Abstract

The Kei Islands of Southeast Moluccas, like other parts of Indonesia, have a customary order and cultural diversity. The values of local wisdom existing in the Kei community, which is contained in the customary law of Larwul Ngabal, is a very important cultural social capital in the social integration of its society. The type of study was an empirical research with sociological-anthropological juridical approach. The results show that the existence of customary law of Larwul Ngabal supports the implementation of regional autonomy with full authority and reinforcement in local regulations based on local wisdom in Kei Island. The dominant factors that caused the values of customary law of Larwul Ngabal have not provided legal strength in the implementation of local government is because it is determined by the recruitment factor of the leader who lacks capacity and competence. Added to the polarization of political parties and the values of local wisdom on financial strength in determining leadership. Therefore, to realize good local governance in Kei Islands, the values of customary law of Larwul Ngabal in various Local Regulations and local government policies must be accommodated, keeping in mind the custom, governmental and religious factors that are the foundation of Kei community life.

Abstract

Ketika pertama kali diumumkan sebagai pandemi global pada 11 Maret 2020 lalu oleh WHO jumlah infeksi di seluruh dunia telah mencapai lebih dari 121.000. Indonesia masih merasa aman dari wabah virus yang sudah melumpuhkan sebagian negara-negara di dunia, Presiden Joko Widodo pada awal Maret lalu yang tadinya membuat masyarakat berada di zona nyaman, harus mengakui kekalahan dengan adanya laporan kasus covid-19 yang disebabkan oleh virus SARS-Cov-2 atau yang lebih dikenal dengan sebutan virus Corona. Penyebaran virus yang tak-pernah-disangka akan sampai di Indonesia itu hingga kini masih berlanjut. Pusat Pemodelan Matematika dan Simulasi Institut Teknologi Bandung mempekirakan pandemi ini akan mencapai puncaknya pada akhir Maret dan berakhir pada pertengahan April 2020. Bahkan dengan kedinamisan data yang ada, prediksi tersebut bisa saja berubah. Data ini tentunya bukan untuk membuat kepanikan di tengah masyarakat, namun lebih untuk membuat masyarakat waspada dan memberikan gambaran bagi pemerintah dalam penanganannya. Yakni penanganan secara kompehensif, khususnya untuk mencegah penyebaran yang lebih luas agar jumlah infeksi dapat ditekan. Kini sebaran Covid 19 makin luas dan menghawatirkan. Jumlah kasus orang yang terpapar Covid-19 di Indonesia pun terus meningkat dari hari ke hari. Badan Nasional Penanggulangan Bencana (BNPB) sampai tanggal 28 April 2020 menyatakan ada sebanyak 9.511 orang positif, sembuh 1.254 orang sembuh, dan meninggal sebanyak 773 orang telah meninggal dunia akibat virus tersebut. Pemerintah memang telah menetapkan wabah Covid-19 itu sebagai bencana non alam dengan status sebagai bencana nasional berdasarkan ketentuan Undang-Undang Nomor 24 Tahun 2007 tentang Bencana Nasional. Pemerintah juga telah membentuk Gugus Tugas Percepatan Penanganan Covid-19. Di level daerah, masingmasing pemerintah daerah juga telah membentuk satuan tugas untuk menangani wabah Covid-19. Perluasan sebaran Covid 19 tersebut telah berimplikasi terhadap berbagai aspek kehidupan masyarakat di bidang ekonomi, sosial, budaya, dan hukum. Dari aspek peraturan perundang-undangan, setidaknya Indonesia telah memiliki 2 (dua) Undang-undang dan 1 (satu) Peraturan Pemerintah yang mengatur mengenai penanganan wabah yaitu UU Nomor 4 Tahun 1984 tentang Wabah Penyakit Menular, UU Nomor 6 Tahun 2018 tentang Kekarantinaan Kesehatan, dan Peraturan Pemerintah Nomor 21 Tahun 2020 tentang Pembatasan Sosial Berskala Besar (PSBB). Ketiga instrumen hukum tersebut belum terlalu lengkap diatur oleh peraturan teknis di bawahnya, terutama UU 6 Tahun 2018. Hal ini menjadi kendala dan urgen menjadi prioritas pemerintah. Untuk mencegah meluasnya sebaran Covid 19, Pemerintah-pun telah melakukan berbagi upaya untuk memutus mata rantai penularan virus Covid 19. Imbauan menggunakan masker, rajin mencuci tangan pakai sabun, social distancing, physical distancing, WFH, SFH, beribadah di rumah, sampai dengan penerapan PSBB. Namun nampaknya upaya pencegahan tersebut belum efektif sebagaimana yang diharapkan walaupun telah ada peraturan perundangundangan (hukum tertulis) yang menjadi dasar pelaksanaannya.

