Abstract

This study aims to examine the institution of Moluku Kei Raha in the Indonesian Government System and the meaning of the Institution of Moloku Kie Raha in Organizing Government. The results of this study indicate that the area named Moloku Kie Raha contained four customary institutions, namely the Sultanate of Ternate, the Sultanate of Tidore, the Sultanate of Bacan and the Sultanate of Jailola. The duties and functions of the customary institutions of Moloku Kie Raha have a very important role in realizing a good governance system that is in line with the meaning contained in the customary institutions. Various meanings in the institution of Moloku Kie Raha such as Alam Ma Kolano in the Sultanate of Ternate who have duties and functions as Mandataris or Heads of State, Kie Ma Kolano in the Sultanate of Tidore with duties and functions that secure and defend all regions within the Confederate state. Jiko Ma Kolano in Jailolo with duties and functions to guard the entire border region, and Dehe Ma Kolano in the Sultanate of Bacan who had the task and function of building the economic system of the Confederate country. The meanings of the customary institutions as social capital are very relevant in realizing a system of good governance especially in North Maluku. The four meanings were studied in depth with the concept of management of the regional government system, especially in North Maluku with the meaning of world bobato and bobato akhirati with the existing institutional structure that has strong and inseparable relevance in realizing the commitment to create a good governance system in North Maluku, namely adopting formal institutions with customary institutions found in Moloku Kie Raha.

Abstract

With the existence of school operational assistance funds (BOS), it is hoped that public access to quality education is expected can be achieved. However, in practice the use of BOS funds is not always what is expected. This is because there are irresponsible elements who often misuse the BOS funds. Individuals who use BOS funds not in accordance with the guidelines for the use of BOS funds can be held legally responsible. The occurrence of corruption in the misuse of school operational assistance funds is caused by several factors, namely the school operational assistance management team that should have been formed by the school principal has never been formed, so that the management of school operational assistance funds is not transparent and accountable. Another factor is the weakness of the control system in the management of the School Operational Assistance Fund, which creates opportunities for managers to use BOS funds for personal interests. Perpetrators of criminal acts of corruption misuse of school operational assistance funds have been processed by law enforcement officials. The process starts from the stages of investigation, prosecution and trial and has obtained a final and binding decision. Even the perpetrator who was convicted and has served the sentence imposed on him. In the process, law enforcement officers have carried out the law enforcement process and have provided legal certainty for the actions of the perpetrators. However, the results of the process are still far from the principles of justice and benefits for the community

Abstract

Banyak masyarakat Kota Ternate menjadi korban tindak pidana penghimpunan dana masyarakat secara ilegal dengan modus investasi disebabkan oleh berbagai faktor seperti faktor ekonomi dimana masyarakat ingin mendapatkan keuntungan yang berlipat tanpa memikirkan akibat yang akan terjadi dikemudian hari, faktor lingkungan dimana masyarakat hanya melihat para nasabah lain disekitar mereka adalah orang-orang yang memiliki strata pekerjaan dan pendidikan yang baik sehingga masyaraat lainnya ikut yakin dengan kegiatan penghimpunan dana ilegal tersebut dan faktor penerapan hukum terhadap pelaku yang selama ini belum maksimal dan belum dapat memberikan efek jera bari para pelaku lainnya dengan beranggapa bahwa jika ia melakukan tindak pidana tersebut hanya dihukum beberapa tahun dan setelah bebas masih dapat menikmati hasil dari kejahatannya. Disisi lain penegakan hukum tindak pidana penghimpunan dana masyarakat secara ilegal dengan modus investasi di Kota Ternate belum bejalan secara efektif. hal mana pada proses penyidikan masih terdapat banyak pelaku lain yang belum di proses hingga saat ini, selain itu pada tahap penuntutan dan putusan pengadilan, nampak jelas belaum adanya keseriusan oleh para penuntut umum maupun hakim untuk menerapkan hukuman maksimal bagi para pelaku agar dapat meberikan rasa keadilan bagi para nasabah yang menjadi korban serta dapat menjadi pelajaran bagi pelaku lain sehingga takut dan jera untuk melakukan tindak pidana penghimpunan dana masyarakat secara ilegal dengan modus investasi.

Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara memiliki peran penting dalam pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral. Peran tersebut terdiri dari peran preemtif dan peran preventif yang merupakan peran sebagai upaya pencegahan serta peran represif sebagai upaya penindakan dalam hal ini penegakan hukum (law enforcement) bagi pelaku yang melakukan tindak pidana pada objek vital di kawasan pertambangan PT. Nusa Halmahera Mineral. Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara menghadapai berbagai kendala dalam melaksanakan pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral. Tidak berjalan optimalnya peran Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara disebabkan karena masih kurangnya jumlah personil pada Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara serta masih terbatasanya sarana dan prasarana yang memadai dalam mendukung pelaksanaan pengamanan. Kemudian lemahnya pelaksanaan koordinasi oleh manajemen PT. Nusa Halmahera juga menjadi kendala bagi Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara dalam melaksanakan perannya secara optimal untuk  pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral.

