Abstract

Polygamous marriage in Indonesia can be carried out by fulfilling the requirements stipulated in the legislation. However, if these requirements are not met, the marriage can be annulled. The Surabaya High Court Decision No. 343/Pdt.G/2023/PTA.Sby is one such decision regarding a lawsuit for the annulment of a marriage filed by the first wife against her husband's polygamous marriage with the second wife, which was conducted without the consent of the lawful first wife. The decision stated that the lawsuit could not be accepted because the marriage proposed for annulment had already been dissolved due to death. This study aims to understand the basis for the lawsuit to annul the second marriage and the legal consequences on the status of the second marriage from the perspective of the Marriage Law and Civil Procedure Law. The author conducted this research using a normative juridical approach with a descriptive-analytical research specification. Data collection techniques were carried out through literature studies that gathered primary, secondary, and tertiary legal materials. The data analysis method was conducted through a normative qualitative method to address the legal issues in this study. Based on the research results, it can be concluded that the basis for the lawsuit to annul the second (polygamous) marriage did not meet the marriage requirements stipulated in Article 3 paragraph (2) of the Marriage Law, which states that a person engaging in polygamy must have the consent of the parties concerned. Furthermore, the legal consequence of the Surabaya High Court Decision No. 343/Pdt.G/2023/PTA.Sby, which stated that the lawsuit could not be accepted because the marriage had been dissolved due to death, is that the second marriage existed (was valid) along with its legal consequences.

Abstract

Undang-Undang Nomor 16 Tahun 2019 Perubahan Atas Undang-Undang Nomor 1 Tahun 1974 tentang Perkawinan (UU Perkawinan) merupakan sebuah sumber hukum perkawinan di Indonesia. Tujuan dari penulisan ini adalah untuk mendapatkan gambaran perkawinan terhadap praktik perkawinan masyarakat di Kampung Urug Kabupaten Bogor dikaitkan dengan Undang-Undang Perkawinan. Untuk memperoleh mengenai keselerasan dan kesesuaian hukum menurut UU Perkawinan dan hukum adat terhadap praktik perkawinan masyarakat di Kampung Urug Kabupaten Bogor. Berdasarkan hasil penelitian mengenai praktik pelaksanaan perkawinan masyarakat Kampung Urug Kabupaten Bogor adalah telah sesuai dengan syarat sah perkawinan menurut UU Perkawinan. Untuk adanya suatu hal yang dilakukan secara adat tetap tidak dapat dikesampingkan atau tetap harus dilakukan dan dilaksanakan karena keyakinan masyarakat terhadap para leluhurnya masih cukup besar, namun hal-hal tersebut tidak berlawanan dengan UU Perkawinan.

Abstract

This article discusses the issue of the legal validity of marriage contract in the case dowry is paid by a third party.  Legal analysis will be performed on the legal principles and regulations found in The Law Number 1 Year 1974 on Marriage, The Compilation of Islamic Law and sources in Islamic Law .  One important finding is does not forbid the payment of dowry by a third party and that this practice does not affect the validity of the marriage contract.

Abstract

Polygamy without the consent of the first wife can have legal consequences regarding the marital status of polygamy between husband and second wife and the status of children born to the second wife as a result of sexual intercourse before marriage (pregnant marriage). The purpose of this research was to determine the status of polygamous and the legal status of children born from second wife that were not approved by the first wife. This research uses a normative juridical approach with analytical descriptive research spesifications by conducting literature studies through laws, regulations, and interviews with relevant sources. The analytical method used is juridical qualitative. The result of this research show that the polygamous marital status between the Applicant and the second wife in a state of pregnancy without the consent of the first wife based on Islamic law and laws and regulations in Indonesia is a valid marriage if it meets the conditions, gets along, and there is no prohibition on marriage. The legal status of children born to the second wife in a polygamous marriage in a state of pregnancy that is not approved by the first wife, there is a difference between Islamic Law and the Marriage Law and the KHI. Islamic law uses the minimum gestational age parameter, which is 6 months. If the birth is less than 6 months, then the child is an adulterous child, so it is not confided to the father and uses the guardian of the judge as the guardian of the marriage. Meanwhile, the Marriage Law and IHL states that the status of the child is a legal child without a gestational age limit. The child can be declared to his father and the marriage guardian who can marry the child, namely wali nasab.

