Abstract

Consumer protection is a crucial element in the concept of the rule of law in countries like Indonesia. Regulations regarding consumer protection are outlined in Law No. 8 of 1999 on Consumer Protection, along with Government Regulation No. 89 of 2019, which amends Government Regulation No. 59 of 2001 on Consumer Protection Organizations (Lembaga Perlindungan Konsumen Swadaya Masyarakat - LPKSM). Indonesia has established LPKSM as a non-governmental organization tasked with providing consumer protection services to the public. This institution is granted various powers through the Consumer Protection Act (UUPK). However, the issue arises regarding the authority of LPKSM to file lawsuits in court related to consumer protection. This research utilizes a normative legal research method. The findings reveal that the role of LPKSM in advocacy is not clearly defined, particularly whether it involves providing legal services similar to those of an advocate in court. However, based on the provisions in the Government Regulation regarding LPKSM, its role is limited to assisting consumers in filing complaints, as legal services are only provided to those who are legally qualified as advocates, as stated in Article 1, Paragraph 2 of Law No. 18 of 2003 on Advocates.

Abstract

Abstrak Pemerintah diberi kewenangan secara atribusi oleh Undang-undang Nomor 3 tahun 2005 tentang Sistem Keolahragaan Nasional untuk melaksanakan Penyelenggaran olahraga di Indonesia. Wewenang ini diberikan dengan tujuan agar pemerintah dapat bertindak sesuai rule of law sehingga tidak menimbulkan abuse of power. Peran dan kewenangan pemerintah tersebut ditindaklanjuti oleh Kemen terian Pemuda dan Olahraga yang mendirikan BOPI melalui Peraturan Menteri Pemuda dan Olahraga Republik Indonesia No. 09 Tahun 2015, akan tetapi Keputusan mengejutkan justru terjadi pada tahun 2020, BOPI justru dinyatakan dibubarkan oleh Presiden Jokowi pada tahun 2020 melalui Perpres No.112 tahun 2020, Pembubaran ini menimbulkan permasalahan, oleh karena tulisan ini akan mengkaji mengenai kedudukan dan kondisi penyelenggaraan olahraga pasca pembubaran BOPI melalui melalui Perpres No. 112 tahun 2020. Metode Penelitian dalam artikel ini menggunakan metode penelitian yuridis normatif. Hasil dari penelitian ini adalah pembubaran BOPI membuat penyelenggaraan olahraga di Indonesia tidak mempunyai mekanisme kontrol, verifikatur dan mediator dalam sengketa olarahraga. Adapun saran yang penulis berikan adalah Pemerintah melalui Menpora harus segara membuat gagasan dan kebijakan untuk menggantikan kedudukan dan peranan BOPI sebagai badan yang melakukan verifikasi terhadap terselenggaranya kompetisi profesional di Indonesia. The government has been authorized directly by Law Number 3 of 2005 concerning the National Sports System to conduct sports in Indonesia. This law provided this legacy intending to let governments act according to the rule of law and thus not resulting in increased power. The 2015 uprising for the BOPI follows up the government's role and authority. Yet, a surprising decision by 2020, with the release of the President's decree no.112 in 2020, the dissolution is problematic. Hence, this paper will review the post-breakup of BOPI's sports administration through the 2020 rule of President no. 112. The study of this article uses juridical research methods, which is that the dissolution of BOPI makes the country's sports arrangement obsolete. With the release of BOPI, Indonesia will not have any specialized bodies, verifications and a mediator in sports issues. As for the advice the writer gives is that governments should consistently make up the idea and policy of replacing BOPI's positions and roles as verification of professional competition in Indonesia.

Abstract

The implementation of parking policy authority by the Pekanbaru City Government is regulated under Pekanbaru City Regulation Number 20 of 2020 concerning Parking Organisation. According to this regulation, the Pekanbaru City Government is responsible for managing parking, which includes planning, implementation, supervision, and control. This research aims to examine the implementation of Article 19 of the regulation, the supporting factors, and the obstacles in supervising and managing parking officers in Pekanbaru City. The research findings highlight the importance of clear parking mechanisms and the protection of parking attendants. The applicable laws mandate that employers register parking attendants for employment social security. Failure to do so results in sanctions, including written warnings, fines, and restricted access to public services. However, the implementation faces challenges such as limited resources, lack of compliance, and enforcement difficulties. The study concludes that an effective parking policy requires a balance between authority and practical implementation. The government must ensure proper planning, supervision, and control over parking management while protecting the rights of parking attendants. Strengthening regulations, improving enforcement, and increasing public awareness are essential to achieving efficient parking governance in Pekanbaru City.