Abstract

This study aims to examine the institution of Moluku Kei Raha in the Indonesian Government System and the meaning of the Institution of Moloku Kie Raha in Organizing Government. The results of this study indicate that the area named Moloku Kie Raha contained four customary institutions, namely the Sultanate of Ternate, the Sultanate of Tidore, the Sultanate of Bacan and the Sultanate of Jailola. The duties and functions of the customary institutions of Moloku Kie Raha have a very important role in realizing a good governance system that is in line with the meaning contained in the customary institutions. Various meanings in the institution of Moloku Kie Raha such as Alam Ma Kolano in the Sultanate of Ternate who have duties and functions as Mandataris or Heads of State, Kie Ma Kolano in the Sultanate of Tidore with duties and functions that secure and defend all regions within the Confederate state. Jiko Ma Kolano in Jailolo with duties and functions to guard the entire border region, and Dehe Ma Kolano in the Sultanate of Bacan who had the task and function of building the economic system of the Confederate country. The meanings of the customary institutions as social capital are very relevant in realizing a system of good governance especially in North Maluku. The four meanings were studied in depth with the concept of management of the regional government system, especially in North Maluku with the meaning of world bobato and bobato akhirati with the existing institutional structure that has strong and inseparable relevance in realizing the commitment to create a good governance system in North Maluku, namely adopting formal institutions with customary institutions found in Moloku Kie Raha.

Abstract

This study aims to analyze in-depth the fraud based on Article 1328 of the Civil Code on the agreement that can result in default, as well as to examine the legal consequences of the agreement containing elements of fraud based on Article 1328 of the Civil Code, fraud can be canceled or null and void. The research method used in this research is normative research on the rule of law contained in Article 1328 of the Civil Code. The data used in this study is secondary data. The secondary data used in this study consists of primary legal materials that are authoritative which means they have authority, secondary legal materials, and tertiary legal materials. The results of this study indicate that fraud based on Article 1328 of the Civil Code in the Agreement does not result in Default. Because default and fraud in civil law have different elements. Default is regulated in Article 1243 of the Civil Code, while fraud in civil law is regulated in 1328 of the Civil Code. The consequences of an agreement containing an element of fraud can be canceled or null and void by law. The condition for canceling the agreement is that the agreement to be canceled must be reciprocal, namely an agreement that gives rights and obligations to both parties, cancellation is carried out through the court so that the cancellation of the agreement is through a judge's decision, and there must be a default. An agreement can be canceled as stipulated in article 1321 of the Civil Code, while an agreement that has prohibited things causes the agreement to be null and void, based on Article 1254 of the Civil Code.

Abstract

Article 18 of Law Number 48 of 2009 concerning Judicial Power determines that judicial power is exercised by a Supreme Court and judicial bodies under it in the general court, religious courts, military courts, state administrative courts, and by an Constitutional Court. Each judicial environment has competence, both absolute and relative competence. The absolute competence of the judiciary is the jurisdiction of the judiciary in examining certain types of cases which are absolutely unable to be examined by other court bodies, either in the same judicial environment or in a different judicial environment. In connection with disputes involving sharia banking, until now it is still a matter of debate, which court has the authority to try them. Not to mention that until now there are still decisions of district courts that accept and grant claims which are disputes involving sharia banking. This means that internally the Supreme Court alone, in this case the judges in making decisions are still unable to provide legal certainty regarding absolute competence in adjudicating disputes involving sharia banking

Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara memiliki peran penting dalam pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral. Peran tersebut terdiri dari peran preemtif dan peran preventif yang merupakan peran sebagai upaya pencegahan serta peran represif sebagai upaya penindakan dalam hal ini penegakan hukum (law enforcement) bagi pelaku yang melakukan tindak pidana pada objek vital di kawasan pertambangan PT. Nusa Halmahera Mineral. Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara menghadapai berbagai kendala dalam melaksanakan pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral. Tidak berjalan optimalnya peran Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara disebabkan karena masih kurangnya jumlah personil pada Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara serta masih terbatasanya sarana dan prasarana yang memadai dalam mendukung pelaksanaan pengamanan. Kemudian lemahnya pelaksanaan koordinasi oleh manajemen PT. Nusa Halmahera juga menjadi kendala bagi Direktorat Pengamanan Obyek Vital Kepolisian Daerah Maluku Utara dalam melaksanakan perannya secara optimal untuk  pengamanan kawasan pertambangan pada PT. Nusa Halmahera Mineral.

Dengan di undangkannya Undang – Undang Nomor 7 Tahun 2017 tentang Pemilihan Umum memberikan peluang untuk peningkatan demokrasi dengan memperhatikan adanya pelanggaran yang dilakukan dan menjadi tugas pokok dari Badan Pengawas Pemilihan Umum Kabupaten/kota. Efektifitas penegakan pelangaran administrasi oleh BAWASLU Kabupaten Halmahera Selatan berdasarkan Pasal 240 Ayat (1) Huruf (k) dan (m) Undang – undang Nomor 7 Tahun 2017 tentang PEMILU, belum maksimal dalam memberikan keputusan kepada Calon Anggota DPRD Kabupaten Halmahera Selatan Dapil II Makian Kayoa yang telah memenuhi unsur formil maupun materil dalam pemeriksaan Persidangan Pelanggaran Administrasi. Selain itu, Faktor yang mempengaruhi penegakan Pelanggaran Administrasi pada Pemilihan Umum serentak Anggota DPRD oleh BAWASLU Halmahera Selatan tahun 2019 yaitu jumlah personil dan sarana fasilitas penunjang dalam pemeriksaan persidangan tidak memadai, antara tugas dengan dana operasional tidak sebanding dalam penganan kasus pelanggaran Administrasi.

Abstract

Human longing for justice is essentially a longing for happiness, so efforts to fulfill various rights as witnesses of victims of theft crimes in Makassar City as a place of research have been conducted since 2017,2018 and 2019, actually show that the handling is carried out by the Police and the Prosecutor's Office especially in the victim's items found in the Police as well as the number of victim's items returned at the Prosecutor's Office, must be an important concern, but in fact, that victims of theft crimes are not like that .. This can be reflected in decisions by judges based on in the data in the last three years above, which convicted the perpetrators with imprisonment but none of the perpetrators were convicted to pay compensation to the victims. If the judge has the courage to make legal breakthroughs by punishing the perpetrator to pay compensation in the amount of the loss suffered by the victim, then, to be able to implement the legal objectives of justice related to the fulfillment of the victim's witness rights to personal property in a theft crime case can be realized

Abstract

Illegal levies on Ternate High School 2 occur because of the active role of the Ternate High School 2 schools and the length of the process of disbursing School Operational Assistance (BOS) funds from the central government to regions for unexpected expenditure needs and funds that are not unexpected included in the BOS funds budget. This illegal levies case has been followed up at the investigation stage after a closed case process was carried out by the North Maluku Regional Police Special Criminal Investigation Investigator and from the results of the title it was concluded that the criminal element had been fulfilled by allegedly violating Article 12 letter (e) of the Law Number 20 of 2001 jo. Law Number 31 of 1999 concerning Eradication of Corruption. In addition, illegal levies have become individual behavior and have become a system of providing services to the community, as if these illegal levies have become prevalent.
