Abstract

Indonesia as the biggest maritime state has not only advantages but also obstacles in managing sea. Called potential because of its large resources but it also brings into a fact of the lack in exploitation of the sea. Such transportation and exploitation have caused a lot debris in the sea which is harmful. This article aims to examine state responsibility in prevent and tackle marine debris. It also aims to enhance local wisdom as solution. This article is normative juridical, using statute and conceptual approach. It is made deductive from specific issue into general issue based on primary, secondary, and tertiary legal materials. After collecting all material, this article then analyzes it qualitatively. The result show that state responsibility has been implemented only in level of regulation. Although some regulation has underlined local wisdom as important matter, in fact, Indonesia still in process of inventory related local wisdom and still far from enhancing the local wisdom as solution to prevent and tackle marine debris. These practices are different to some states which apply their local wisdom as one of solution. Therefore, Indonesia must collaborate legal policy and local wisdom to achieve higher result in preventing and tackling marine littering. A legal policy that born from the way of life in community may accepted better.

Abstract

Children are the next generation of a state, no exception for child prisoner. There is limitless future for all children in the world, including Indonesia. The problem is, some of child prisoner transform into adult prisoner because their life background makes them hard to rejoin or accepted in any social community. This article aims to examine the best method for child prisoner mediation based on principle of for the best interest of the child. This article is a sociological juridical research, using secondary data and field data as addition. The data collected by using library research and analyzed qualitatively. This article finds that child prisoner mediation will help to provide opportunity for child prisoner and family members or other stakeholder to meet, with the help of a mediator, before release to have an open, honest, and sincere dialogue to prepare for the transition back into the community. The best interest of the child remains as core principle without decreasing other necessary principle in succussing mediation process. Child prisoner mediation is a process of mediation held especially for child prisoner and will restore the future of child prisoner in Indonesia.Keywords: child prisoner; community; mediation

Abstract

Pancasila sebagai landasan filosofis dan ideologi negara Indonesia memegang peranan penting dalam pembentukan kerangka hukum negara. Sebagai sumber hukum tertinggi, Pancasila menjadi pedoman dalam perumusan peraturan perundang-undangan dan kebijakan hukum nasional. Namun, proses pembentukan hukum sering kali dipengaruhi oleh kepentingan politik, yang dapat memengaruhi kualitas dan keselarasan hukum dengan nilai-nilai dasar Pancasila. Penelitian ini mengkaji hubungan antara kepentingan politik dan pembentukan peraturan perundang-undangan di Indonesia dari perspektif Pancasila sebagai sumber hukum. Penelitian ini mengkaji apakah pengaruh politik dapat diterima dalam proses legislasi dan bagaimana pengaruhnya terhadap kualitas produk hukum. Temuan penelitian ini menyoroti bahwa ketika kepentingan politik selaras dengan prinsip-prinsip Pancasila, maka hal tersebut berkontribusi pada terciptanya hukum yang adil dan berorientasi pada kesejahteraan. Sebaliknya, ketika motivasi politik bertentangan dengan prinsip-prinsip tersebut, maka akan menghasilkan produk hukum yang mungkin tidak mencerminkan nilai-nilai inti bangsa, yang berujung pada resistensi masyarakat. Oleh karena itu, menjaga integritas Pancasila sebagai dasar perumusan hukum sangat penting untuk memastikan bahwa hukum Indonesia tetap adil, demokratis, dan selaras dengan identitas nasional

Abstract

The Fourth Industrial Revolution (Industry 4.0) has significantly transformed various sectors, including air transportation. Technologies such as the Internet of Things (IoT), artificial intelligence (AI), big data, and automation have driven innovations like drones and flying cars. In Indonesia, the implementation of flying cars has begun testing in the New Capital (IKN) as part of a transformation towards smarter and environmentally friendly transportation. However, these developments also present challenges in air traffic regulations. Law No. 1 of 2009 on Aviation and its related regulations have not fully accommodated these new technologies. This study examines how air transportation law in the Industry 4.0 era can be analyzed from a futuristic legal perspective and the welfare state theory. The state plays a crucial role in ensuring adaptive regulations, including aspects of safety, privacy, and harmonization with international regulations. This research employs a normative juridical method, relying on literature studies and secondary data analysis. A qualitative descriptive approach is used to analyze regulations relevant to advanced air transportation technology. The research findings indicate that technological advancements such as drones and flying cars necessitate updates in air transportation law. Responsive regulations and adequate infrastructure are essential to ensure that innovations in air transportation can operate safely, efficiently, and inclusively
