The existence of Sharia mortgage is initially supported by the success of Islamic Banking and the Muslims necessary of the existence of mortgage principled with sharia. Nowadays, motivation of Muslims for transaction is not only influenced by religious motivation, but also on their attitudes and perceptions, such as relative advantage, location and others. It becomes a question to society in Banjarmasin, who are predominantly Muslim, whether religious factors or other factors are more dominant to influence the preferences of clients (attitudes and motivation) in transactions in Shariah mortgage Kebun Bunga branch office, Banjarmasin.

Abstract :This research suggests that increasing economic growth effect on land use Banjarmasin called the increasing needs of economic land, which in turn affects the conversion of agricultural land, swamp and bush into residential land, industry and trade. In Islamic view due to conditions that occur in Banjarmasin is like two poles masalih and mafasid mutual attraction between infltration needs such as paddy felds, swamps and thickets with the residential land needs which important for the beneft entirely. This condition can be minimized by the efforts of economic equality through justice and equitable development as well as economic growth in the Islamic concept.Abstract : Penelitian ini menunjukkan bahwa peningkatan pertumbuhan ekonomi berpengaruh terhadap tata guna lahan kota Banjarmasin yakni meningkatnya kebutuhan lahan ekonomi yang pada akhirnya berdampak pada alih fungsi lahan pertanian, rawa dan semak menjadi lahan pemukiman, industri dan perdagangan. Dalam pandangan Islam kondisi yang terjadi pada kota Banjarmasin ini ibarat dua kutub masalih dan mafasid yang saling tarik menarik antara kebutuhan lahan resapan seperti sawah, rawa dan semak dengan kebutuhan terhadap lahan pemukiman yang seluruhnya penting bagi kemaslahatan. Kondisi ini dapat diminimalisir dengan upaya pemerataan ekonomi melalui keadilan dan pemerataan pembangunan sebagaimana konsep pertumbuhan ekonomi dalam Islam.

The Islamic law of today has the relationship with the past Islamic law. In the history process, the growth and development of Islamic law show a dynamics of religious though and describe the clash of religious and the development of social and cultural where the law grows. Therefore, is it appropriate if there is a view that Islamic law is something sacred, immutable and rigid. History fact, especially Islamic law in the golden era, will give a reality about tasyri construction or Islamic law legislation and about emergence of mazhab.

In fact, the practice of polygamy in the Banjar community is often carried out without being recorded and gives rise to legal problems, not only in the form of not fulfilling the right to justice but also gives rise to physical, verbal, and psychological violence. It is often that religion becomes a 'shield' in the form of unconscious motives to cover up the truly practical motives. The purpose of this writing is to describe why the practice of polygamy in Banjar society, with its duality of motives, actually creates problems and why religion is always a 'shield'. This research was conducted empirically with data obtained from the interview process with informants and then analyzed using a socio-legal approach. Based on the results of the study, it was found that the practice of polygamy for religious reasons as an unconscious motive has the potential to give rise to unfair polygamous behavior, acts of violence, and a disregard for the protection of rights and the law. The textual and partial interpretation of polygamy texts supported by a patriarchal socio-cultural system is the basis for legitimizing this behavior, even though this behavior is not by the essential goals of marriage including polygamy and the applicable regulations. Making religion an unconscious motive is something that is considered effective in legitimizing polygamy because, by the religious character of Banjarese society with Islam being an ethnic identity, the practice of polygamy is understood as a natural and legitimate thing. This condition is strongly supported by the traditionalist reasoning that many Banjar people adhere to so that often the understanding of a tuan guru includes polygamy as an accepted truth. This is because of the position of the tuan guru who is considered as an authoritative figure in every aspect of Banjarese people's life.

This study examines the jujuran tradition in Banjar society, a cultural practice where the groom's family provides monetary or material gifts to the bride's family during marriage rituals. Rooted in pre-Islamic customs, jujuran persists due to its alignment with Islamic principles when practiced as a cultural tradition. Using qualitative methods, including literature review and field observations, the study highlights jujuran as a symbol of respect, wedding support, and social prestige, distinct from mahr in Islamic law. The findings underscore the significance of jujuran in fostering family bonds and preserving cultural identity amidst modern social dynamics.

