Ùهي تتكون من تعري٠مقاصد الشريعة Ùˆ أنواعها Ùˆ مراتبها â€Ùˆ أهميتها ÙÙŠ استنباط الأØÙƒØ§Ù… الشرعية. مقاصد الشريعة هي المعاني â€ÙˆØ§Ù„أهدا٠الملØÙˆØ¸Ø© للشرع ÙÙŠ جميع Ø£ØÙƒØ§Ù…ها أو معظمها. أو هي الغاية من â€Ø§Ù„شريعة والأسرار التي وضعها الشارع عند كل ØÙƒÙ… من Ø£ØÙƒØ§Ù…ها. Ùˆ هي â€ØªØªÙƒÙˆÙ† من الضروريات Ùˆ هي خمس: الدين ÙˆØ§Ù„Ù†ÙØ³ والعقل والنسل والمال Ùˆ â€Ø§Ù„ØØ§Ø¬ÙŠØ§Øª Ùˆ Ø§Ù„ØªØØ³ÙŠÙ†ÙŠØ§Øª. Ùˆ قد اختل٠الأصوليون ÙÙŠ ترتيب الكليات الخمس â€Ùيما بينها ولكن المراتب المستعملة الأغلبية عند الأصوليين هي ما قاله الغزالي â€Ø¨ØªÙ‚ديم الدين ثم Ø§Ù„Ù†ÙØ³ ثم العقل ثم النسل ثم المال. ÙÙÙŠ استنباط الأØÙƒØ§Ù… â€Ø§Ù„شرعية على المجتهد أن ÙŠÙهم مقاصد الشريعة. ÙÙهمها عند الشاطبي يكون â€Ø´Ø±Ø·Ø§ تأهيليا أساسيا لمن أراد أن يجتهد، وعند الجمهور يكون شرطا تأهيليا â€ØªÙƒÙ…يليا. One of five Islamic pillars is zakah, which aims to create social welfare. As the last revealed religion, Islam puts the social justice in a high sequence. As the matter of fact, the word “adl”, “qisth”, and “mizan” as well as their derivates, are the third most frequently mentioned word after the word “Allah” and knowledge respectively in al-Qur’an. This article is all about the development of zakah regulation in Indonesia, particularly in East Lombok. Perda Zakat in East Lombok was enacted by its regent, Ali bin Dahlan, by a Decision Letter No. 4 of 2004 as the implementation of Regional Regulation No. 9 of 2002 on Zakâh and Prohibition to Drink Alcoholic Drink. Therefore, he was enthusiastic to apply the regulation by deducting the public servants’ salaries of 2.5% every month. But most of Muslim teachers refused the regulation. For them, the regulation contradicted with zakâh concept in Islam.

In the field of Indonesian-Islam studies, Hooker’s ‘Indonesian Islam’ is a welcome contribution to the scholarship. Unlike other Western scholars who study Indonesian Islam through anthropology, Hooker through his publication tries to show us that Islam in contemporary Indonesia can be known from fatâwâ (pl. fatwa) that have been responding matters of Indonesian Muslim society, have colored them and have been followed by them. For this reason, Hooker chooses four main Indonesian fatwa-issuing institutions which have been responding to challenges of modernity. They are Persatuan Islam (Persis), Muhammadiyah, Nahdlatul Ulama (NU) and Majelis Ulama Indonesia (MUI) and further, they are called “sources” or sources of fatâwâ. As a focus of the study, Hooker takes the fatâwâ from 1920s to the 1990s, from the period of colonialism to independence, which encompass the vast political, social and legal changes of this period.

Merarik is a marriage process of Sasak tradition in which a bridegroom runs away with the bride before marriage settlement or wedding procession is conducted lawfully based on both religion and national law. Initially, merarik is merely a term of an action running away with a girl to take in marriage. However, later on, it has a wider meaning. It is extensively used to name a whole series of marriage in Sasak community. Unfortunately, nowadays the tradition of merarik is frequently misapplied as a way to abduct a girl to be married even though without any agreement of her parents. It frequently causes conflicts between two families. In this regard, merarik becomes an interesting topic to discuss because at all events, several practices of such a tradition contravene the rights of women and their parents. Women cannot make a choice a bridefroom whom they love.Moreover, under-age marriages also often occur. As a consequence, most of women stop far schools. Why does the tradition of merarik still exist in a society This phenomenon shows as if there is a legitimation of the Sasak men who have a mind to maintain this tradition. This article tries to study how Sasak community as the majority of Muslim understand and interprete this phenomenon. Key Words: Merarik, Marriage, women forcefulness, Sasak Community

