Abstract

Penelitian ini bertujuan yang Pertama Mengkaji dan menganalisis indikator masyarakat hukum adat di Indonesia berdasarkan ketentuan Pasal 18B ayat (2) UUD 1945; Kedua, Mengkaji dan menganalisis pengaturan hak-hak dan wewenang masyarakat hukum adat dalam pengelolaan sumber daya alam pada petuanan laut; Jenis penelitian yang digunakan dalam penelitian ini yaitu Penelitian ini akan menggunakan tipe penelitian hukum normatif yaitu suatu proses untuk menemukan aturan hukum, prinsip-prinsip hukum, maupun doktrin-doktrin hukum guna menjawab isu hukum yang dihadapi serta suatu penelitian yang terutama mengkaji ketentuan-ketentuan hukum positif maupun asas-asas hukum. Hasil penelitian menunjukkan Bahwa Pengaturan eksistensi masyarakat hukum adat sebagaimana diatur dalam Pasal 18B ayat (2) UUD 1945 merupakan pengakuan bersyarat yang dilakukan oleh negara. Syarat eksistensial ini tidak perlu dicantumkan dalam Pasal 18B ayat (2) UUD 1945, oleh karena politik hukum pembentukan pasal ini sebagai upaya reformasi terhadap Undang-Undang Nomor 5 Tahun 1979. Pada hakikatnya pengaturan dalam Undang-Undang Nomor 5 Tahun 1979 tersebut bertentangan dengan Pasal 18 UUD 1945 (sebelum amandemen), karena tidak mengakui adanya hak-hak masyarakat hukum adat. Pengaturan hak dan wewenang masyarakat hukum adat dalam berbagai undang-undang tidak mengakomodir adanya hak dan wewenang masyarakat hukum adat dalam pengelolaan sumber daya alam pada wilayah pesisir (petuanan laut). Masyarakat hukum adat yang memiliki hak bawaan tentunya akan dirugikan dari pengaturan tersebut. Padahal, hak dan wewenang masyarakat hukum adat merupakan hak bawaan yang diakui dalam UUD 1945, karena itu masyarakat hukum adat tetap memiliki hak dan wewenang dalam pengelolaan sumber daya alam pada wilayah petuanan laut. Masyarakat Di Kepulauan Kei (Tanimbar Kei) secara nyata telah mengatur dalam Peraturan Adat terkait penyelenggaraan kegiatan di wilayah petuanan pesisir dan laut, menunjukan bahwa masyarakat di Kepaualauan Kei (Tanim,bar Kei) masih eksis dalam pengelolaan wilayah petuanan pesisir dan laut.

Abstract

Introduction: The village head is part of the government apparatus at the lowest level, playing an important role in helping to achieve legal certainty regarding land rights.Purposes of the Research:  The purpose of the current research is to know and analyze what authority the village head has in making a land certificate and to know and analyze what the legal consequences are if there is an abuse of the village head's authority in making a land certificateMethods of the Research: The research method in this study is normative legal research, using a statutory and conceptual approach. Sources of research data include primary, secondary, tertiary legal sources. The data collection technique is in the form of literature study. Processing and analysis of legal materials used in writing is using a qualitative analysis method.Results of the Research: The result of the research show that it was found that abuse of authority was found in the case of land acquisition for the AL wharf in Tawiri Ambon City, unscrupulous village heads abused authority in making land certificates for land sale and purchase transactions in 2015, the letter was made by for his personal interests and verified by the sub-district head ambon bay.