Abstract

The phenomenon of transsexuality and sex change is still something that is considered taboo or should not be done by Indonesian society, the reason is because our country upholds religious values, traditions and eastern values adopted by society. Keep in mind that not everyone is born with normal conditions. There are some people who experience gender ambiguity or in medical terms called ambiguous genetalia or sex ambiguity and Islamic jurisprudence studies, this group of people is referred to as khunsa or double gender. The results of this study show that Law Number 23 of 2006 concerning Population Administration opens up opportunities for sex change by submitting a sex change application to the court so that the event can be recorded at the relevant agency. Judging from Islamic law, Islamic law also allows sex change if done for someone suffering from multiple gender conditions (khuntsa) as a form of treatment as stipulated in Fatwa No. 03/MUNASVIII/MUI/2010.

Abstract

Perkawinan beda agama menjadi sebuah fenomena yang sudah banyak terjadi di Indonesia. Banyak masyarakat Indonesia yang melakukan perkawinan di luar negeri untuk dapat melakukan perkawinan beda agama. Dalam agama Islam, perkawinan beda agama adalah suatu hal yang dilarang. Hal ini menimbulkan kebingungan karena adanya ambiguitas dari makna Pasal 35 huruf a UU Adminduk. Penelitian ini bertujuan untuk mengetahui keabsahan pengizinan pencatatan perkawinan beda agama pada Pengadilan Negeri dan dampak negatifnya dalam hukum Islam. Penelitian ini menggunakan metode pendekatan yuridis normatif dan spesifikasi penelitiannya bersifat deskriptif analisi. Berdasarkan hasil penelitian, pencatatan perkawinan beda agama seharusnya tidak diperbolehkan bagi masyarakat yang dalam aturan agamanya melarang perkawinan beda agama. Hal ini tetap mengacu kepada aturan agama masing-masing pihak yang bersangkutan, terkhusus bagi umat agama Islam. Dalam analisis pula, menemukan adanya beberapa dampak negatif secara Islam, yang mana pencatatan perkawinan beda agama ini akan berpengaruh pada hubungan antara istri dan suami, kedudukan anak sebagai anak tidak sah dan kedudukan ahli waris yang memiliki perbedaan agama dalam satu keluarga.

Abstract

Penetapan hak asuh anak yang belum mummayyiz atau belum berusia 12 (dua belas) tahun pasca terjadinya perceraian menjadi hak ibunya menurut Pasal 105 KHI. Dalam beberapa kasus, hak asuh anak yang belum mumayyiz tersebut berdasarkan putusan pengadilan diberikan kepada ayah seperti Putusan Pengadilan Tinggi Agama Jakarta Nomor 115/Pdt.G/2021/PTA.JK. Penelitian ini bertujuan untuk menganalisis pertimbangan hukum pada Putusan Nomor 115/Pdt.G/2021/PTA.JK dan akibat hukum yang timbul terhadap hak ibu dalam mengasuh anak-anaknya yang belum mumayyiz. Metode pendekatan yang digunakan dalam penelitian ini berupa pendekatan yuridis normatif dengan spesifikasi bersifat deskriptif. Metode yuridis normatif dilakukan dengan cara menelaah pendekatan teori-teori dan konsep-konsep. Hasil penelitian menunjukkan bahwa majelis hakim membatalkan hak asuh anak yang belum mumayyiz dari pihak ibu karena adanya perpindahan agama dan pengaruhnya terhadap anak-anak. Ini sejalan dengan prinsip hukum Islam dan Yurisprudensi Mahkamah Agung yang menyatakan bahwa agama menjadi syarat penting dalam pengasuhan anak. Analisis juga menyoroti kewajiban orang tua untuk memberikan pendidikan agama sesuai dengan keyakinan anak, sebagaimana diamanatkan oleh Undang-Undang Perlindungan Anak. Kesimpulan dari penelitian ini meskipun hak asuh berpindah kepada ayah, ibu tetap memiliki hak untuk menjalankan kewajibannya sebagai orang tua, seperti menemui dan membawa anak-anaknya untuk memberikan kasih sayang dalam pengasuhan ayah.
