Abstract

The Kei Islands of Southeast Moluccas, like other parts of Indonesia, have a customary order and cultural diversity. The values of local wisdom existing in the Kei community, which is contained in the customary law of Larwul Ngabal, is a very important cultural social capital in the social integration of its society. The type of study was an empirical research with sociological-anthropological juridical approach. The results show that the existence of customary law of Larwul Ngabal supports the implementation of regional autonomy with full authority and reinforcement in local regulations based on local wisdom in Kei Island. The dominant factors that caused the values of customary law of Larwul Ngabal have not provided legal strength in the implementation of local government is because it is determined by the recruitment factor of the leader who lacks capacity and competence. Added to the polarization of political parties and the values of local wisdom on financial strength in determining leadership. Therefore, to realize good local governance in Kei Islands, the values of customary law of Larwul Ngabal in various Local Regulations and local government policies must be accommodated, keeping in mind the custom, governmental and religious factors that are the foundation of Kei community life.

Abstract

Ketika pertama kali diumumkan sebagai pandemi global pada 11 Maret 2020 lalu oleh WHO jumlah infeksi di seluruh dunia telah mencapai lebih dari 121.000. Indonesia masih merasa aman dari wabah virus yang sudah melumpuhkan sebagian negara-negara di dunia, Presiden Joko Widodo pada awal Maret lalu yang tadinya membuat masyarakat berada di zona nyaman, harus mengakui kekalahan dengan adanya laporan kasus covid-19 yang disebabkan oleh virus SARS-Cov-2 atau yang lebih dikenal dengan sebutan virus Corona. Penyebaran virus yang tak-pernah-disangka akan sampai di Indonesia itu hingga kini masih berlanjut. Pusat Pemodelan Matematika dan Simulasi Institut Teknologi Bandung mempekirakan pandemi ini akan mencapai puncaknya pada akhir Maret dan berakhir pada pertengahan April 2020. Bahkan dengan kedinamisan data yang ada, prediksi tersebut bisa saja berubah. Data ini tentunya bukan untuk membuat kepanikan di tengah masyarakat, namun lebih untuk membuat masyarakat waspada dan memberikan gambaran bagi pemerintah dalam penanganannya. Yakni penanganan secara kompehensif, khususnya untuk mencegah penyebaran yang lebih luas agar jumlah infeksi dapat ditekan. Kini sebaran Covid 19 makin luas dan menghawatirkan. Jumlah kasus orang yang terpapar Covid-19 di Indonesia pun terus meningkat dari hari ke hari. Badan Nasional Penanggulangan Bencana (BNPB) sampai tanggal 28 April 2020 menyatakan ada sebanyak 9.511 orang positif, sembuh 1.254 orang sembuh, dan meninggal sebanyak 773 orang telah meninggal dunia akibat virus tersebut. Pemerintah memang telah menetapkan wabah Covid-19 itu sebagai bencana non alam dengan status sebagai bencana nasional berdasarkan ketentuan Undang-Undang Nomor 24 Tahun 2007 tentang Bencana Nasional. Pemerintah juga telah membentuk Gugus Tugas Percepatan Penanganan Covid-19. Di level daerah, masingmasing pemerintah daerah juga telah membentuk satuan tugas untuk menangani wabah Covid-19. Perluasan sebaran Covid 19 tersebut telah berimplikasi terhadap berbagai aspek kehidupan masyarakat di bidang ekonomi, sosial, budaya, dan hukum. Dari aspek peraturan perundang-undangan, setidaknya Indonesia telah memiliki 2 (dua) Undang-undang dan 1 (satu) Peraturan Pemerintah yang mengatur mengenai penanganan wabah yaitu UU Nomor 4 Tahun 1984 tentang Wabah Penyakit Menular, UU Nomor 6 Tahun 2018 tentang Kekarantinaan Kesehatan, dan Peraturan Pemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar (PSBB). Ketiga instrumen hukum tersebut belum terlalu lengkap diatur oleh peraturan teknis di bawahnya, terutama UU 6 Tahun 2018. Hal ini menjadi kendala dan urgen menjadi prioritas pemerintah. Untuk mencegah meluasnya sebaran Covid 19, Pemerintah-pun telah melakukan berbagi upaya untuk memutus mata rantai penularan virus Covid 19. Imbauan menggunakan masker, rajin mencuci tangan pakai sabun, social distancing, physical distancing, WFH, SFH, beribadah di rumah, sampai dengan penerapan PSBB. Namun nampaknya upaya pencegahan tersebut belum efektif sebagaimana yang diharapkan walaupun telah ada peraturan perundangundangan (hukum tertulis) yang menjadi dasar pelaksanaannya.

