua Regency included 33 male students and 48 female students. The instrument, in the form of 12 multiple-choice questions based on cognitive indicators of understanding (C2), was declared reliable, with Cronbach’s Alpha 0.82 in the outstanding category. The results showed that students in Kupang City had a concept understanding level of 39.54% (less understanding category), lower than students in Sabu Raijua Regency with a percentage of 45.47% (sufficient understanding category). Gender analysis revealed that female students were superior to male students in all indicators, especially in the comparing indicator. However, weaknesses were seen in the summarising and explaining indicators in both regions. Rasch modeling analysis with the help of WINSTEPS showed variations in students’ abilities between the low to sufficient categories. The findings are expected to be a reference for teachers to design contextual, problem-based, and collaborative learning and utilize learning media to improve students’ concept understanding in Physics.

Abstract

This study aims to analyze the impact of implementing the Teams Games Tournaments (TGT) learning model on students' Higher-order Thinking Skills (HOTS) and learning motivation in the context of Global Warming. The research employed a quantitative approach, involving 44 eleventh-grade high school students as participants. Data analysis using the stacking test indicated an average logit increase of 1.40 for HOTS and 1.98 for learning motivation. The effect size analysis revealed a large category (1.63) for HOTS and a medium category (0.59) for learning motivation. Additionally, the implementation of the TGT model achieved an average score of 90% in learning quality assessments, accompanied by highly positive student responses. These findings indicate that the TGT learning model is effective in enhancing students' HOTS and learning motivation, particularly for complex physics topics such as Global Warming. The implications of this study suggest that the TGT model can serve as an innovative pedagogical strategy to foster a dynamic learning environment, support better academic achievement, and increase students' enthusiasm for learning.

Abstract

This research aims to develop an instrument that measures students' critical thinking skills in physics learning to test its validity and reliability using the Rasch Model. The instrument is called the Critical Thinking Test on The Light Waves Concept (CT-LiWa). The novelty of this research is to create a new instrument that is applied to the concept of light waves. The target of this instrument is high school students in one of the provinces in West Java. This research method uses the ADDIE model involving 72 high school students from West Java, Indonesia. The instrument used is a validation sheet and the CT-LiWa consists of 15 items in the form of descriptions. The trial results data were analyzed using the Rasch Model assisted by the Winstep program to obtain the quality of the instrument, namely reliability, validity, and level of difficulty. The results of the analysis show that the CT-LiWa test is not reliable but has a good validity of 27.6% in the fulfilled category with varying levels of difficulty. Therefore, the development of the CT-LiWa test can be implemented as an instruent to measure students' critical thinking skills on the concept of light waves.

Abstract

Grammatical competence remains fundamental to English proficiency assessment, particularly in standardized tests such as the TOEFL ITP. The Structure and Written Expressions (SWE) section consistently challenges EFL learners, yet research has predominantly focused on English language majors, with limited comparative examination of how academic disciplinary background influences grammatical performance and learner perceptions. This mixed-methods study addressed this gap by investigating grammatical difficulties across three academic programs: Tourism Education, Japanese Language Education, and English Language Education. The study examined 163 Indonesian undergraduate students' performance on the TOEFL ITP SWE section and explored their self-perceived competence and test-related challenges. Quantitative data from a 40-item TOEFL SWE test were analyzed using Classical Test Theory and jMetrik software to calculate item difficulty indices. Qualitative data were collected through self-rating questionnaires and focus group discussions with 15 participants. Results revealed systematic performance differences across disciplines, with Tourism and Japanese Language students demonstrating significantly higher error rates than English majors. Six grammatical constructions consistently emerged as problematic: relative adverbs, causal expressions, inverted sentence structures, word forms, parallel structures, and redundancy. Qualitative analysis identified shared challenges including vocabulary limitations, test format unfamiliarity, and time management difficulties. Notably, English students, despite higher performance, showed unexpected weaknesses in error analysis. The findings demonstrate that grammatical performance in standardized contexts results from complex interactions between linguistic competence, test literacy, and academic background.

Abstract

This study aims to examine the influence of family background factors in terms of family wealth and parent education levels on students’ reading performance in Indonesia. The study utilises secondary data from the OECD’s Programme for International Student Assessment (PISA) 2015 for Indonesia, in which 6513 students participated. Moreover, this specifically highlights the analysis of family wealth and parent education levels in possibly predicting the students reading literacy in Indonesia. In analysing the data, a quantitative approach was employed which utilised statistically different analysis namely t-test, one-way ANOVA, two-way ANOVA, correlation and multiple linear regression analysis using WesVar version 5.1 software. The result found there were significant different reading scores between students from different family wealth and parent education levels. The students from high family wealth performed better than they with middle and low wealthy. Likewise, the children with highly educated mother and father had high scores than students whose parents had low and did not complete primary school. Moreover, the result of correlation and regression analysis revealed that all predictor variables, WEALTH, MISCED and FISCED, significantly associate and predict better reading literacy performance of 15-year-old students in Indonesia for PISA 2015 survey. Therefore, the implications of the study highlight opportunities to reform educational policies through data and evidence.

