Abstract

This study identifies specific legal loopholes and regulatory deficiencies contributing to white-collar crime, advocating adaptive legal reforms and a collaborative approach to fortify the legal framework. In the context of Dubai's rapidly growing economy, this study delves into the escalating global phenomenon of white-collar crime, focusing specifically on its prevalence within the emirate's financial sector. The study addresses the potential exploitation of legal frameworks and regulatory gaps, offering a contextualized analysis of the contributing factors amid Dubai's economic expansion. The research employs a comprehensive literature review to identify existing gaps in understanding, focusing on the distinctive challenges faced by Dubai. The research aims to furnish a comprehensive understanding of white-collar crime in the financial sector, emphasizing the mechanisms through which legal loopholes and regulatory shortcomings may facilitate such offenses. By pinpointing vulnerabilities, the study provides actionable insights for policymakers, regulatory authorities, and stakeholders to fortify the legal infrastructure and prevent financial misconduct. The findings not only deepen the comprehension of white-collar crime challenges in Dubai but also furnish practical insights for mitigating future risks, presenting a roadmap for policymakers to combat the evolving nature of financial offenses in the region. In conclusion, this study underscores the urgent need for adaptive legal reforms and enhanced regulatory measures to address the vulnerabilities within Dubai's financial sector.

Abstract

Dalam makalah ini, penulis membahas urgensi penerapan kerangka kerja kesiapan forensik digital, yang digunakan oleh Mahkamah Agung Republik Indonesia dan pemangku kepentingan dalam rangka mengidentifikasi, mengumpulkan, dan memelihara bukti digital dan merespons lebih cepat selama fase pasca-insiden tempat kejadian perkara (TKP) dari biasanya, dengan memulai pemeriksaan forensik digital sesegera mungkin, setelah deteksi insiden TKP, memperoleh bukti digital yang tersedia terlebih dahulu. Buku pedoman disusun dengan mempertimbangkan prinsip-prinsip persyaratan kesiapan forensik digital sejalan dengan standar internasional ISO/IEC 27043.

Abstract

Dalam makalah ini, penulis membahas urgensi penerapan kerangka kerja kesiapan forensik digital, yang digunakan oleh Mahkamah Agung Republik Indonesia dan pemangku kepentingan dalam rangka mengidentifikasi, mengumpulkan, dan memelihara bukti digital dan merespons lebih cepat selama fase pasca-insiden tempat kejadian perkara (TKP) dari biasanya, dengan memulai pemeriksaan forensik digital sesegera mungkin, setelah deteksi insiden TKP, memperoleh bukti digital yang tersedia terlebih dahulu. Buku pedoman disusun dengan mempertimbangkan prinsip-prinsip persyaratan kesiapan forensik digital sejalan dengan standar internasional ISO/IEC 27043.

Abstract

This study aims to identify specific legal loopholes and regulatory deficiencies that contribute to white-collar crime, with the goal of advocating for adaptive legal reforms and a collaborative approach to strengthen legal frameworks. The specific focus is on the prevalence of white-collar crime in the financial sector of the emirate, given Dubai's rapidly growing economy. Therefore, this study addresses the potential exploitation of legal frameworks and regulatory gaps to offer a contextualised analysis of the contributing factors during the economic expansion of the emirate. A comprehensive literature review was applied to identify existing gaps in understanding, with a focus on the distinctive challenges faced by Dubai. The intention was to provide a thorough understanding of white-collar crime in the financial sector with an emphasis on the mechanisms through which legal loopholes and regulatory shortcomings could facilitate such offences. The identification of the vulnerabilities led to the provision of actionable insights for policymakers, regulatory authorities, and stakeholders to fortify legal infrastructure and prevent financial misconduct. The results deepened our understanding of the challenges associated with white-collar crime in Dubai. They provided practical insights for mitigating future risks by presenting a roadmap for policymakers to combat the growing nature of financial offences in the region. In conclusion, this study highlights the urgent need for adaptive legal reforms and enhanced regulatory measures to address the vulnerabilities within Dubai's financial sector.

Abstract

For the first time, this study aims to comprehensively explore the landscape of innovation and healthy product development within Indonesian Small and medium-sized enterprises (SMEs) in the food and drinks industry. By addressing existing gaps, the paper provides insights into the context-specific factors, the role of healthy product variants, and the interconnected dynamics that drive innovation. The research employs a thorough literature review. The literature review establishes the foundation by identifying gaps and theoretical frameworks, including the Innovation Ecosystem Theory, to guide the analysis. The findings illuminate several key contributions of this research. First, the study crystallizes the specific new product development practices within Indonesian SMEs, addressing the lack of context-specific insights. It highlights the significance of healthy product development within a changing consumer landscape. The analysis reveals diverse strategies, challenges, and successes, emphasizing the role of networking, creative innovation drivers, and the absence of financial constraints. Furthermore, the introduction of a unified framework for innovation provides a holistic understanding that bridges theoretical constructs and practical applications. This study identifies flaws in the current innovation policy, suggesting actionable recommendations for improvement. In conclusion, this paper fills critical gaps in the literature, offering a comprehensive exploration of innovation and healthy product development within Indonesian SMEs in the food and drinks industry. By integrating context-specific insights, addressing gaps, and providing practical value for stakeholders and policymakers, the research significantly advances our understanding of healthy agricultural product development.