Abstract

ABSTRACT: Article 34 paragraph 3 of the Constitution of the Republic of Indonesia states that the state is responsible for providing health service facilities and adequate public service facilities to the community. Furthermore, Article 45 paragraph 1 letter a of Law Number 22 of 2009 concerning Road Traffic and Transportation "states that supporting facilities for the implementation of road traffic and transportation include sidewalks, the provision of which is provided by the local government. “Article 113 paragraph 1 letter a government regulation number 79 of 2013 concerning Road Traffic and Transportation Networks states that sidewalks are also a form of public service provided by the government as supporting facilities for road traffic and transportation in the form of provisions for pedestrians. Article 11 Paragraph 2 of Law Number 38 of 2004 concerning Roads "states that sidewalks are useful spaces for pedestrians. In accordance with the problems raised, the type of research used in this writing is normative juridical legal research. Legal research is a process of discovering legal rules, legal principles and legal doctrines in order to answer the legal issues faced. The Ambon City Government regarding changing the function of sidewalks in Ambon City is currently not in accordance with Article 4 paragraphs 3 and 4 of Ambon City Regional Regulation No. 10 of 2014 concerning the Arrangement of Street Vendors, which states (3) Locations that cannot be designated as business premises for street vendors The five are as follows: within government agencies, within schools, within places of worship, around market locations, on roofs and sewers, in city parks and green lanes, around monuments and hero's graves, throughout the body road.

Abstract

The Village Government carries out various village government activities which are contained in the statutory regulations. This research aims to find out and analyze whether the action of dismissing the Chair of the Village Consultative Body by the Village Head is not legal. To find out and analyze the impact and legal consequences that occur regarding the actions of the Village Head who do not have legality in dismissing the Chair of the Village Consultative Body. This research includes normative juridical. 1. The results of the research are based on Articles 12, 14, 15, 17, 18, 19, 20, 21, 27, 28, 29, 30, 32, 33, 34, 35, 46, 47, Article 63 of Permendagri 110 of 2016 concerning Village Consultative Body, and Articles 55, 56, 58, 59 of Law Number 6 of 2014 concerning Villages, the village head does not have direct authority to dismiss members/leaders of the Village Consultative Body or appoint new members of the Village Consultative Body. So the dismissal of the Chairman of the Village Consultative Body carried out by the Village Head has no legality. The Legal Consequences if the action of dismissing the Chairman of the Village Consultative Body by the Village Head who does not have legality is null and void, as well as the Legal Consequences of the village head's legal action being declared null and void in the first place based on invalid authority and not fulfilling the provisions of the provisions which must be fulfilled in order for a village head's actions to be declared valid.

Abstract

There is authority and responsibility of the goverment in provinding road infrastructure to ensure the fulfillment of road infrastructure as stipulated in article 5 of law number 22 of 2009. The issue being discussed is whether the goverment is responsible if road infrastructure is not availaibleProvide input academically in the development of constitutional law related to the government’s responsibility for the provision of road infrastructure in law number 22 of 2009.This research is a normative legal research, statute approach, conceptual approach, primary legal materials, and secondary legal materials. Primary legal materials are linked to secondary legal materials where the management and analysis of legal materials is carried out qualitatively. Research shows that there is government responsibility and authority for the provision of road infrastructure for the common interest in order to create prosperity.

Abstract

Personal data is a human right protected by the constitution. Protection of personal data of Indonesian citizens is still weak, causing an increase in many cases of data leaks that are exploited by irresponsible parties. Protection of personal data in Indonesia is still sectoral, based on the authority granted by regulations governing personal data. The absence of specific regulations governing the protection of personal data causes frequent data leaks. The Ministry of Communication and Information has the authority to maintain personal security in Government Regulation Number 71 of 2019 concerning the Implementation of Electronic Systems and Transactions, which gives the Ministry of Communication and Information the authority to supervise the implementation of electronic systems and transactions. The government's responsibility has been regulated in Article 58 paragraph 1 of Law Number 27 of 2022 concerning Protection of Personal Data, which states that "The government plays a role in realizing the implementation of personal data protection in accordance with the provisions of the law." The forms of efforts made by the government regarding the protection of its citizens' personal data are in the form of increasing system security, conducting security supervision, providing security certification, security auditors, cooperation with the security industry and the government has the authority to require violators to inform the public or related parties of the violation. Additional types of administrative sanctions may include written warnings, temporary suspension of personal data processing activities, deletion or destruction of personal data, and/or financial fines.

