Abstract

Micro, small and medium businesses have an important role for the economy in Indonesia. One of them is economic growth in employment and distribution of development results. On the other hand, MSMEs also face various problems, including limited working capital, low quality of human resources, and a lack of mastery in science and technology. Not only that, the lack of clarity about business prospects and planning, and how to market or promote the products being marketed. The method used in this research is descriptive method. The study population is MSMEs in the City of Baturaja. The data collection techniques used are observation, interviews and questionnaires while the data analysis technique uses SWOT analysis and then formulates strategies to overcome them. The purpose of the strategy for development of middle small micro businesses in the City of Baturaja is expected to increase the income so that welfare is also increasing.

Abstract

Pada kenyataannya yang terjadi di masyarakat bahwa ada beberapa pengusaha yang melakukan hal-hal yang merugikan konsumen. Hak-hak konsumen sering diabaikan oleh pengusaha, dengan kata lain, pengusahabelum melakukan kewajibannya kepada konsumen dengan baik. Dari latar belakang ini, penulis merumuskan beberapa masalah, yaitu bagaimana aturan hukum mengenai penyelesaian sengketa konsumen dan bagaimana tanggung jawab pengusaha terhadap konsumen. Penelitian ini adalah jenis penelitian lapangan deskriptif. Penelitian ini menggunakan 2 (dua) sumber data yaitu data primer dan sekunder. Ada 2 (dua) metode pengumpulan data yang digunakan dalam penelitian ini, yaitu observasi dan wawancara. Hasil penelitian ini menunjukkan bahwa perlindungan konsumen di BPSK berjalan sesuai dengan ketentuan Undang-Undang Nomor 8 Tahun 1999 tentang perlindungan konsumen sementara pengadilan negeri kurang objektif dalam menyelesaikan sengketa konsumen. Tanggung jawab pengusaha default dapat dilakukan dengan melanjutkan / membatalkan perjanjian dan mengkompensasi kerugian yang timbul karena default.

Abstract

Collusion in public procurement tenders in Indonesia, particularly in the context of Hajj-related services, has been a persistent issue despite sanctions imposed by the Indonesian Competition Commission (KPPU). This study analyses KPPU’s approach to sanctions and compares it with international best practices to assess the effectiveness of these measures in preventing anti-competitive practices. Case studies of procurement for Hajj souvenirs, equipment, food, and transportation from 2007 to 2018 indicate that KPPU fines have not provided a sufficient deterrent to prevent repeat collusion. Factors such as weak law enforcement, close business relationships between companies, and ineffective oversight contribute to the recurrence of tender collusion. Through a comparative approach, this study provides recommendations for strengthening regulations, enforcing more stringent sanctions, and enhancing oversight to promote fair competition in public procurement in Indonesia.
