Abstract

The current use of contraception is dominated by short term methods with a one month drop out rate for contraception pills and injections that contribute 30.6 percent and 46.3 percent, respectively, for women aged 15-49. The high use of short term contraceptives can result in gaps for acceptors to stop using contraception. The analysis aims to investigate switching behaviour among contraceptive users by different source of health facilities both for modern and traditional methods and the analysis also intends to identify sociodemographic factors characterizing switchers. This analysis resulted in four models of sociodemographic factors and their relationship with the possibility of transferring to another contraceptive method which were analyzed using logistic regression in each unit of analysis based on the source of the health facility. Short term contraception is still the favorite, namely injections (50.5 percent) and pills (19.1 percent) are still the main choice for couple of childbearing age. Around 61.2 percent of acceptors who use injectable contraception survive compared to other contraception use in private and community based health facilities. The pattern of family planning use in health facilities in the government sector is at least able to intervene in acceptors in the use of long term contraception which effectively has a lower dropout rate than the dropout rate for short term contraceptives.

Abstract

Regime or government change has specificlegal political characteristics, including the Political Law of Family Planning. Each period of government has different views and policies on the implementation of the national family planning program as one of the programs in population control in Indonesia. This study aims to determine the effect of legal politics on the success of the family planningprogram in Indonesia by analyzing statutory regulations in the form of policy rules relating to the family planning program at each government period. The research method used is juridical-normative research through a literature review approach by analyzing policies in the form of laws and regulations and other literatures related to family planning programs. Data collection techniques are through library research and problem approaches through thestatue approaches, historical approaches, and comparative approaches. The results show that there is a relationship between the politics of law or policies issued by a regimeand family planning program intervention.

Abstract

Keberadaan Pasal 8 Undang-Undang Nomor 12 Tahun 2011 tentang Pembentukan Peraturan Perundang-undangan, menjadi permasalahan dikarenakan tidak semua peraturan yang dibentuk oleh lembaga negara atau pejabat dapat dikategorikan sebagai peraturan perundang-undangan. Studi ini ingin mengidentifikasi jenis peraturan yang dibentuk oleh lembaga kekuasaan legislatif yaitu Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, dan Dewan Perwakilan Daerah, apakah masuk ke dalam internal regulation atau peraturan perundang-undangan dan bagaimana dengan uji materilnya. Studi ini menggunakan metode penelitian yuridis normatif, melalui pendekatan peraturan perundang-undangan dan konseptual yang akan dianalisis secara deskriptif kualitatif. Hasil studi menjawab, secara teori peraturan yang dibentuk oleh Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, dan Dewan Perwakilan Daerah masuk ke dalam kategori internal regulation. Namun demikian, dalam praktiknya masuk ke dalam kategori peraturan perundang-undangan yang ditegaskan dengan adanya Pasal 8 Undang-Undang No. 12 Tahun 2011. Dikarenakan termasuk peraturan perundang-undangan di bawah undang-undang, sehingga Peraturan Majelis Permusyawaratan Rakyat, Dewan Perwakilan Rakyat, dan Dewan Perwakilan Daerah masuk ke dalam Objek Hak Uji Materil Mahkamah Agung.

Abstract

Masih banyak peraturan perundang-undangan sebagai peraturan pelaksana (subordinate legislations) yang belum dibuat atau ditetapkan pada Undang-Undang Nomor 52 Tahun 2009 tentang Perkembangan Kependudukan dan Pembangunan Keluarga. Padahal Undang-Undang Nomor 52 Tahun 2009, secara jelas dan tegas memerintahkan untuk membuat peraturan pelaksana dalam bentuk Peraturan Pemerintah, Peraturan Presiden, Peraturan Menteri yang bertanggung jawab di bidang kesehatan, dan Peraturan Menteri sesuai dengan kewenangannya. Dari sekian banyak peraturan pelaksana yang harus dibentuk, namun demikian baru terdapat 3 (tiga) produk hukum yang dihasilkan. Berdasarkan hal tersebut, tulisan ini untuk menjawab permasalahan: 1) apakah ada konsekuensi hukum pendelegasian kewenangan dari undang-undang (delegated legislation) kepada penerima kewenangan dan 2) apakah konsekuensi hukum apabila tidak dijalankannya “delegated legislation”. Penelitian ini menjawab akibat dari adanya subtansi yang multisektor dan kurang dimaksimalkannya rapat koordinasi antarkementerian dan/atau nonkementerian, sehingga tidak menghasilkan kesepakatan untuk menentukan pemrakarsa. Meskipun Pasal 62 Undang-Undang Nomor 52 Tahun 2009 tentang Perkembangan Kependudukan dan Pembangunan Keluarga menyebutkan “Peraturan perundang-undangan sebagai pelaksanaan Undang-Undang ini ditetapkan paling lambat 1 (satu) tahun sejak tanggal pengundangan Undang-Undang ini”. Akan tetapi tidak didukung dengan adanya sanksi apabila ketentuan tersebut tidak dijalankan. Sehingga kelalaian atau kealpaan dari pemerintah tidak memiliki konsekuensi hukum apapun.

Abstract

Freedom of the press is another side of press accountability. The press must obey the ethics of the press profession regulated by the press organization. Meanwhile, journalistic work is within the corridor of laws and regulations governing the press. On the one hand, the press works in the spirit of freedom, on the other hand, the press also demands accountability. This study shows that the Indonesian press was free after the end of the Soeharto Authoritarian Government. However, the gift of press freedom was also faced with various violations of the ethics of the press profession, which led to legal problems. The researcher used a normative legal research methodology. This study uses a normative research methodology. This study concludes that in addition to "freedom of the press", journalistic work is also required to obey the ethics of the journalistic profession regulated by the press organization.
