Abstract

This study seeks to examine the challenges associated with cadre-based recruitment of the House of Representative candidates by political parties and to propose ideal frameworks for such recruitment. The current processes of political party recruitment are not comprehensive and encounter philosophical, sociological, and juridical issues. Philosophically, recruitment practices and orientations differ widely among parties, with some adopting populist methods and others being controlled by party elites. Sociologically, a feudalistic political culture ties parties to certain figures, promoting a pragmatic approach aimed at winning elections rather than ensuring candidate quality. Juridically, while Law Number 2 of 2011 mandates democratic cadre recruitment, Law Number 7 of 2017 on General Elections lacks clear requirements for nominating cadres, resulting in inconsistencies between the laws. This research employs a normative legal methodology, incorporating conceptual, statutory, and comparative approaches. The study involves analyzing regulatory documents, books, journals, and other relevant scholarly works to explore how legal provisions are implemented in society. The findings indicate that problems in cadre-based recruitment arise from ambiguous principles and orientations in regulations. Future arrangements should prioritize party ideology and orientation, drawing on practices from Malaysia and the United States. It is crucial to establish statutory principles for political party cadre and recruitment, focusing on character, utility, ideology, vote balance, democracy, transparency, justice, and equality.

Abstract

Penelitian ini bertujuan untuk mengetahui pengaturan kewenangan dalam melakukan pengawasan terhadap Alokasi Dana Desa (ADD) oleh lintas kementerian secara terpadu. Penelitian ini merupakan penelitian hukum normatif. Pendekatan penelitian menggunakan pendekatan perundang-undangan (statute) dan pendekatan kasus. Hasil penelitian menunjukkan bahwa pengaturan kewenangan dalam melakukan pengawasan terhadap Alokasi Dana Desa oleh Kementerian Dalam Negeri melalui pegawasan terhadap perencanaan pengelolaan keuangan desa terkait penerimaan dan pengeluaran pemerintahan desa. Sedangkan oleh Kementerian Desa, Pembangunan Daerah Tertinggal, dan Transmigrasi melakukan pengawasan melalui pencermatan dan penyelarasan rencana kegiatan dan pembiayaan pembangunan desa. Pelaksanaan pengawasan Alokasi Dana Desa dilakukan melalui Pelaporan Pengelolaan Keuangan Desa dan Pelaporan Pemanfaatan Dana Desa. Pelaporan Pengelolaan Keuangan dilakukan secara berjenjang mulai dari tingkat Desa hingga sampai pada Menteri Dalam Negeri di tingkat pusat. Sedangkan, Pelaporan Pemanfaatan Dana Desa dilakukan melalui pelaporan penetapan Prioritas Penggunaan Dana Desa kepada Menteri yang disampaikan dalam bentuk dokumen digital menggunakan Sistem Informasi Desa yang disediakan oleh Kementerian.

Abstract

Indonesia has been trying to develop democracy since the early independence. Assignment of the head of the region conducted from 1945 to 1999. After the big reformation in 1999, which started in 2004, Indonesia started a new chapter with the direct election model for regional heads. This research tries to find the philosophy of Indonesia’s choice to select its regional leader according to the law provided. The research is normative research with a conceptual and comparative approach. The results show that the election of regional leaders in Indonesia has not always been in line with the sovereignty of the people and the concept of democracy. Political choice has had a very significant impact. However, as it turns out into practice, as an emerging country in South East Asia, even though an assignment and not by the general election, leaders or regional heads are also considered as democratic as long as it is still on the path of openness, fair game and also according to people’s approval, including if it comes from the regional representative’s choice of candidates.

Abstract

This article examines the implications of the Joint Decree on Disrespectful Dismissal of the State Civil Apparatus, focusing on the dismissal of individuals who have completed their criminal sentences based on court decisions with permanent legal force (inkracht van gewijsde). Employing a Normative-Empirical research approach, the study was conducted in Palopo City, South Sulawesi Province, specifically at the Office of the Personnel and Human Resources Development Agency.The research identifies two key issues. Firstly, the Joint Decision Letter (Number 182/659/SJ, Number 15/2018, Number 153/Kep/2018) lacks specificity regarding sanctions against civil servants convicted of criminal offenses. This oversight poses a risk of maladministration actions, as it fails to address the potential consequences for non-compliance with the decree. Secondly, the article contends that the central government should not solely focus on dismissing civil servants convicted of corruption but also hold Personnel Supervisory Officials accountable for failing to enforce dismissals. This accountability serves as a crucial deterrent, discouraging selective application of sanctions and abuse of authority. The study underscores the importance of effective supervision and advocates for disciplinary training to instigate positive behavioral changes among employees, fostering a culture of adherence to legal mandates