Sasak adalah kelompok suku terbesar di Lombok. Mereka terbagi ke dalam dua kelompok,yaitu Wetu Telu dan Waktu Lima. Waktu Lima adalah sebuah komunitas yang mendefinisikan diri sebagai penganut Islam ortodoks. Sedangkan Watu Telu adalah komunitas suku sasak marjinal yang memiliki kepercayaan yang dianggap sinkretik karena mereka masih mempercayai roh-roh nenek moyang mereka. Akan tetapi, sekitar delapan dekade yang lalu, sebagian muslim Lombok masih menjadi penganut Islam Wetu Telu. Perubahan yang sangat cepat ini mengundang banyak sarjana untuk melakukan penelitian tentang hubungan sosial dan keberagamaan masyarakat Lombok. Secara khusus, mereka tertarik untuk mengkqji pembagian antara Wetu Telu dan Waktu Lima.Artikel ini merupakan kajian literatur yang bertujuan untuk mengkaji relasi kuasa antara Wetu Telu, Waktu Lima dan pemerintah. Artikel ini mencoba meninjau konflik-konflik yang timbul dari hubungan-hubungan tersebut. Selanjutnya, artikel ini juga akan mengkaji perubahan paradigma S uku Sasak dan paradigma pemerintah dalam memandang posisi Wetu Telu. Untuk memahami hal tersebut, penulis akan mencoba menggali kajian-kajian antropologi mengenai masyarakat. Banyak literatur yang sudah membahas mengenai masyarakat Wetu Telu dan Waktu Lima. Untuk menganalisis data, penulis menggunakan metode induktif dan metode deskriptif analitis.Kata Kunci: Sasak, islamisasi, konflik, polarisasi, relasi kuasa

Ibn Sīnā is one of the prominent scholars in the Muslim scientific world. In the West, he is well known as Avicenna. As a polymath, he wrote many books in a broad range of sciences. Al-Qānūn fī aṭ-Tibb (the Canon of Medicine) and Kitāb Ash-Shifā’ (the Boook of Healing) are considered to be his magnum opuses. While the former is his greatest work on medicine, the latter is his monumental contribution to science and philosophy. Kitāb Ash-Shifā’ is concerned with four main subjects: logic (al-manṭiq), natural sciences (aṭ-ṭabi’iyāt), mathematics (ar-Riyaḍiyāt), and metaphysics or theology (al-Ilāhiyāt).

The practice of female circumcision or FGM/C (Female Genitalia Mutilation/Cutting) in Indonesia is stated as a purification process by removing najis or dirt in female genital area and it is useful for controlling women's sexual desires so that they are far from evil. Based on this motivation, FGM/C makes women increasingly subordinated by placing the assumption of infertility and being responsible for the satisfaction of sexual relations with their partners. Apart from tradition, this phenomenon is also based on the strong influence of Islamic religious doctrine which generally makes parents feel compelled to fulfill it. Through a qualitative approach with descriptive-analytical methods, this research will compile and explain the data that has been obtained to be analyzed and drawn conclusions. The results of this study indicate that there is no concrete evidence that correlates female circumcision with sexual harmony, female circumcision is purely a tradition and not an Islamic teaching.

The enactment of the Job Creation Law in approval of Government Regulation in Lieu of Law No. 2 of 2022, which became Law No. 6 of 2023 on Job Creation, has resulted in significant changes in halal certification in Indonesia, which is the main focus of this research. This study aims to discuss halal certification in Indonesia following the implementation of the omnibus law on job creation. The author adopts a standardized legal approach and a descriptive-analytical approach through literature research. The research findings indicate that comprehensive legislation is expected to streamline the halal certification process in Indonesia. There are important changes regarding halal certification in Law No. 6 of 2023 compared to Law No. 11 of 2020 on Job Creation. This regulation aims to accelerate and enhance efficiency in halal certification, ensuring legal certainty and fostering trust among Muslim consumers in halal products. The growth of micro-enterprises in terms of expediting halal certification shows positive trends. The research contributes new perspectives and original findings that positively impact problem-solving or theory development in the advancement of halal certification in Indonesia.Lahirnya UU Cipta Kerja sebagai pengesahan Peraturan Pemerintah Pengganti Undang-Undang Nomor 2 Tahun 2022 menjadi Undang-Undang Nomor 6 Tahun 2023 tentang Cipta Kerja telah menghasilkan perubahan signifikan dalam sertifikasi halal di Indonesia. Tujuan dari penelitian ini adalah untuk membahas sertifikasi halal di Indonesia pasca penerapan omnibus law penciptaan lapangan kerja. Penulis mengadopsi pendekatan hukum standar dan pendekatan deskriptif-analitik melalui penelitian literatur. Temuan penelitian menunjukkan bahwa peraturan yang komprehensif diharapkan dapat merampingkan proses sertifikasi halal di Indonesia. Ada perubahan penting terkait sertifikasi halal pada UU No 6 Tahun 2023 dibandingkan dengan UU No 11 Tahun 2020 tentang Cipta Kerja. Regulasi ini bertujuan untuk mempercepat dan meningkatkan efisiensi dalam sertifikasi halal, menjamin kepastian hukum dan menumbuhkan kepercayaan konsumen muslim terhadap produk halal. Pertumbuhan usaha mikro dalam hal percepatan sertifikasi halal menunjukkan tren yang positif. Penelitian ini menyumbangkan perspektif baru dan temuan orisinal yang berdampak positif terhadap pemecahan masalah atau pengembangan teori dalam kemajuan sertifikasi halal di Indonesia.
