Abstract

Pesantren merupakan salah satu khazanah dalam pendidikan Indonesia. Hal ini disebabkan model pendidikan yang berbeda dan alumni yang dihasilkan. Pondok Modern Darussalam Gontor adalah Pesantren yang telah berdiri sejak 1926. Model pendidikan dan peran alumni menjadi salah pertimbangan orang tua untuk memasukkan anaknya ke Pondok Modern Darussalam Gontor.  Persayaratan masuk Pondok Modern Darussalam Gontor adalah kemampuan baca Al-Qur’an. Sebagai upaya untuk mempersiapkan calon santri diadakanlah pelatihan baca Al-Qur’an dan pendampingan calon santri. Kegiatan pengabdian dilaksanakan pada masa pandemi covid-19. Metode yang dipergunakan adalah metode sorogan daring dan mengirimkan materi video ke peserta. Untuk pendampingan dilaksanakan selama pendaftaran sampai pengumuman kelulusan. Pengabdian berjalan lancar dengan kelulusan peserta pelatihan sebesar 95,91%. Para peserta yang lulus menjadi santri Pondok Modern Darussalam Gontor.

Abstract

Halal food products labeling is a form of producer responsibility and fulfilling protectionist authority of Muslim consumers and a form of ethics in the business world. From some of the cases that coming explain a lot of manufacturers do not take full responsibility for protecting Muslims consumers authority. The purpose of this study is to know how the role of halal food products labeling according Islamic business ethics and consumer protection law. The results of this study concluded that labeling of halal on food products have goals and values, the values that will concrete the good behavior of an ethical business, noble and professionals in the business which pay attention to spiritual values and social interests so that will protect consumers. Halal labeling is a form of legal guarantees that will protect consumers in way of physical and spiritual, it is mean protecting consumers with regard to physical health and observance of Muslims in carrying out the commands of Allah. In addition, the labeling of halal became absolute thing to do and obeyed, because rules are specified in Act No. 8 of 1999 on Consumer Protection and Law No. 33 of 2014 concerning the guarantee of halal products.

Abstract

Problematika penyelesaian sengketa hasil Pilkada dimulai pada saat Mahkamah Konstitusi mengeluarkan putusan Nomor 97/PUU-XI/2013 . Tindak lanjut atas putusan Mahkamah Konstitusi tersebut lahir UU 8/2015. UU 8/2015 sebagaimana dimaksud mengamanatkan untuk membentuk badan peradilan khusus pilkada. Pembentukan ini dijadwalkan paling lambat sebelum dilaksanakan Pilkada serentak pada Tahun 2024. Selama belum dibentuk badan peradilan khusus pilkada kewenangan penyelesaian sengketa hasil pilkada ditangani oleh Mahkamah Konstitusi.Sampai tahun 2022, badan peradilan khusus pilkada tidak pernah terwujud, padahal pelaksanaan Pilkada semakin dekat. Melalui putusan Nomor 85/PUU-XX/2022 menyatakan Pasal 157 UU 8/2015 yang inkonstitusional. Penelitian ini hendak menyoal penyelesaian sengketa hasil pilkada pasca putusan Mahkamah Konstitusi Nomor 85/PUU-XX/2022 dan masa depan kewenangan enyelesaian sengketa hasil pilkada. Penelitian ini adalah penelitian normatif dengan pendekatan perundang-undangan (statuta approach) dan pendekatan konseptual (conceptual approach). Hasil dari penelitian ini adalah Mahkamah Konstitusi mengatakan bahwa pembentukan badan peradilan khusus pilkada tidak akan pernah terjadi. Terjadi perubahan signifikan dalam proses dan pemaknaan Pilkada.sifat kewenangan  a quo telah berubah dari yang bersifat sementara menjadi permanen.

Abstract

The implication of the direct regional head election is the emergence of the results of the Regional Head Election. In the regulation of Law Number 32 of 2004, the results of the Regional Head Election were resolved by the Supreme Court. Through the decision of the Constitutional Court Number 072-073 / PUU-II / 2004 the legislators transferred the authority to the Constitutional Court with the birth of Law Number 22 Year 2007 and Law Number 12 Year 2008. However, the Constitutional Court annulled its authority with issued a decision Number 97 / PUU-XI / 2013. This article explored the resolution of the results of the Election of Regional Heads in the Supreme Court, the Constitutional Court and the discourse on the formation of a special judicial council with the legalized of the Election Law for Governors, Regents and Mayors with a statutory approach. The result of this writing is that as long as there is a final decision in the Supreme Court which is the same as the Permanent Legal Decision, so that it is possible to review the decision of the Supreme Court. In addition, as long as the Constitutional Court deals with disputes over the results of the Regional Head Election, the Constitutional Court settles cases using the sub-justice approach. After the decision 97 / PUU-XI / 2013, the urgency of the formation of special elections for the regional head elections is a necessity by taking into account the 4 elements. First, the establishment of a Special Court under the Supreme Court, second, filling the position of judge, the third special court is in the State Administrative High Court and fourth, the procedural law used is the constitutional court procedural law.