This study aims to find the concept of match making or coercion in marriage against women. Women are more sensitive to match making issues and express disagreement with practices that violate women’s rights and endanger their future. However, previous researchers also considered match making coercion, sowe tried to research what if it was adapted to the concept of kafa'ah according to Shariah. The method used in this researchis a literature review by looking at the book an-nikah by Shaykh Muhammad Arsyad Al-Banjari, written in the 17th century AD. Through a hermeneuticalapproach, the researcher explores the marriage problems that her parents thought to becornering women in marriage problems. We try to uncover marriage problems that are sometimes considered to push women into marriage problems by their parents. This research proves that the concept of kafa'ah in al-Banjari theory can eliminate the perception of match making with a coercive system, because in the kafa'ah what is prioritized is a person's faith relationship which is ultimatelyable to maintain the honor of his wife and family. Not only in terms of material, but more inclined to approach immaterial needs. The Immaterial approach is evidenced by the harmonious relationship between the two families of the bride and groom.

This research relates to the belief in the hereditary tradition of providing 41 kinds of wadai or cakes in the month of Safar which is still practiced by some Banjar people. The 41 kinds of wadai or cakes are one of the culinary specialties of Banjarmasin, South Kalimantan. The provision of 41 kinds of wadai or cakes is done in the month of Safar because people still believe that Safar is a month full of bad luck. The 41 kinds of wadai are held to ask for protection and keep people away from various misfortunes or calamities. The method used in this research is a field research method that still occurs in Banjar society and a qualitative approach with literature study, which refers to the literature on the issues studied. Wadai or 41 kinds of cake is one of the requirements for various traditional events in Banjar society, one of which is the tradition of providing this wadai in the month of Safar which is believed to provide protection for the community. This study also aims to determine the view of Islamic law regarding the belief in the hereditary tradition of providing 41 kinds of wadai in the month of safar.

Abstract This paper explores the concept of Radha'ah, a practice of breastfeeding recognized by Islamic scholars. Radha'ah refers to the act of nursing that establishes a mahram relationship between the nursing mother and the nursed individual. The discussion involves the perspectives and assessments of prominent Islamic scholars regarding the legitimacy and relevance of this concept within the framework of Sharia. The research delves into the legal foundations and hadiths that discuss Radha'ah, exploring the scholars' understanding and interpretations that either support or oppose it. Analysis of this concept involves an understanding of the conditions that must be met for a mahram relationship to be established through the practice of Radha'ah. The study also highlights the historical and cultural contexts shaping scholars' perceptions of this practice. Furthermore, this paper investigates the practical implications of Radha'ah in the everyday lives of Muslims. In discussing this aspect, attention is given to how the understanding of Radha'ah contributes to a broader comprehension of Islamic family dynamics and societal norms. Radha'ah merujuk pada tindakan menyusui yang dapat menjadikan dua individu yang terlibat sebagai mahram. Diskusi melibatkan pandangan dan penilaian para ulama terkemuka dalam Islam terhadap keabsahan dan relevansi konsep ini dalam konteks syariah. Penelitian ini mendalam ke dalam landasan hukum dan hadis yang membahas Radha'ah, mengeksplorasi pemahaman dan interpretasi ulama yang memperkuat atau menentangnya. Analisis terhadap konsep ini melibatkan pemahaman tentang syarat-syarat yang harus dipenuhi agar hubungan mahram dapat terbentuk melalui praktik Radha'ah. Penelitian ini juga menyoroti konteks historis dan budaya yang membentuk pemahaman para ulama terkait dengan praktik ini. Selain itu, makalah ini menggali implikasi praktis Radha'ah dalam kehidupan sehari-hari umat Islam. Dalam membahas hal ini, diperhatikan bagaimana pemahaman terhadap Radha'ah dapat memberikan kontribusi dalam pemahaman keluarga dan masyarakat Islam secara lebih luas.