Abstract

The constitutionality in Indonesia is measured based on its alignment with the 1945Constitution. The examination of the role and appointment of the Chief of Authority in theSpecial Capital Region of the National Capital is essential to comprehend its governancemechanism. The Chief of Authority of the Indonesian Capital City is directly appointed by thePresident and serves a five-year term, which, however, does not conform to the general electionmechanism stipulated in Article 18 Clause 4 of the 1945 Constitution used by other regionalleaders.The type of research utilized in this study is normative legal research. In collecting data fornormative research, a literature review method (library research) was employed. This researchalso employs qualitative data analysis and generates descriptive data.From the research findings and discussions conducted, several conclusions are derived:firstly, the appointment of the Chief of Authority of the Indonesian Capital City by the Presidentpotentially violates the principle of regional autonomy regarding the direct appointment andplacement of the Chief of Authority by the President. This violation threatens the autonomy andauthority of regions, which contradicts the principle of decentralization mandated by Article 18Clause 4 of the 1945 Constitution. Secondly, the ideal concept of appointing the Chief ofAuthority of the Indonesian Capital City by the President aims to balance power between thecentral government and regional governments by maintaining the concept of checks andbalances and regional autonomy. The concepts of checks and balances and regional autonomyare considered crucial to prevent power abuse.The recommendations include proposing a judicial review of Article 4 Clause 1 letter b,Article 5 Clause 4, Article 9, Article 10, Article 13 Clauses (1) and (2) of the Law on theIndonesian Capital City, as well as on the division of authority between the central governmentand regions in the context of the Indonesian Capital City Authority in Article 10 of PresidentialRegulation Number 62 regarding the Indonesian Capital City Authority to ensure alignment withthe principles of regional autonomy stipulated in Article 18 Clause 4 of the 1945 Constitution.Additionally, the restoration of the role of the Regional People's Representative Council (DPRD)in the governance structure of the Indonesian Capital City Authority as the representation of thepeople in accordance with the provisions of Article 18 Clause 3 of the 1945 Constitution isrecommended. Furthermore, inclusive dialogue and active participation from all stakeholders,including the central government, regional governments, civil society, and other democraticinstitutions, in formulating policies related to the appointment of the Chief of Authority.Keywords: Chief of Authority, Indonesian Capital City, Regional Autonomy

Abstract

Riau University Faculty of Law's Merdeka Belajar Kampus Merdeka (MBKM) service program is an ambitious and far-reaching initiative, with the main goal of creating law-aware villages in three strategic locations: Ranah Baru Village, Batu Belah Village, and Naumbai Village. This initiative is not just an academic program, but also a transformative effort that aims to empower rural communities through improved legal literacy. As a concrete manifestation of MBKM vision, the program is comprehensively designed to improve legal understanding and awareness at the village level. With a holistic and sustainable approach, the program aims to create a community ecosystem that is not only law-abiding, but also has the capacity to identify, analyze, and resolve legal issues independently and equitably. Through a series of structured and directed activities, the program is expected to be a catalyst for significant social change. By improving the community's legal understanding, the program not only aims to reduce the potential for conflict and law violations, but also to build a strong foundation for sustainable and equitable village development. Ultimately, the envisioned law-aware village is expected to become a pilot model for the development of similar programs in other areas in Indonesia.

Abstract

The Regional Head Regulation in the hierarchy of laws and regulations can be interpreted through Article 8 paragraphs (1) and (2) of Law Number 12 of 2011 concerning the Establishment of Laws and Regulations. The existence of this Regional Head Regulation also raises several record problems, Regional Head Regulations have potential problems no less complicated than Regional Regulations. This is because the supervision of the Regional Head Regulation by the DPRD in Dumai City is not yet clear whose authority. Therefore, this study seeks to analyze how supervision of Regional Head Regulations is made in the context of delegation from higher laws and regulations as well as in the context of policy rules (beleidsregel). This research uses empirical juridical research methods. The results of this study show that the Dumai City DPRD has not been able to supervise the Regional Head Regulation made by the Mayor of Dumai. The suggestion in this study is that there must be clear rules regarding the authorities in supervising the Regional Head Regulation.