Abstract

Motorcycle riders in southern Halmahera Regency have not complied and obeyed the provisions of Article 293 paragraph (2) of the LLAJ Law concerning the obligation of motorcycle riders to turn on their lights during the day. This happened because in facing the disobedience of the driver, the South Halmahera Sat Lantas Police had not taken repressive measures such as giving a TOSS statement but the action taken was still limited to preventive action. The preventive measure is to disseminate information about the obligation to turn on lights during the day by motorcyclists. In addition, community ignorance and the low level of community discipline. Then the weak sanctions imposed by law enforcement.

Abstract

Abuse of narcotics by children in Ternate City actually occurs and is used by children who are still minors, either the child is a user / user or the child is a dealer, if it is categorized as narcotics abuse by children in Ternate City then the most dominating the category is a child as a user or a user who is a victim. The legal area of the North Maluku Regional Police and its staff in Ternate City is often found by children as drug users / users who are victims, in 2017 there were 2 cases of children who were netted with drug cases, in 2018 there were 1 cases of children and in 2019 there were 3 cases of children as users drugs, from these figures it shows that in the jurisdiction of the North Maluku Regional Police and the number of crimes of trafficking of Narcotics by minors still occurs, from a number of reasons children use or use narcotics because they are influenced by invitations from friends, curiosity or trial and error. try, the influence of the older siblings who live in, then the family is not harmonious and the environment in which they live.

Abstract

Penelitian ini bertujuan untuk menganalisis perlindungan hukum terhadap Pejabat Lelang dalam kedudukan dan fungsinya. Penulis menganalisis suatu pelaksanaan lelang yang berujung pada penetapan tersangka, penangkapan, dan penahanan serta disidangkan dalam perkara pidana terhadap Pejabat Lelang Sdr. UAM sebagaimana tercantum dalam perkara pidana pada Pengadilan Negeri Denpasar Nomor 15/Pid.B/2016/Pn.Dps jo Kasasi Mahkamah Agung Nomor 1250K/Pid/2016. Sah atau tidaknya alat bukti yang digunakan sesuai dengan bahan Analisa yang didapatkan alat bukti surat yang dimaksud dalam dakwaan adalah alat bukti yang tidak sah menurut undang-undang. Rekapan hasil audit internal yang dilakukan oleh salah satu bagian dari perusahan tidak dapat dipertanggungjawabkan keabsahannya. Dalam teori relatif atau teori tujuan Negara menjatuhkan hukuman kepada penjahat sebagai alat untuk mencapai tujuannya, tujuan dari hukuman yaitu menakut-nakuti seseorang dari melaksanakan perbuatan jahat. Dari apa yang dikemukakan dalam teori tentang pemidanaan maka tidak akan terpenuhi tujuan hukum dalam perkara ini. Sebab apa yang perlu ditakut-takuti terhadap terdakwa. Terdakwa tidak merasa melakukan perbuatan yang dituduhkan.

Abstract

Human longing for justice is essentially a longing for happiness, so efforts to fulfill various rights as witnesses of victims of theft crimes in Makassar City as a place of research have been conducted since 2017,2018 and 2019, actually show that the handling is carried out by the Police and the Prosecutor's Office especially in the victim's items found in the Police as well as the number of victim's items returned at the Prosecutor's Office, must be an important concern, but in fact, that victims of theft crimes are not like that .. This can be reflected in decisions by judges based on in the data in the last three years above, which convicted the perpetrators with imprisonment but none of the perpetrators were convicted to pay compensation to the victims. If the judge has the courage to make legal breakthroughs by punishing the perpetrator to pay compensation in the amount of the loss suffered by the victim, then, to be able to implement the legal objectives of justice related to the fulfillment of the victim's witness rights to personal property in a theft crime case can be realized

Abstract

Illegal levies on Ternate High School 2 occur because of the active role of the Ternate High School 2 schools and the length of the process of disbursing School Operational Assistance (BOS) funds from the central government to regions for unexpected expenditure needs and funds that are not unexpected included in the BOS funds budget. This illegal levies case has been followed up at the investigation stage after a closed case process was carried out by the North Maluku Regional Police Special Criminal Investigation Investigator and from the results of the title it was concluded that the criminal element had been fulfilled by allegedly violating Article 12 letter (e) of the Law Number 20 of 2001 jo. Law Number 31 of 1999 concerning Eradication of Corruption. In addition, illegal levies have become individual behavior and have become a system of providing services to the community, as if these illegal levies have become prevalent.