Abstract

This research aims to investigate progressive Court Constitution in Test limitation age marriage . Article 7 paragraph (1) of the Marriage Law Year 1/1974 has been give birth to form discrimination to female . This thing reflected from difference set age . Age limit marriage for Men is 19 years and 16) years for woman . To problematic this submit trial in Court Constitution . Later problem faced is Court Constitution no allowed by principles and stance for test Article 7 paragraph (1) of the Marriage Law which is a Open legal policy (Open legal policy). Purpose of study this is for knowing progressive Court Constitution in cut off case that . Study this is study normative with approach conceptual and approach regulation legislation . Result of Study this show that Court Constitution To do progress law with leave principles and stance . Court Constitution please receive application in decision the though Article tested  is Open legal policy [Penelitian ini bertujuan untuk menyelidiki progresifitas Mahkamah Konstitusi dalam Pengujian batasan usia perkawinan. Pasal 7 ayat  (1) UU Perkawinan Tahun 1/1974 telah melahirkan bentuk diskriminasi terhadap perempuan. Hal ini tercermin dari perebadaan usia yang diatur. Batasan usia perkawinan bagi pria adalah 19 (sembilan belas) tahun dan 16 (enam belas) tahun bagi wanit. Terhadap problematika ini diajukanlah pengujian di Mahkamah Konstitusi. Masalah yang kemudian dihadapi adalah Mahkamah Konstitusi tidak diperkenankan secara prinsip dan pendirian untuk menguji Pasal 7 ayat (1) UU Perkawinan yang merupakan Kebijakan Hukum Terbuka (Open legal policy). Tujuan dari penelitian ini adalah untuk mengetahui progresifitas Mahkamah Konstitusi dalam memutus perkara tersebut. Penelitian ini adalah penelitian normatif dengan pendekatan konseptual dan pendekatan peraturan perundang-undangan. Hasil dari Penelitian ini menunjukkan bahwa Mahkamah Konstitusi melakukan progrsifitas hukum dengan meninggalkan prinsip dan pendiriannya. Mahkamah Konstitusi berkenan mengambulkan permohonan dalam putusan tersebut meskipun Pasal yang diujikan adalah Kebijakan Hukum Terbuka (Open legal policy).]

Abstract

The controversies surrounding the Constitutional Court Decision Number 90/PUU-XXI/2023 have attracted public attention. The a quo decision is related to the judicial review of Article 169 letter q of the Election Law. This study questions the a quo decision which grants the applicant's request. This study uses the perspective of Prophetic Law. The Prophetic Law perspective consists of humanity, liberation and transcendence. The results of the study show: The Constitutional Court Decision Number 90/PUU-XXI/2023 does not represent the values ​​in Prophetic Law. The a quo decision loses its humanization value when it only places individual interests above public interests. In addition, the Constitutional Justices who are agents of liberation have failed by radically altering the Decision in a flash. When the values ​​of humanity and liberation are ignored, the dimension of transcendence is also lost. This decision does not meet the ethics, conscience, and divine values ​​the basis for making decisions, even though prophetic law demands spiritual awareness in the law enforcement process.Keywords: Humanity, Prophetic Law, Liberation, Constitutional Court Decision, Transcendence AbstrakProblematika Putusan Mahkamah Konstitusi Nomor 90/PUU-XXI/2023 menyita perhatian publik. Putusan  a quo berkaitan dengan pengujian Pasal 169 huruf q UU Pemilu. Penelitian ini mempermasalahkan Putusan a quo yang mengabulkan permohonan pemohon. Penelitian ini menggunakan sudut pandang Hukum Profetik. Pandangan Hukum Profetik terdiri dari humanisasi, liberasi dan transendensi. Hasil dari penelitian menunjukkan: Putusan Mahkamah Konstitusi Nomor 90/PUU-XXI/2023 tidak merepresentasikan nilai-nilai dalam Hukum Profetik. Putusan a quo kehilangan nilai humanisasinya ketika hanya menempatkan kepentingan perseorangan di atas kepentingan publik. Selain daripada itu, Hakim Konstitusi yang merupakan agen liberasi/pembebasan telah gagal dengan berubahnya Putusan secara radikal hanya dengan hitungan waktu "sekelebat." Ketika nilai-nilai humanisasi dan liberasi diabaikan, maka dimensi transendensi pun turut hilang. Putusan ini tidak menjadikan etika, nurani, dan nilai-nilai ketuhanan sebagai dasar dalam mengambil keputusan, padahal hukum profetik menuntut adanya kesadaran spiritual dalam proses penegakan hukum.Kata Kunci: Humanisasi, Hukum Profetik, Liberasi, Putusan Mahkamah Konstitusi, Transendensi

Abstract

This research analyzes the presidential authority to issue Government Regulations in Lieu of Law (Perpu) during urgent conditions in Indonesia and explores the potential institutionalization of fast-track legislation as a more accountable alternative. Using statutory and conceptual approaches, the study identifies five fundamental problems with the current Perpu mechanism: disruption of legislative processes, judicial review conflicts, unlimited and subjective content scope, lack of legislative discussion, and unclear nomenclature. These issues risk executive overreach and weaken the principle of separation of powers. The research then compares Indonesia’s system with fast-track legislative mechanisms in Ecuador and Colombia. Both countries empower the president to expedite urgent bills with a 30-day legislative response period; Ecuador limits this to economic matters and grants the president authority to enact bills if the legislature fails to act, while Colombia has no such clear consequence. Based on this comparison, the study advocates abolishing the president’s authority to issue Perpu and replacing it with a formal fast-track legislative process involving the House of Representatives. This approach preserves democratic accountability, ensures legal certainty, restores separation of powers, and prevents unilateral executive actions prone to arbitrariness. The research concludes that amending Article 22 of the 1945 Constitution to institutionalize fast-track legislation offers a constitutionally sound and transparent solution to urgent legislative needs in Indonesia.
