Abstract

Children are the hope of a nation. They are our next generation, and in their hands thefuture of this nation will be laid. As the successor of the nation, it is necessary for thepresent generation to provide protection to them from moral damage caused by the use ofdangerous content in printed and electronic media, especially content that containselements of violence and pornography. This research used normative research methodwhich is based on the study of legal materials from the literature and is as a process tofind the rule of law, legal principles, and legal doctrines in order to answer the contents ofthe law encountered. The legal protection for children and women is indeed an absolutething to be done by the government. They are the institution responsible for the continuityof an orderly, peaceful and prosperous community life. The legislation that regulates thelegal protection of children from dangerous content in printed and electronic media is stillgeneral. There are no specific rules aimed at providing legal protection for children fromdangerous content that might be present in printed and electronic media.

Abstract

All actions that harm everyone can be monitored by the court, while the review can be channeled through the State Administrative Court (PTUN). The State Administrative Court is one of the implementers of judicial power for the people seeking justice for State Administrative disputes. PTUN aims to resolve State Administrative disputes. Research methods in this papers using normative juridical research methods and using data collection techniques carried out using descriptive analysis techniques, with secondary data sources, which include primary legal materials such as laws and regulations relating to the rights of children and wives in divorce cases, sued unseen husbands, as well as secondary legal materials such as books, journals, articles, and other legal doctrines. State administrative disputes are disputes that arise in the field of State Administration between Persons or Civil Legal Entities and Legal Entities or State Administration Officials, both at the center and in the regions, as a result of the issuance of State Administrative Decrees, including employment disputes based on statutory regulations applicable. With the juridical analysis method, the author discusses the existence of PTUN as a form of legal protection for citizens from the act of state administration (abuse of power)

Abstract

The pace of improvement in internet technology will not only have a positive impact, but negative things will also appear as side effects including skimming crimes which are included in the form of cybercrime. Skimmer crime with the mode of installing tools on ATMs as a form of cybercrime crime and legal steps in overcoming the Crime of using information systems and electronic transactions. Through primary and secondary data developed and analyzed and reviewing Law Number 11 of 2008 and Law Number 16 of 2019 concerning Electronic Information and Transaction where it is known that the mode of operation of ATM electronic crimes as a form of cybercrime and the application of electronic information and transaction laws as an effort to overcome the crime of using information systems and electronic transactions.

Abstract

The involvement of women in various aspects of life, both socially and economically, has exposed the potential for criminal behaviour among women. This situation has led to the phenomenon of women's involvement in criminal acts commonly associated with men, such as robbery, murder, organized crime, and human trafficking. Poor social and economic conditions tend to be triggering factors and solid reasons for women to engage in criminal activities. This background has become the basis for the increasing number of women in prison in Indonesia, opening the possibility of various forms of violence within women's prisons. This presents a significant challenge for the management of women's prisons in optimizing the reintegration system due to the escalation of significant demotivation resulting from the violence experienced by female inmates, both among themselves and with prison staff. This research employs an exploratory qualitative approach, focusing on women involved in criminal cases and sentenced to prison. Primary data from interview results are descriptively analysed, producing a comprehensive, authentic, and representative narrative. The findings of this study indicate that the concept of punishment in Indonesia still emphasizes punitive functions over corrective functions, where both physical and mental violence are considered effective forms of punishment, especially for women. Violence occurring within women's prisons is then negatively responded to and becomes a driving factor for the decreased interest of female inmates in succeeding in the reintegration program. This reluctance then triggers a negative response from the staff in the form of violence against female inmates. A solution to mitigate violence in women's prisons is the placement in open prisons, with the involvement of independent external parties in both the supervision process and the implementation of reintegration programs to achieve an inclusive and constructive effect for all parties involved.

Abstract

Nama adalah identitas penting yang melekat pada diri seseorang. Merubah nama merupakan hal yang diperbolehkan oleh hukum di Indonesia, sebagaimana diatur dalam Undang-undang Nomor 24 Tahun 2013 tentang Perubahan Undang-undang Nomor 23 Tahun 2006 tentang Administrasi Kependudukan. Seseorang yang akan melakukan perubahan nama harus mengajukan permohonan perubahan nama kepada Pengadilan Negeri setempat guna dilakukan penetapan. hal tersebut untuk mengetahui bagaiman prosedur seta untuk mengetahui apabila perubahan tersebut ditolak oleh Pengadilan Negeri setempat. Penulisan ini melalui proses study kepustakaan dengan metode analisis yuridis normative. Dimana pengajuan perubahan nama seseorang pada Pengadian Negeri setempat apabila telah memenuhi persyaratan tentunya akan ditetapka, sebaliknya apabila tidak memenuhi prosedur serta syarat yang ditentukan makan akan ditolak

Abstract

This study aims to investigate efforts to preserve traditional Chinese marriages through marriage legalization in the city of Cirebon, Indonesia. The study used a qualitative approach with a descriptive type of research because it is to minimize changes in attitudes from the millennial generation that can cause the loss of traditions and cultural heritage of ancestors regarding customary marriage. The population studied was ethnic Chinese who are members of the Chinese Ethnic Social Clan, both traditionally and nationally. Data analysis was carried out using the content analysis method, using concepts from structural functionalism theory and social change theory as the framework of analysis. The results of the research show that marriages that are not registered can still be submitted for registration, even though they have exceeded the maximum limit (60 days) as long as a court decision in the form of a determination of marriage registration is obtained first. The validity of marriage is also studied from the theory of structural functionalalism. This research contributes to preserving cultural heritage by addressing the legal recognition of customarily married marriage in the Chinese ethnic community. The government needs to issue provisions that regulate the issue of the marriage registration mechanism due to the delay in marriage registration so that couples who have been married and have not been recorded get legal certainty that protects the validity of their marriage, especially regarding the status of children.