Abstract

The paradigm regarding the structure of state institutions underwent drastic changes since the constitutional reform from 1999 to 2002. For various reasons and needs, new state institutions were formed, although some institutions were abolished. One of the institutions formed is the Constitutional Court. The Constitutional Court is designed to be a guard and at the same time an interpreter of the Constitution through its decisions. In carrying out its constitutional duties, the Constitutional Court seeks to realize its institutional vision, namely the establishment of the constitution in the context of realizing the ideals of a state of law and democracy for the sake of a dignified national and state life. This vision becomes a guideline for the Constitutional Court in exercising its judicial power independently and responsibly in accordance with the constitutional mandate. The Constitutional Court  work since its presence has been considered quite significant, especially in its contribution to maintaining the law and developing democracy

Abstract

AbstrakPerubahan penyelenggaraan pemeritahan daerah dari Sentralisasi ke Desentralisasi sesuai undang-undang no.32 Tahun 2004 daerah diberihak, kewenangan dan tanggung jawab dalam pengelolaan barang milik daerah yang merupakan bagian dari kekayaan negara, untuk diamankan dan dipelihara baik fisik non fisik serta dapat digunakan untuk pelaksanaan tugas dan pelayanan serta dapat menciptaaakan lapangan kerja melalui pihak swasta. Berdasarkan temuan yang dilakukan dalam kontrak/ perjanjian pemanfaatan barang milik daerah dengan pihak laian (swasta) dalam bentuk sewa, kerjasama pemanfaatan, bangun serah guna dan bangun guna serah atas dasar perjanjian/kontak tejadi penyimpangan sehingga pemerintah mengalami kerugian, disebabkan dalam pembuatan kontrak/perjanjian tidak adanya mekanisme pertangung jawaban Kepala Daerah dan Kepala Satuan Kerja. Permasalahan yang sering dihadapi dan belum banyak dibahas, khususnya dibidang pemanfaatan aset daerah, memunculkan 2 (dua) pertanyaan: (1) Apakah kontrak/perjnjian tersebut telah memenuhi syarat-sayarat sahnya suatu kontrak/perjnajian dan tidak adanya pelangggaran azas kebebasan berkontrak (contractvrijheid beginselen)? (2) Apakah sebelum penandatanganan kontrak/pernjanjian telah memenuhi syarat-syarat sahnya suatu kontrak /perjnjian tidak terjadi penyalahgunaan keadaan (misbruik van omstandigheden)? Untuk menjawab pertanyaan-pertanyaan di atas, selain menggunakan sumber-sumber literatur, juga akan dipadukan dengan pengalaman lapangan sehingga diharapkan akan dapat dihimpun masukan terhadap penyiapan sebuah kontrak/perjjanjian, sebelum kontrak ditandatangani, dilaksanakan, maupun akibat hukum yang terjadi manakala kontrak/perjnjian tersebut diingkari (wanprestasi) atau terjadi sengketa.Kata Kunci: Kontrak/perjanjian, Azas Kebebasan Berkontrak, Penyalahgunaan Keadaan, dan Pemanfaatan aset Daerah. AbstractThe change in the implementation of regional government from Centralization to Decentralization in accordance with law no.32 of 2004 regions are given the authority, authority and responsibility in the management of regional property that is part of the state's wealth, to be secured and maintained both non-physical and can be used for the implementation of duties and services and can create jobs through the private sector. Based on the findings made in the contract / agreement for the use of regional property with the laian (private) party in the form of leases, utilization cooperation, build a handover and build for the handover on the basis of the agreement / contact there are deviations so that the government suffers losses, caused by the making of contracts / agreements there is no mechanism for answering the Regional Head and Head of the Work Unit. Problems that are often faced and have not been discussed much, especially in the field of utilization of regional assets, raise 2 (two) questions: (1) Whether the contract / contract has met the requirements of the validity of a contract / agreement and the absence of violation of the principle of freedom of contract (contractvrijheid beginselen)? (2) Whether prior to the signing of the contract/agreement has fulfilled the conditions for the validity of a contract/contract there is no abuse of circumstances (e.g. van omstandigheden)? To answer the questions above, in addition to using literary sources, it will also be combined with field experience so that input can be gathered on the preparation of a contract / agreement, before the contract is signed, implemented, or legal consequences that occur when the contract / agreement is denied (default) or a dispute occurs.Keywords: Contracts/agreements, Principles of Freedom of Contract, Abuse of Circumstances, and Utilization of Regional assets.
