Abstract

The percentage of early marriages in South Kalimantan is the highest in Indonesia but the poverty rate in this province is the third lowest. This gives an early indication that early marriages in the province are not associated with poverty. Therefore, the case of early marriages in South Kalimantan is interesting to be observed. This study investigates what are the causes of early marriages in South Kalimantan and whether early marriages have a correlation with poverty and other indicators such as education and health levels. To answer that, data collection is done by documentation of interviews transcript and data report from the Central Statistics Agency of South Kalimantan. This study finds that the causes of early marriages in South Kalimantan relate to economic problems and as a way to protect families.  This study also finds that there is a significant negative correlation between early marriages and the level of education ( -0,005 < 0,05) and between early marriages and health (-0,001 < 0,05). Surprisingly, there is no significant correlation between early marriages and poverty (0,073 > 0,05).  This means that the higher the number of early marriages, the lower the level of education and health and vice versa.  This finding is important for policy makers, communities, and religious leaders to focus on supporting public education to prevent early marriages and break the cycle of problems associated with early marriages. Persentase pernikahan dini di Kalimantan Selatan tertinggi di Indonesia tetapi angka kemiskinan di Provinsi ini berada posisi tiga terendah. Hal tersebut memberi petunjuk awal bahwa pernikahan dini di provinsi ini tidak berhubungan dengan kemiskinan. Oleh karena itu, kasus pernikahan dini di Kalimantan Selatan menarik untuk dicermati. Penelitian ini mencari penyebab terjadinya pernikahan dini di Kalimantan Selatan dan korelasi antara pernikahan dini dengan tingkat pendidikan, kesehatan, dan kemiskinan. Untuk menjawab itu pengumpulan data dilakukan dengan dokumentasi transkrip wawancara dan laporan data dari Badan Pusat Statistik Kalimantan Selatan. Penelitian ini menemukan bahwa penyebab terjadinya pernikahan dini di Kalimantan Selatan adalah permasalahan ekonomi dan sebagai cara untuk melindungi keluarga. Selain itu, penelitian ini menemukan bahwa pernikahan dini berkorelasi signifikan dengan tingkat pendidikan (-0,005 < 0,05) dan kesehatan (-0,001 < 0,05) dengan nilai negatif, tetapi pernikahan dini tidak berkorelasi signifikan dengan kemiskinan (0,073 > 0,05). Dengan demikian dapat disimpulkan bahwa jika persentase pernikahan dini menurun, tingkat pendidikan dan angka harapan hidup akan meningkat. Temuan ini penting untuk pengambil kebijakan, komunitas, serta tokoh agama untuk fokus pada dukungan terhadap pendidikan masyarakat untuk mencegah pernikahan dini dan memutus siklus permasalahan yang terkait dengan pernikahan dini.

Abstract

In fact, the practice of polygamy in the Banjar community is often carried out without being recorded and gives rise to legal problems, not only in the form of not fulfilling the right to justice but also gives rise to physical, verbal, and psychological violence. It is often that religion becomes a 'shield' in the form of unconscious motives to cover up the truly practical motives. The purpose of this writing is to describe why the practice of polygamy in Banjar society, with its duality of motives, actually creates problems and why religion is always a 'shield'. This research was conducted empirically with data obtained from the interview process with informants and then analyzed using a socio-legal approach. Based on the results of the study, it was found that the practice of polygamy for religious reasons as an unconscious motive has the potential to give rise to unfair polygamous behavior, acts of violence, and a disregard for the protection of rights and the law. The textual and partial interpretation of polygamy texts supported by a patriarchal socio-cultural system is the basis for legitimizing this behavior, even though this behavior is not by the essential goals of marriage including polygamy and the applicable regulations. Making religion an unconscious motive is something that is considered effective in legitimizing polygamy because, by the religious character of Banjarese society with Islam being an ethnic identity, the practice of polygamy is understood as a natural and legitimate thing.  This condition is strongly supported by the traditionalist reasoning that many Banjar people adhere to so that often the understanding of a tuan guru includes polygamy as an accepted truth. This is because of the position of the tuan guru who is considered as an authoritative figure in every aspect of Banjarese people's life.