Abstract

Protection of casual workers is to guarantee the basic rights of workers/laborers and guarantee equal opportunities and treatment without discrimination on any basis to realize the welfare of workers/laborers and their families while still paying attention to the development of the progress of the business world. Workers need to be protected by both employers/entrepreneurs and the state through government intervention. In accordance with the purpose of this study, the type of research used is socio-legal research. Socio -legal research , namely a research method that combines doctrinal legal research methods and empirical legal research methods. Doctrinal research is intended to conduct library research by identifying laws and regulations and collecting other data related to the problem being studied. In reality, casual daily workers who work on bobong ships owned by employers, they work without any guarantee other than a verbal agreement about the income earned every time they go to sea or given every week according to mutual agreement. Casual daily fishermen on these bobong ships do not receive social security in the form of health insurance, accident insurance or death insurance which is their right, in accordance with the laws and regulations governing the matter in question.

Abstract

The authority of the Ambon city government over child victims of economic exploitation is urgently needed, given that children are the next generation of the nation and state that must always be protected, and their growth and development is paid attention to with the rights they have which have been regulated in the Laws and Regulations. The purpose of this study was to find out and understand how the authority of the Ambon City Government for Children Victims of Economic Exploitation is in accordance with Legislation and what forms of legal protection for children who are victims of economic exploitation. The research method used is normative legal research method and is analyzed qualitatively. The results and discussion show that the Ambon City Regional Government is based on the provisions of Article 20 and Article 21 paragraph (1) to (4) of Law Number 35 of 2014 concerning Child Protection and the provisions of Article 23 paragraph (4) of Ambon City Regional Regulation Number 1 of 2019 Concerning the Implementation of Child Friendly Cities, has authority over the implementation of Child Protection, respects the fulfillment of Children's Rights, guarantees the fulfillment of Children's Rights and is responsible for formulating and implementing policies in the field of implementing Child Protection. Authority Regional Government Against Children according to Law Number 35 of 2014 concerning Child Protection includes the obligations and responsibilities of the Regional Government. However, in the Ambon City Regional Government Regulation which specifically regulates the implementation of Means of Fulfilling Legal Protection Rights for children, it does not give law enforcement authority to the Regional Government against the perpetrators.

Abstract

The state recognizes and respects the unity of customary law communities and their traditional rights as long as they are still alive and in accordance with the development of society and the principles of the Unitary State of the Republic of Indonesia, which are regulated in law" Article 18(b) paragraph 2 of the 1945 Constitution is the legal basis for recognizing the existence of the community customary law in Indonesia which has rights and authority to be respected and respected. The existence that has been recognized on a clear legal basis means that customary law communities have the authority to manage and manage their own customary territories as they should. The authority that is meant is the authority to manage the land and even the sea which is the ownership right of the indigenous communities themselves. Marine management rights by customary law communities or what is usually called marine ulayat rights are a set of rules or practices for managing marine areas and the resources therein based on customs carried out by coastal communities in villages. Regional Governments are obliged to provide recognition of marine management rights to customary law communities. This is clearly stipulated in Law Number 1 of 2014 in article 20 paragraph (1): The Government and Regional Governments are obliged to facilitate the granting of location permits and management permits to Local Communities and Traditional Communities "But what if the regional government does not grant marine management rights in accordance with the applicable law.

Abstract

Ambon City Regional Regulation number 10 of 2017 concerning the Appointment, Election, Inauguration and Dismissal of the Head of State Government is the legal basis for every implementation of state regulations in Ambon City, this means that every state regulation made must be based on Ambon City Regulation Number 10 of 2017 2017. In making regulations, whether regional regulations or state regulations, appropriate and appropriate adjustments are needed in terms of determining the title and material content contained in the regulation, but it is not uncommon for there to be regulations that are not appropriate. The mismatch between the title of a state regulation and the content of the content material is certainly something that is very contrary to the law which will of course give rise to legal consequences. One of the state regulations which has a different title and content material is the Hative Kecil state regulation Number 6 of 2020 concerning the determination of house points. parents in the Hative Kecil country, with the title determining the terms of the parental home, the content material contained in this state regulation should only be limited to the scope of the parental home in the Small Hative State, but unfortunately the content material contained in the state regulations already covers all matters regarding Small Hative Country, starting from the appointment of the head of government of Small Hative Country, the election of the head of the state government, to the dismissal of the head of the state government, of course it is clear that the title of this state regulation does not match the existing content material, for this reason, this difference is certainly contrary to law and can give rise to legal consequences.
