Abstract

The climate change mitigation agenda in Indonesia urgently requires the realization of climate justice through inclusive approaches that involve non-state actors, such as foundations. As nonprofit legal entities, foundations possess strategic potential to implement climate change mitigation programs, particularly those based on carbon market mechanisms. However, to date, there is a lack of clear legal certainty allowing foundations to participate lawfully in such initiatives. This study aims to address three core questions: (1) What is the legal basis for foundations to engage in carbon-based climate mitigation programs? (2) How does the absence of carbon-related terminology in a foundation’s statutes (AD/ART) affect its legal authority? (3) What is the ideal regulatory framework that could ensure legal certainty for foundations in carrying out climate mitigation programs? This research employs a normative legal approach using library research methods, focusing on the analysis of relevant legislation and institutional documents of foundations involved in climate initiatives. The findings reveal that there is no explicit legal basis regulating the role of foundations in carbon-based mitigation programs. The absence of carbon-related nomenclature in the statutes of foundations creates the risk of exceeding their legal authority. Although Article 46 paragraph (2) point (d) of Presidential Regulation No. 98 of 2021 refers to “the public” as an actor in the implementation of the Carbon Economic Value (NEK), no derivative regulation clarifies whether foundations, as legal entities, are included in this category. The theoretical implication of this study emphasizes the need to reformulate the concept of climate justice within Indonesia's environmental law to formally recognize the institutional role of civil society. Such recognition is crucial for integrating legal certainty, regulatory effectiveness, and collective participation in the global climate mitigation agenda.

Abstract

Poligami sering kurang dipahami sehingga mendapatkan tanggapan yang kurang menyenangkan dari khalayak. Meskipun demikian, disepakati bukan ajarannya yang harus disalahkan tapi lebih kepada praktik yang tidak sesuai tapi lebih sering didasarkan untuk pemenuhan nafsu. Padahal di sisi lain, poligami dapat menjadi solusi sosial apabila dilakukan secara benar. Selain itu terdapat juga kriminalisasi dari poligami dan nikah siri.Masalah nikah siri juga ramai dibicarakan di berbagai media cetak maupun elektronik. Terdapat berbagai pandangan terhadap nikah siri terutama yang dilakukan tanpa adanya wali si perempuan. Dalam hal ini timbul berbagai pandangan. Penyuluhan hukum Poligami dan nikah siri yang dilakukan untuk memberikan pemahaman kepada masyarakat tentang hukum poligami dan nikah siri menurut undang-undang perkawinan. Dari hasil evaluasi, kegiatan pelatihan ini dapat dikatakan cukup berhasil. Dari pertanyaan yang diajukan peserta tergambar peningkatan pemahaman peserta terhadap hukum tentang poligami dan nikah siri dan diharapkan dapat segera terbentuk kelompok binaan yang dapat membantu masyarakat dalam menjawab berbagai persoalan yang berkaitan dengan poligami dan nikah siri di lingkungan masyarakat tersebut.

Abstract

Teenagers are the next generation of the nation that must continously be fostered to shape their identity and personality in accordance with Indonesian values. Various problems related to adolescents both as objects and as subjects have emerged with the development of information technology. Information technology has developed since the discovery and development of Science in the field of information and communication, starting from the development of communication system to communication equipment and direct and interactive communication tools. Social media is like a double-edged knife. If used wisely, selectively and responsibly, various social networking sites can be useful and beneficial. However, if used irresponsibly, social media can bring bad results, even legal problems. Therefore, social media users should be more careful in using the platform. The growing usage of social media among teenagers may bring negative impact if not addressed wisely due to teenagers’ vulnerability. The lack of legal knowledge on the use of social media may also cause adolescents becoming perpetrators and/or victims of social media.