Abstract

This study aims to examine the institution of Moluku Kei Raha in the Indonesian Government System and the meaning of the Institution of Moloku Kie Raha in Organizing Government. The results of this study indicate that the area named Moloku Kie Raha contained four customary institutions, namely the Sultanate of Ternate, the Sultanate of Tidore, the Sultanate of Bacan and the Sultanate of Jailola. The duties and functions of the customary institutions of Moloku Kie Raha have a very important role in realizing a good governance system that is in line with the meaning contained in the customary institutions. Various meanings in the institution of Moloku Kie Raha such as Alam Ma Kolano in the Sultanate of Ternate who have duties and functions as Mandataris or Heads of State, Kie Ma Kolano in the Sultanate of Tidore with duties and functions that secure and defend all regions within the Confederate state. Jiko Ma Kolano in Jailolo with duties and functions to guard the entire border region, and Dehe Ma Kolano in the Sultanate of Bacan who had the task and function of building the economic system of the Confederate country. The meanings of the customary institutions as social capital are very relevant in realizing a system of good governance especially in North Maluku. The four meanings were studied in depth with the concept of management of the regional government system, especially in North Maluku with the meaning of world bobato and bobato akhirati with the existing institutional structure that has strong and inseparable relevance in realizing the commitment to create a good governance system in North Maluku, namely adopting formal institutions with customary institutions found in Moloku Kie Raha.

Abstract

Energy is one of the main needs ofhuman life. Energy enhancement can be anindicator of the increasing prosperity of an area, butsimultaneously it also poses problems with supply.An adequate and cheap as well as environmentallyfriendly electrical energy supply for sustainableeconomic and social development. Limitations ofelectrical energy are one of the obstacles in theconstruction and development of ruralcommunities.The micro-hydro power plantis selected as oneof the alternative energy that are environmentallyfriendly, pollution-free, renewable (renewable), notconsumptive of water use, durable (long life), andsmall operational cost is suitable for remote areas.The potential of hydro energy in the Province ofNorth Maluku contained in several regions,including in Ibu Village, West Halmahera. Hydropower potential has been exploited is still relativelysmall. The utilization of hydropower proficiencylevel is still relatively small because the potential isusually located in remote areas that electricitydemand is relatively small, so for micro hydropotential are located far from consumers has notbeen utilized.

Abstract

Children are the future of the nation, because in its journey is the young generation and the successor to the ideals of the nation's struggle that has a strategic role. As human beings who need to get protection for their rights, at the same time they must also monitor to avoid various things that damage their future, such as being involved in various things that injure their lives such as being involved in Narcotics. Moreover, this was done in his capacity as a student. The development of science is so advanced in various segments of life that it is not only in adults but is almost pervasive among the younger generation, especially students. Therefore, it is the duty of all stakeholders to do things that can be done in order to do understanding and at the same time make prevention with various aspects so that the younger generation will be more specifically students can avoid the dangers that will be caused from the use of narcotics. there is, the study with a model of service that is focused on students at Ternate State High School I (SMA Negeri 1 Ternate) as a partner in exploring more about the impact of drug use. With the hope that this will be a good initial example to do it in another school with the same purpose.

Abstract

Regulation of the Chief National Police of the Republic of Indonesia Number 14 Year 2014 concerning Services Unit for Procurement of Goods/Services at the North Maluku Regional Police Logistics Bureau for the implementation of the procurement process for goods and services has been running in accordance with existing rules. But there are some things that have not been carried out based on the Regulation. With regard to consistency in the implementation of the rules, inconsistencies occur in the rules that have been set, because there are indeed some things that cannot be fulfilled by the organizational unit so that there are still mismatches between the realization and implementation of the rules themselves. Factors which become obstacles in the implementation of the Regulation of the Chief National Police of the Republic of Indonesia Number 14 Year 2014 include (1) Human Resources Factors; (2) Facilities and Infrastructure Factors; and (3) Rule/Legality Factors.