Abstract

The integration of Artificial Intelligence (AI) into the medical field has catalyzed groundbreaking innovations in diagnostics, treatment, and drug discovery, but it also presents complex challenges for intellectual property (IP) law. Traditional IP frameworks are increasingly ill-equipped to address issues of ownership, access, and benefit-sharing arising from AI-generated medical inventions. This research examines the limitations of existing IP laws in the context of healthcare AI, with a focus on their impact on equitable access and innovation. Using a literature review methodology, the research analyzes legal developments, empirical studies, and market trends, framed through Public Goods Theory and Collaborative Innovation Theory. The findings reveal that current IP regimes often foster monopolistic control, impeding access to essential AI-driven healthcare technologies, especially in low-resource settings. In response, the research proposes a collaborative IP ownership model that distributes rights among AI developers, healthcare institutions, and patients. This model supports innovation while promoting equitable access through mechanisms such as flexible licensing, price regulation, and public–private partnerships. The research concludes by recommending legal reforms to encourage global collaboration and ensure that the benefits of AI in healthcare are accessible to all.

Abstract

This paper explores the complexities of criminal liability for inadvertent negligence through a comparative and interdisciplinary approach. While civil law jurisdictions, such as Germany, embrace a broad scope for criminal negligence, common law systems, including those in the United States and the United Kingdom, and typically restrict criminal liability to more severe forms of negligence. By integrating legal theory with philosophical and psychological perspectives, this study examines the moral and cognitive dimensions of negligence. It proposes a framework for a more just and effective legal system. The findings highlight significant disparities between legal systems and provide recommendations for harmonizing definitions, enhancing judicial training, increasing public awareness, and promoting international dialogue. This research contributes novel insights into the application of negligence laws and advocates for a balanced approach to criminal liability.

Abstract

The integration of artificial intelligence (AI) into national security frameworks has introduced transformative opportunities and challenges, particularly within the European Union (EU). While the EU's AI Act represents a milestone in regulating AI technologies, its national security exception raises significant concerns about oversight, accountability, and compliance. This study examines the implications of this exception for Indonesia-EU relations, focusing on AI governance and its intersection with national security. Using a literature study method, the research analyzes comparative legal frameworks, highlighting the EU's approach and its relevance to Indonesia. The findings underscore critical gaps in Indonesia's AI governance, including the need for robust oversight mechanisms and alignment with international standards. The study concludes that fostering bilateral collaboration, strengthening regulatory frameworks, and balancing security with human rights are essential for advancing AI governance in Indonesia while enhancing its partnership with the EU. Meskipun UU AI Uni Eropa merupakan tonggak penting dalam mengatur teknologi AI, pengecualian keamanan nasionalnya menimbulkan kekhawatiran signifikan mengenai pengawasan, akuntabilitas, dan kepatuhan. Penelitian ini mengkaji implikasi pengecualian ini terhadap hubungan Indonesia-UE, dengan fokus pada tata kelola AI dan persimpangannya dengan keamanan nasional. Menggunakan metode studi literatur, penelitian ini menganalisis kerangka hukum komparatif, menyoroti pendekatan UE dan relevansinya bagi Indonesia. Temuan penelitian menunjukkan adanya celah kritis dalam tata kelola AI Indonesia, termasuk kebutuhan akan mekanisme pengawasan yang kuat dan keselarasan dengan standar internasional. Penelitian ini menyimpulkan bahwa memperkuat kolaborasi bilateral, memperkuat kerangka regulasi, dan menyeimbangkan keamanan dengan hak asasi manusia adalah hal yang penting untuk memajukan tata kelola AI di Indonesia sambil meningkatkan kemitraannya dengan UE. Wawasan ini menawarkan peta jalan praktis bagi pembuat kebijakan dan berkontribusi pada diskursus yang berkembang tentang regulasi AI yang adil dan akuntabel.

Meskipun UU AI Uni Eropa merupakan tonggak penting dalam mengaturteknologi AI, pengecualian keamanan nasionalnya menimbulkan kekhawatiransignifikan mengenai pengawasan, akuntabilitas, dan kepatuhan. Penelitian inimengkaji implikasi pengecualian ini terhadap hubungan Indonesia-UE, denganfokus pada tata kelola AI dan persimpangannya dengan keamanan nasional.Menggunakan metode studi literatur, penelitian ini menganalisis kerangka hukumkomparatif, menyoroti pendekatan UE dan relevansinya bagi Indonesia. Temuanpenelitian menunjukkan adanya celah kritis dalam tata kelola AI Indonesia, termasukkebutuhan akan mekanisme pengawasan yang kuat dan keselarasan dengan standarinternasional.
