Abstract

The transmission of Islamism among the kiais and their students in Madura has become more critical to examine in the last decade. However, some kiais of Nahdlatul Ulama (NU) in Bangkalan Madura see that Islamism or political Islam will gradually erode their national commitment. This article intends to reinterpret the nationalism vision of several kiais of NU and measure the extent of their views on the ideology of Islamism discoursed by the Islamic Defenders Front (FPI). By interviewing several kiais, this study finds that the propagation of Islamism in Bangkalan has not been as massive as occurred in Pamekasan, another sub-districts in Madura. The FPI-style Islamism in Bangkalan has been propagated only by a small group though they are vigorously active on social media. The majority of the NU community remains devoted to nationalism, committing that the NKRI is the final state. Islamic moderation promulgated by the kiais has been widely accepted and deeply rooted among the NU community. They believe nationalism and religion should not be separated from the spirit of their struggle (khittah). These two elements have united within their fighting spirit and become the primary trigger in devoting themselves to the nation and state to preserve national sovereignty and the integrity of Indonesia.

Abstract

Polygamy is a classic issue but is still interesting to study. The basis used is QS an Nisa verse 3. According to Musdah, this verse talks about how to provide protection for orphans. Even if polygamy is practiced, it is one breath with the protection of orphans. Therefore, the law of polygamy is haram lighayrih because the condition of its permissibility is justice which includes material and immaterial is very difficult to achieve. The prohibition of polygamy because of justice to his wives becomes the legal illat. The Marriage Law in Indonesia in regulating polygamy does not seem to be fair to women and views women as sub ordinate. While Musdah's thinking about polygamy in positive law in Indonesia is Article 3 paragraph (1) of Law No.1 of 1974 reads "Basically in a marriage a man can only have one wife. However, on the other hand, it provides a loophole for polygamy, even a maximum of four wives. This permission contains inconsistencies, because on the one hand it confirms the principle of monogamy but on the other hand it gives leeway to husbands to polygamy even though it is limited to four wives with several reasons but all the reasons for allowing polygamy are in favor of the husband's interests without considering the interests of the wife. It appears that the wife is an object to be polygamized and the inconsistency where the principle of marriage is monogamous but still provides a loophole for polygamy. This research aims to analyze Musdah Mulia's thoughts on polygamy justice in Islamic law and positive law in Indonesia. The method used by the author in writing is descriptive normative legal research method, the result of this research analysis is a critical study analysis of Siti Musdah Mulia's thoughts on polygamy justice in Islamic law and positive law in Indonesia

Abstract

The idea of producing religious science is known not only in Iran and the Islamic world but also in the Western world. This idea has created movements in the Western world and the Islamic world in the field of science production, which are mainly divided into three perspectives. In the sources of science production, a group has given originality to naqlī (narrative) knowledge, a group to human knowledge and experimental sciences, and the third group confirmed both views and considered the way to acquire knowledge to be both intellect and narration. Abdulkarim Soroush is among those who have given originality to experimental sciences and knowledge in this field. In this article, an attempt is made to explain the nature of religious science with a descriptive-analytical method, examine and explain Soroush’s point of view, and state his bases and arguments in explaining this theory, and finally to criticize his point of view. Confusion of the two authorities of demonstration and confirmation, failure to provide a criterion for judging between religion and human knowledge in times of conflict, and the invalidity of generalizing historical evidence to all ages are some of the things that undermine the acceptance of Soroush’s theory.