Abstract

The position of the inspectorate as a supervisory body in the governance of regional government must be strengthened by the government making its own law. This is important in order to realize local governance, one of which is that it can prevent corruption must be accompanied by the strengthening of the inspectorate institution, through a separate Act with the Government's Internal Oversight System that can be accounted for. In order for authority, duties and functions to function as expected, regulations that must clearly regulate the position of the inspectorate in a regional government structure clearly match their role. Factors that play a role in strengthening the inspectorate as a supervisory institution in regional governance, must be born a separate law with the Government's Internal Monitoring System, which is not only at the center but also in the regions. Thus, the various strength factors become the strengthening of the inspectorate as a supervisory institution that can realize good and correct local governance.

Abstract

This paper will specifically analyze the application of Article 18 of Law Number 20 Year 2001 concerning the Eradication of Corruption as compensation for recovering state financial losses at the Jayapura District Prosecutor's Office. This type of research is normative or doctrinal law research. The legal materials used are primary legal materials, namely legal regulations and secondary legal materials consisting of statistical data from the Jayapura District Prosecutor's Office, and the Corruption Court at the Jayapura Class I A District Court, text books, legal journals, comments - Comment and legal dictionaries. Data collection was carried out through document study and literature study. The collected data were then analyzed qualitatively. The results of the study show that the return of a number of funds or payment of replacement money equal to the value of corruption committed by perpetrators of corruption for the return of state losses does not eliminate criminal charges as stated in Article 4 of Law Number 20 Year 2001 concerning amendments to Law Number 31 Year 1999 concerning the Eradication of Corruption Crime. The rules regarding the mechanism for paying replacement money to recover state losses due to corruption are very clear. Namely, based on the Attorney General's decision Number: Kep-518/J.A/11/2001 dated November 1, 2001 concerning the Mechanism of Payment of Replacement Money.

Abstract

This paper aims to analyze the effectiveness of the application of Article 100 of Law Number 31 Year 2004 in handling fisheries crime in North Maluku. The type of research used is the research type Socio Legal Research. The data used is primary data which is data obtained directly from the object to be studied. Data is obtained through field research from the research locations mentioned above, namely in the form of interviews or statements from investigators of the Directorate General of Civil and Political Sciences, Public Prosecutors and District Court Judges, fisheries expert witnesses, and secondary data, namely data obtained from institutions or certain institutions. Data is obtained through report materials and other documents that have existed previously and have a close relationship with the issues discussed in this paper. The collected data were then analyzed qualitatively. The results of the study show that the application of Article 100 of Law Number 31 Year 2004 by law enforcement officials has not been effective, because investigators by the Police and prosecution by the Prosecutor consistently use these articles, but judges based on the trial decisions that occurred ignored the demands in article 100 by choosing the penalty is lighter because it only pays a fine in accordance with what happens in a fishery crime. Therefore, based on what happens repeatedly, it is imperative that in enforcing the fisheries criminal law in North Maluku, law enforcement officials, both the Police, the Attorney General as well as judges must be consistent in applying Article 100 since the process of investigation, prosecution and the decision to be decided.

Abstract

In the community there are still many violations of the Fish and Plant Animal Quarantine Law. As a result of not meeting the requirements or procedures mentioned above, it will cause the entry of dangerous diseases in animals and plants, destroy the potential availability of animals and plants and cause disease outbreaks in Indonesia. It is even worse if the disease is zoonotic in nature, so it is disturbing for the community. One of the many cases of importation of agricultural commodities that do not meet the requirements and quarantine procedures is due to the ineffective function of Civil Servant Investigators in law enforcement in the Class II Ternate Agricultural Quarantine Center. The factors that cause law enforcement against quarantine crime in the Class II Ternate Agricultural Quarantine Center are less effective due to low public awareness and lack of coordination of related agencies. As for the less effective Law Enforcement Against Quarantine Crime, among others, is due to the lack of Apparatus Resources, namely the lack of Civil Servant Investigators at the Class II Ternate Agricultural Quarantine Center and the lack of operational budgets related to investigations.
